7 WHEREAS, Ordinance No. 17,085 was passed on January 16, 1996, establishing a Planned Zoning'
8 District titled Reservoir Flat Addition Short -Form PD-R (Z-5845-B), located on the east side of Reservoir
9 Road, approximately 0.75 miles north of Rodney Parham Road and one (I) -mile south of Cantrell Road;
10 and,
11 WHEREAS, the development of the site plan as proposed for Reservoir Flat Addition Short -Form PD-
12 R (Z-5845-B), located on the east side of Reservoir Road, approximately 0.75 miles north of Rodney
13 Parham Road and one (I) -mile south of Cantrell Road has not occurred and the owner of the subject
14 property has requested the repeal of the "PZD" ordinance and restoration of the zoning classification as
15 previously existed;
16 NOW, THEREFORE BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
17 OF LITTLE ROCK, ARKANSAS.
18 Section 1. That Ordinance No. 17,085 is hereby repealed, removing from the official zoning map the
19 classification PD-R.
20 Section 2. That the property described as: A parcel of land in Section 35, T-2-N, R-13-W and located
21 on the east side of Reservoir Road approximately 0.75 miles north of Rodney Parham Road and one (1)-
22 mile south of Cantrell Road, Little Rock, Arkansas, being more particularly described as follows:
23 commencing at the northwest corner of the SW '/4 NW '/4 of said Section 35; thence S86°31'25"E along the
24 north line of said SW '/4 NW '/4 20.0 feet to a point on the east right of way line of Reservoir Road said
25 point being the POB; thence continuing S86°31'25"E along the north line of said SW '/4 N W '/4 476 91 feet;
26 thence S02°34'07"W 190.0 feet; thence N86°34'30"W 50.70 feet; thence N71°06'25"W 105.57 feet;
27 thence N89°40'30"W 98.95 feet; thence S77°14'24"W 100.99 feet; thence S65°40'31"W 109.19 feet;
28 thence S73°40' 15"W 33.79 feet to a point on the east right of way line of Reservoir Road; thence
29 NO2°44'32"E along the east right of way line of Reservoir Road 258.03 feet to the POB containing 2.08
30 acres more or less is hereby revoked and the underlying R-5 Zoning District zoning classification is hereby
31 restored to the property.
32 Section 3. That the map referred to in Chapter 36 of the Code of Ordinances of the City of Little Rock,
33 Arkansas, and designated district map be and is hereby amended to the extent and in the respects necessary
34 to affect and designate the change provided for in Sections 1 -and 2 hereof.

Section 4. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or
adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and
effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the
ordinance.
Section 5. Repealer. All laws, ordinances, resolutions, or parts of the same that are inconsistent with
the provisions of this ordinance are hereby repealed to the extent of such inconsistency.

The request is a revocation of the existing PD-R zoning and
the restoration of the underlying R-5 Zoning District.
None.
Staff recommends approval of the requested PD-R zoning.
The Planning Commission voted to recommend approval of
the requested zoning by a vote of 8 ayes, 0 noes and
3 absent.
The Planning Commission reviewed the proposed PD-R
request at its August 22, 2013, meeting. There were no
registered objectors present. All property owners located
within 200-feet of the site along with the Sturbridge
Neighborhood Association were notified of the Public
Hearing.
BACKGROUND
Ordinance No. 17,085 adopted by the Little Rock Board of
Directors on January 16, 1996, rezoned the site from R-5
Zoning District to PD-R to allow development of a
residential complex. The proposal included 2.2 acres and
was proposed as a townhome community. The developer
proposed to construct 15 attached homes; there was one
duplex building, three tri-plex buildings, and one four-plex
building. The homes were proposed as two story buildings.
Each of the homes was to be located on a stand-alone lot
served by private streets. The development has not
occurred. The applicant is requesting a revocation of the
PD-R zoning and the restoration of the R-5 Zoning District.
Per Section 36-454(d) The owner of an approved PD or
PUD may, for cause, request repeal of the ordinance
establishing the development when it has been determined
that the development will not occur. A written request may
be filed with the City staff at any time up to three (3) years
after the date of adoption of the ordinance creating the PUD
or PD. The request shall set forth the cause of the repeal.
The owner has stated the townhouse development will not
occur. The owner is requesting the PD-R zoning be
revoked and the R-5 Zoning District zoning be restored.

recommendation.

I was unable to develop the property as was envisioned by the proposed PD-R and I would
like to have the previous zoning classification (R-5) reinstated.
