B. Staff Analysis:
#5 Cimarron Valley does not have a carport or garage, and
the owners of the property would like to build a detached
carport and storage area in the rear yard. The area that
was used as a carport has been enclosed. The proposal is to
construct the carport less than 2 feet from the residence.
The Zoning ordinance state that all single family residences
shall be separated from accessory structures by a distance
of not less than 6 feet. (Attaching the carport to the
house would still require a variance because there would be
an encroachment into the 25 foot rear yard setback.)
Because of the location of the driveway and easements on the
lot, placing a carport on the property is somewhat limited,
especially without some type of variance. The proposed

- construction appears to be the most reasonable solution for
providing the needed carport and storage area. Allowing a
separation of less than 6 feet will not affect the adjoining
lots, nor will it be visible from the street.
In addition to the requested variance, the Board will also
need to grant a variance from the 30% coverage provision.
Staff's review of the issue has determined that the square
footage of the carport and storage area exceeds the 30%
restriction. This is based on the dimensions provided on
the survey.
C. Staff Recommendation:
Staff recommends approval of both variances for the carport
and storage area.
BgARD OF AD STMENT: (APRIL 25, 1994)
The applicant, James Battreal, was present. There were no
objectors and there was no discussion.
A motion was made to approve the variance and for the accessory
structures to exceed 30% coverage in the rear yard. The motion
passed by a vote of 7 ayes, 0 nays, 1 absent and 1 open position.
