Our firm represents the Cantrell Road Property Owners' Sewer Improvement District No.
252 of Little Rock. The PCD offered by Mr. Bill Dean for your consideration is within the sewer
District.
The District was formed in 2002 to provide public sewer service to an unserved pocket
along Cantrell Road from Walgreens to Rurnmel Road. The sanitary sewage collector system -
constructed by the District at a cost of more than $150,000 has contributed to orderly growth of
the City by providing; this essential infrastructure. Development of the properties served by the
District to date has also provided new tax revenue and jobs for the City through new business
operations.
There are only eight property owners supporting; the indebtedness of the District, and
unfortunately most of the District properties remain undeveloped or only partially developed.
There is also only one tie -on of property available for future expansion of the District service
area. It adjoins the District on the north. New developments on District properties and
Particularly the future property tie -on will benefit District property owners by providing
'additional assessment revenues to decrease annual assessments and/or shorten the term of the
District's indebtedness. There are currently twenty-two years remaining on the debt, and the
average property owner assessment is well over $2,000 per year.
This is a request for approval of the Magnolia Terrace PCD rezoning on behalf of the
District property owners. Approval of the request will pave the way for development of three
presently undeveloped parcels into three office buildings and one business. More importantly,
-the large land parcel adjacent to the north side of Magnolia Terrace is the sole future acreage tie-
onpossible for the District. Tile proposed street extension to the property by the Magnolia
Terrace PCD will facilitate future development of the tract since the property is presently
functionally landlocked.
Without adequate public street access, this 50 acre plus tract adjacent to the District on
the north side will be difficult if not impossible to develop into the residential lots planned under
the current City zoning. This would deny the District property owners the opportunity to
substantially reduce or even possibly even eliminate their assessment taxes through growth of the
District's assessment base.
it should be a priority of the City to encourage infill developmcrtt within current City
boundaries and reduce tite tendency toward continued urban sprawl leading to demand for
expensive expansions of fire, police, and other municipal services. Developments such as that
proposed by the Magnolia Terrace PCD project also directly benefit the City by providing an
increased real property tax base and new jobs for City residents.
Approval of the proposed Magnolia Terrace project PCD will provide benefits to the
sewer District property owners, adjoining property owners, and the City of Little Rock, and, we

the Land Use Plan, the subject property has a "transition" designation which would include
low density multi -family housing and office uses, not commercial uses.
The approval of this application would further expand the commercial node at Taylor Loop
and Cantrell by approximately 1-4 mile, considerably more than the limited scope of
commercial use at selected intersections designated in the Highway 10 Scenic Design
Overlay District. As has been previously expressed to the Planning Commission and Board of
Directors, incremental allowance of exceptions to the Highway 10 Scenic Design Overlay
District is simply not an option for the residential neighborhoods in this area.
As you are all aware, the Highway 10 Scenic Design Overlay District was created to benefit
the entire City. It our opinion that the application at hand would only benefit the
applicant. As such, the Little Rock Municipal Code concerning the formation of PCDs would
prohibit the approval of the application. Simply put, a request for a PCD should not be
granted for the benefit of the applicant to the detriment of many.
That is not to say that we are opposed to development. Only that we oppose development
which would be contrary to the Highway 10 Scenic Design Overlay District, Land Use Plan
and any other applicable laws or regulations which are designed to benefit the public at
large.
As I indicated in my written and oral comments to the Board of Directors earlier this week
in support of the Planning Commission's denial of an application by Team Clean Carwash,
allowing commercial uses in this area which are contrary to the Highway 10 Scenic Design
Overlay District and Land Use Plan only serves to open Pandora's box. Once opened, it will
be difficult, if not impossible, to close it. In other words, the approval of one
commercial use where it is not already provided for will result in additional applications
requesting approval for other commercial uses where they are not already provided for and,
to some degree, the justification for denying them will be jeopardized.
I'm asking that you uphold the land use plan within the Highway 10 Design Overlay and deny
these applications.

Though Mr. Dean is making some changes in his original proposal,
which was
rightly rejected by the Commission, we still do not feel a battery store,

its high traffic vehicles, is appropriate for this area.
Recently we headed to the interstate from Rummel Rd at 4:30 in the
afternoon.
It took us 40 minutes. 40 MINUTES!! There was no accident — just high
volume
and traffic lights. Where will it end? How do we control it if we keep
opening
high traffic businesses along our "scenic corridor"? We urge the
Commission
to continue to take a stand and stop this type of expansion.
On a positive note, the Easter Seal proposal (Z -5139F), seems to be a
great option
for this space and we support it.

A planned development of three lots was submitted to the Planning Commission approximately a year ago.
The Planning Commission turned down the proposal primarily because it included a retail use (a battery store)
on one of the lots.
The applicant, Bill Dean, was the owner of two of the lots (Lots 1 and 2 of the Magnolia Ten•ace
Subdivision). Lot 3 was owned by another person. Lot 2 is under contract to be sold, conditioned upon the
City's approval of the requested retail use.
Mr. Dcan has scheduled an appeal before the City Board for February 7, 2012.
During the process, Mr. Dean lost his two lots to iberiabank through foreclosure. His role at present is as the
engineer for the potential buyer of Lot 2.
I am :lberiabank's real estate agent. Iberiabank is allowing the appeal to take place only under certain
circumstances: 1) An understanding that the applicant, Bill Dean, is riot the bank's agent and cannot commit
the bank to any agreement. 2) The bank has not and will not agree to any monetary outlay, such as
constructing any streets or drainage improvements until the development of lot 1 (the lot remaining after the
sale of Lot 2.)
Please advise me whether or not the scheduled appeal can proceed under these circumstances, or under what
circumstances we can proceed.

The request is an appeal of the Planning Commission's
recommendation of denial of a rezoning from R-2, Single-
family to POD to allow for the development of the site with
four lots containing office and retail uses.
None.
Staff recommends denial of the requested POD zoning.
The Planning Commission voted to recommend denial of
the requested zoning by a vote of 1 ayes, 8 noes and
2 absent.
The Planning Commission reviewed the proposed POD
request at its October 6, 2011, meeting. There were
registered objectors present. The Pinnacle Valley
Neighborhood Association, the Westchester/Heatherbare
Neighborhood Association, the Tulley Cove Property
Owners Association and all property owners located within
200 -feet of the site were notified of the Public Hearing.
BACKGROUND
Ordinance No. 16,690 adopted by the Little Rock Board of
Directors on June 7, 1994, established South Hills Terrace
Addition Short -form POD, for a portion of this site
containing 1.27 acres. The proposal included (Phase I) the
utilization of an existing residential structure located at the
rear of the site as an office use for a civil engineering
company and (Phase II) was to consist of the construction
of a second office building (5,080 square feet) at the front
of the property. The Phase I proposal included the
remodeling of the existing structure and the utilization of
the existing 12 -foot driveway. The Phase II portion
included the abandonment of the existing driveway, closure
of the existing curb cut and construction of a new driveway
and curb cut. The new curb cut was to be 24 -feet. A new
septic system was proposed on the site with connection to
city sewer when service became available. The applicant
indicated upon availability of sewer service Phase II would
be initiated. The Phase II portion of the development was
not constructed.
Ordinance No. 18,211 adopted by the Little Rock Board of
Directors on February 15, 2000, established the Childress
Short -form POD on property adjacent to the east containing
1.5 acres. The site contained a 9,400 square foot, two-story
brick building which was previously used as a non-
conforming photography studio. The applicant proposed
the rezoning to allow redevelopment of the site with
building and parking lot additions. The applicant proposed
0-1, Quiet Office District uses as allowable uses for the
site. The applicant proposed a two phased development for
the property: Phase I included the construction of an
asphalt drive extending from Cantrell Road, construction of
24 parking spaces on the south side of the existing building,
dumpster location, use of the exiting building for 0-1
permitted uses. Phase II was to consist of the construction
of an 8,000 square foot addition to the existing building,
extend the driveway along the east side of the building,
construction of 32 additional parking spaces on the north
side of the building, relocation of the dumpster area. The
applicant noted a single sign would be placed near the
entrance to the property, which would conform to the
Highway 10 Design Overlay Standards.

CONTINUED
An application was filed for Lots 2 and 3 of the Boydston
Subdivision to rezone the property from R-2, Single-family
to C-3, General Commercial District. The area is located
west of the South Hills Terrace Addition POD. The request
was withdrawn prior to the legal ad being placed for the
June 11, 1985, Planning Commission Public Hearing.
Ordinance No. 18,564 adopted by the Little Rock Board of
Directors on September 18, 2001, rezoned Lots 1, 2 and 3
of the Boydston Subdivision from R-2, Single-family to
POD. The Board of Directors revoked the POD zoning
approval on April 20, 2004, by the adoption of Ordinance
No. 19,085 restoring the previously held R-2, Single-family
zoning classification. The property contained 1.29 acres.
Ordinance No. 19,506 adopted by the Little Rock Board of
Directors on March 21, 2006, rezoned the two previously
approved POD's and expanded the area to property located
to the west of the POD zoned property (the expanded area
was zoned R-2, Single-family) to POD to allow the
development of four buildings on three lots. 0-3, General
Office District uses were approved as allowable uses for the
site. The approval did allow the placement of ten percent
of the total gross floor area as an accessory use as identified
in the 0-3, General Office Zoning District. The lots ranged
in size from 1.18 acres to 1.53 acres. The construction of a
single story building was proposed for Lots I and 2 and Lot
3 was proposed with two buildings, a single -story building
and a two level building utilizing the slope of the site, The
building located on Lot 1 contained 9,000 square feet. The
building on Lot 2 contained 12,600 square feet and the
building on Lot 3 contained a 3,000 square foot building
and a 12,000 square foot building.
On May 19, 2011, the Little Rock Planning Commission
denied a request to allow the site to develop with four (4)
lots containing a mixed use development of office and retail
uses. The buildings were proposed containing 3,000 square
feet to 19,000 square feet. The uses included the uses
within the 0-3, General Office Zoning District including
the ten percent allowable accessory uses for Lots 1 and 3B
and C-1, Neighborhood Commercial Zoning District for

Lot 3A." The request included setback and landscaping less
than the typical standard set forth in the Highway 10
Design Overlay District. This recommendation was
appealed to the Little Rock Board of Directors but was
withdrawn prior to the Board acting on the request.
Ordinance No. 20,453 adopted by the Little Rock Board of
Directors on August 16, 2011, repealed the previously
approved POD's for these properties restoring the zoning to
R-2, Single-family.
The applicant is now proposing to rezone the property from
R-2, Single-family to POD to allow the development of
four (4) lots, one (1) containing Battery Outfitters and the
remaining three (3) lots with office buildings utilizing 0-3,
General Office District without the ten percent allowed
accessory uses. This plan differs from the plan denied by
the Planning Commission on May 19, 2011, by the
dedication of right of way for a public street and staged
construction of 290 linear feet of collector roadway and
deletion of the previously proposed C-1, Neighborhood
Commercial District uses for Lot 3A in favor of 0-3,
General Office District uses.
The following notes the specific requirements of the
Highway 10 DOD that the applicant is not meeting:
• There shall be a minimum development tract size of not
less than two (2) acres — the lots are proposed
containing less than the two acre minimum criteria, Lot
1 is proposed containing 1.19 acres, Lot 2 1.35 acres
Lot 3 A 0.90 acres and Lot 4 0.61 acres
• Side yard shall not be less than thirty (30) feet — The
eastern side yards on Lots 2, 3A and 3B do not meet
this minimum requirement
• Rear and side yards shall have a landscaped buffer
averaging a minimum of twenty-five (25) feet from the
property line. Where such yards abut a street right-of-
way, a fifteen -foot landscaped strip shall be required
adjacent to land zoned office and residential. A seven -
foot landscaped strip shall be required when adjacent to
lands zoned commercial — Lot 1 is not meeting the
25 -foot landscape strip requirement along the northern
perimeter, the remaining landscape strips appear to
meet the Overlay standard

• Ma)imum, one (1) curb cut per three hundred (300) feet
and no curb cut closer to an intersection than one
hundred (100) feet - the site as developed is not
meeting this requirement
• The maximum number of buildings per commercial
development shall be measured both by minimum tract
size and minimum frontage as follows: One (1) building
every two (2) acres — the development is not complying
with this standard, the lots are proposed less than two
acres
Although the applicant has done an adequate job in
addressing some of the development criteria of the
Highway 10 Design Overlay standards staff is not
supportive of the request. The site is indicated as Suburban
Office on the City's Future Land Use Plan. Suburban
Office is to provide low intensity development of office or
office parks in close proximity to lower density residential
areas to assure compatibility, The applicant is requesting a
stand-alone commercial use, Battery Outfitters, which does
not meet the Suburban Office Land Use Classification.

invalid or unconstitutional, such declaration or adjudication shall not affect the
remaining portions of the ordinance which shall remain in full force and effect as if

Submitted herewith are seventeen copies of the revised site plan for the proposed project.
Also enclosed are an Information Sheet and PZD Application Form. The filing fee was
previously paid on March 11, 2011.
The proposed revisions to the previous application are:
1. Dedication of a 60' width public street right-of-way and staged construction of 290
linear feet of collector roadway.
2. Deletion of the previously proposed retail use for Lot 3A in favor of exclusive use as
suburban office.
The public street right-of-way dedication and staged collector street construction are
needed to provide an adequate future access for the development of the Hughes Estate
property, a large (approximately 53 acres), functionally land -locked property ownership
that adjoins the north boundary of Magnolia Terrace. The property is functionally
land -locked because the existing Sorrels Road access cannot be brought to City standards
in its present location due to (a) inadequate separation distance between the present
Cantrell intersection and the North Taylor Loop Creek bridge end and (b) since the
existing roadway curvatures are too severe. These deficiencies cannot be corrected
without acquisition or condemnation of private property external to the land -locked tract.
The principal project neighborhood interests that would be impacted by the proposed
development include Westchester Subdivision, Tulley Cove neighborhood, the
Sorrells Road/Thomas Park area, the Hughes Estate property, and the property owners of
the Cantrell Road Property Owners Sewer Improvement District #252 (SID 252).

The property owners of SID 252 include the owners of all the developed and
undeveloped properties along Cantrell Road from Walgreens west to Sorrells Road. The
developed properties, which include a bank, a dentist office, a pain clinic, a fast food
restaurant and a pet clinic, as well as the undeveloped properties pay an annual
assessment on their real property tax bills to retire the cost of the area's sewage collection
system.
The Hughes Estate property has access to the SID 252 sewer but is not presently part of
the sewer district and does not contribute to the district's debt retirement. However, due
to topography, over 40% (approximately 20.5 acres) of the residentially zoned tract must
be sewered by connection to SID 252 facilities. The future development of the Hughes
property will increase the SID 252 assessment base and substantially reduce the annual
costs for all the sewer district patrons. It is therefore in the best interest of the existing
sewer district patrons to facilitate future development of the Hughes Estate property. The
public street right-of-way dedication proposed as part of the Magnolia Terrace project
will serve this purpose.
It should be noted that access to the SID 252 public sewer system for the Hughes Estate
property has been previously provided by recorded easement dedications as shown on the
Magnolia Terrace site plan.
The provision of adequate public sewer and street access are keys to sound land use
planning and orderly growth of the City of Little Rock. Future development of the
Hughes Estate property will represent in -fill development of the City and lessen the need
for continued urban sprawl by making more property within the City available for
residential development.
The concerns of the existing residential neighborhoods were expressed at the Planning
Commission Public Hearing on May 19, 2011. The principal concerns expressed
included:
- Local flooding in Westchester Subdivision
- Downstream flooding affecting Tulley Cove and Thomas Park
- Traffic volume and speed on Cantrell Road
- Additional development encroachment on Tulley, Sorrells, and Thomas Park
- Conformance to the Highway 10 Overlay Plan
The neighborhood concerns are addressed as follows:

Westchester Flooding
The proposed project will eliminate the addition of some 22 acres of hillside drainage that
presently crosses Cantrell and adds to the backwater pool on the upper side of the North
Taylor Loop Creek bridge during extreme rainfall events. The diversion of a substantial
portion of drainage area from the upstream side of the bridge will contribute to lowering
of the backwater profile further upstream on the creek channel. In turn, this will serve to
improve positive drainage of the interior storm drainage system in Westchester into
Taylor Loop Creek during extreme events.
Downstream Floodin
City development codes require stormwater detention facilities to be designed to detain
the volume of water necessary to insure that the post -development peak discharge from a
project is no greater than the pre -development peak discharge. The City's engineering
design specifications require that calculations be based on the 25 -year storm event. The
Magnolia Terrace project proposes to use a 50 -year storm event for storage design so that
the post -development peak discharge from the project will actually be less than the
required pre -development peak discharge. Use of the more stringent detention design
criterion will serve to diminish downstream peak flows and lessen flood damage
potential.
Traffic Volumes and Speeds on Cantrell
The proposed land uses of the revised Magnolia Terrace project are predominately office
with a single retail warehouse business. The office uses proposed total 17,465 square
feet, and the retail warehouse use totals 5,472 square feet consisting of approximately
3,648 square feet of inventory storage and 1,824 square feet of space for retail trade. The
retail use portion of the building therefore represents less than 8% of the total
development building space.
The average daily traffic of the limited retail use will be approximately 50 stops per day
on average with a maximum daily traffic of less than 100 stops. The majority of trade
traffic is expected to come from within a six mile radius of the location and is not
expected to be drawn from outlying neighborhoods or suburban areas.
The Arkansas Department of Highways estimates the average daily traffic volume along
the subject stretch of Cantrell Road to range between 26,000 and 38,000 vehicles per day.
The proposed Magnolia Terrace land uses should not produce any discernable increase in
traffic flow on Cantrell Road.

Cantrell Traffic Volumes and Seed --- Continued
Regarding Cantrell traffic speed, the Magnolia Terrace project proposes a public collector
street connection to facilitate future residential development to the north of the project
area as well as to provide improved ingress and egress for Sorrells Road and Thomas
Park residents. At such time as the envisioned neighborhood street improvements are
complete, it is expected that the future collector street intersection on Cantrell will require
signalization that will serve traffic stilling purposes and significantly reduce the present
high speed hazard on this part of Cantrell Road.
Additional Develo ment Encroachment on Sorrells. Thomas Park, and Tulley Cove Areas
Encroachment of new development of any type on the north side of Cantrell Road from
Sorrells Road west to the confluence of the North and South Forks of Taylor Loop Creek
will be severely restricted due to the floodway/floodplain zones of the North Fork of Taylor
Loop Creek. These zones, particularly the floodway zone, essentially dictate no further
development along the north side of Cantrell for more than one-half mile west of Sorrells
Road. The natural buffer provided by these regulatory flood zones preclude encroachment
of new development of any type on the three subject neighborhoods.
Conformance with Highway 10 Overlay Plan
As earlier noted, the proposed project is overwhelmingly office use in conformance with
the Highway 10 Overlay Plan. The sole exception being requested is that for a retail
warehouse business, specifically and exclusively that of Battery Outfitters.
Of the total proposed building space of 5,472 square feet, only one-third or
approximately 1,824 square feet will be dedicated to retail traffic with the balance to be
devoted to inventory storage.
Meetings with members of the neighborhood groups have revealed some
acknowledgements that the Battery Outfitters facility will be a low-volume, low -impact,
environmentally friendly, and to some a welcome convenience as a local neighborhood
service store. However, the fear exists that any successor retail operation of 5,472 square
feet of floor space could involve substantially more negative neighborhood impacts than
the Battery Outfitters operation.

Conformance with Hi hwa 10 Overla Plan
In order to allay the neighborhood concerns over future retail use of the Battery Outfitters
location, it is proposed that approval of the application stipulate that any future retail use
of the building will be limited to no more than 12% of the total development floor space
or no more than 2,750 square feet for retail trade. In addition, that the hours of operation
of any successor use will be limited to the same operating hours as the Battery Outfitters
use. These stipulations will be enforceable through the City's existing building code and
certificate of occupancy regulations. The stipulations will insure than any successor
retail use of the site will be a similar, low-volume, low -impact use similar to that of
Battery Outfitters.
