The project was scheduled for a Board Hearing last Tuesday evening but was rescheduled for the next Board meeting on August 2nd. However,there have been substantial changes in the originally proposed plan. The changes involve a proposed public street dedication and changes in land use. We feel that the changes need to be reviewed by the Planning Commission and the Public Works Department before the proposals are heard before the City Board. Therefore, please consider this request to delete Ordinances Z -5817-D and Z -5817-B from the Board agenda for the next meeting. While we realize that as the city expands we can no longer enjoy Cantrell that way, we are concerned that the scenic designation for this area is in jeopardy, with development that has already occurred and what appears to be a disregard for the "scenic" designation in favor of commercial development. Of course we are concerned about property values in our neighborhood if certain types of businesses which generate a lot of traffic or noise are allowed at this intersection. Looking at the wording of the Highway 10 Scenic Ordinance we question whether this current development fits the purpose of retaining the scenic component of this area. Please encourage the commissioners to re -read this ordinance and vote to discourage this project. We've been strong supporters of the Highway io DOD and think that after almost 20 years still is a valuable design and planning tool. No one can question that the commercial node at Taylor Loop has now expanded west to Regions Bank. Good, bad or indifferent that is what is now in place. However, that expansion does not justify the reasoning of these 2 applications to jump over Regions and the medical offices that are designated on the land use plan as Suburban Office and allow for C -3/C-4 uses in the Suburban Office designation. Our objection to these applications is one of principle. We have an extremely difficult time exiting onto Hwy 10 now with NO businesses in this area. Adding businesses with vehicles of all sizes entering and exiting will hinder visibility from Rummel Rd and complicate an already dangerous situation. None. Staff recommends denial of the requested POD zoning. The Planning Commission voted to recommend denial of the requested zoning on the consent agenda by a vote of 1 ayes, 9 noes and 1 absent. The Planning Commission reviewed the proposed POD request at its May 19, 2011, meeting. There were registered objectors present. The Pinnacle Valley Neighborhood Association, the Westchester/He atherb are Neighborhood Association, the Tulley Cove Property Owners Association, all residents who could be identified located within 300 feet of the site and all property owners located within 200 -feet of the site were notified of the Public Hearing. BACKGROUND Ordinance No. 16,690 adopted by the Little Rock Board of Directors on June 7, 1994, established South Hills Terrace Addition Short -form POD, for a portion of this site containing 1.27 acres. Ordinance No. 16,691 allowed for a deferral of the required sidewalk, the required detention and the front yard landscaping for three years or to within sixty days of completion of the sewer main which was proposed for constructed along the Highway 10 frontage of the property. The proposal included (Phase I) the utilization of an existing residential structure located at the rear of the site as an office use for a civil engineering company and (Phase II) was to consist of the construction of a second office building (5,080 square feet) at the front of the property. The Phase I proposal included the remodeling of the existing structure and the utilization of the existing 12 - foot driveway. The Phase II portion included the abandonment of the existing driveway, closure of the existing curb cut, and construction of a new driveway and curb cut. The new curb cut was to be 24 -feet. A new septic system was proposed on the site with connection to city sewer when service became available. The applicant indicated upon availability of sewer service Phase II would be initiated. Ordinance No. 18,211 adopted by the Little Rock Board of Directors on February 15, 2000, established the Childress Short -form POD on property adjacent to the east containing 1.5 acres. The site contained a 9,400 square foot, two-story brick building which was previously used as a non- conforming photography studio. The applicant proposed the rezoning to allow redevelopment of the site with building and parking lot additions. The applicant proposed 0-1, Quiet Office District uses as allowable uses for the site. The applicant proposed a two phased development for the property: Phase I included the construction of an asphalt drive extending from Cantrell Road, construction of 24 parking spaces on the south side of the existing building, dumpster location, use of the exiting building for 0-1 permitted uses. Phase II was to consist of the construction of an 8,000 square foot addition to the existing building, extend the driveway along the east side of the building, construction of 32 additional parking spaces on the north side of the building, relocation of the dumpster area. The applicant noted a single sign would be placed near the entrance to the property, which would conform to the Highway 10 Design Overlay Standards. 2 BACKGROUND CONTINUED An application was filed for Lots 2 and 3 of the Boydston Subdivision to rezone the property from R-2, Single-family to C-3, General Commercial District. The area is located west of the South Hills Terrace Addition POD. The request was withdrawn prior to the legal ad being placed for the June 11, 1985, Planning Commission Public Hearing. Ordinance No. 18,564 adopted by the Little Rock Board of Directors on September 18, 2001, rezoned Lots 1, 2 and 3 of the Boydston Subdivision from R-2, Single-family to POD. The POD zoning approval was revoked by the Board of Directors on April 20, 2004, by the adoption of Ordinance No. 19,085 restoring the previously held R-2, Single-family zoning classification. The property contained 1.29 acres. Ordinance No. 19,506 adopted by the Little Rock Board of Directors on March 21, 2006, rezoned two previously approved POD's and expanded the area to property located to the west of the POD zoned property (the expanded area was zoned R-2, Single-family) to POD to allow the development of four buildings containing on three lots. 0-3, General Office District uses were approved as allowable uses for the site. The approval did allow the placement of ten percent of the total gross floor area as an accessory use as identified in the 0-3, General Office Zoning District. The lots ranged in size from 1.18 acres to 1.53 acres. The construction of a single story building was proposed for Lotsl and 2 and Lot 3 was proposed with two buildings, a single -story building and a two level building utilizing the slope of the site. The building located on Lot 1 contained 9,000 square feet. The building on Lot 2 contained 12,600 square feet and the building on Lot 3 contained a 3,000 square foot building and a 12,000 square foot building. The overall development plan was in compliance with the Highway 10 Design Overlay District with the exception of the rear yard setback which was approved with a 25 -foot setback (40 -feet typically required per the DOD). The dumpster service hours were limited to 7 am to 7 pm. 3 BACKGROUND CONTINUED The applicant is now requesting to rezone the property to POD to allow additional retail uses to locate within the development. The property was approved in 2006 as a Planned Office Development consisting of three lots and four structures. The approval allowed for the construction of buildings ranging in size from 3,000 square feet to 19,000 square feet. The approved uses for the site were those listed in the 0-3, General Office Zoning District with the allowance of ten (10) percent of the total gross square footage with the accessory uses identified in the 0-3, General Office Zoning District. According to the applicant development and marketing efforts on the approved buildings for use as large executive office suites have proved unsuccessful over the five years since approval of the 2006 plan. The applicant states other successful developments in the area since 2006 have included redevelopment of lots to accommodate single -occupancy, owner -occupied offices, small -space, lease -office buildings and multiple -use commercial/office use developments anchored by a commercial component. The proposed plan is designed to provide smaller buildings, less parking space, and more open/green space compared to the previously approved plan. In short, the current proposal represents a much less intense use of the property. In addition, the current proposal is for a mixed office/commercial development similar to other successful development projects approved for the area. Lot 1 is to remain as suburban office with 0-3, General Office District uses as previously approved. The building is proposed as a single story building containing 8,000 square feet. Lot 2 is proposed for use by Battery Outfitters, which is a light retail consumer battery outlet. The building is proposed containing 5, 472 square feet. Lot 3 is proposed to be replatted into two lots, 3A and 3B. Lot 313 will remain as an office use with 0-3, General Office District uses as previously approved. The building located on Lot 3A is proposed containing 5,625 square feet and is proposed for commercial use as defined in the C-1, Neighborhood Commercial zoning district. The building located on Lot 3B is proposed containing 3,840 square feet. C! BACKGROUND CONTINUED The proposed use of Lot 2 by Battery Outfitters will provide a much less intense site use than previously approved. Business hours will be daytime only (8:00 AM — 5:00 PM), six days per week. The business will have approximately 4-6 employees and can be considered light retail in volume. Restock freight deliveries will average from 1 to 3 per month. Stock delivery times will be scheduled for evening and nighttime arrivals to avoid high traffic periods on Cantrell Road and pose minimal disturbance to other neighborhood properties. Proposed commercial uses for Lot 3A will be similarly limited to light retail uses listed as approved uses under C-1 zoning district which include but are not limited to cellular phone service outlet, drugstore, florist/gift shop, jewelry store, hobby shop, pet store, tool and equipment rental with no outside display, dance studio, optics shop, clothing store, and camera shop. The Lot 3A building is proposed for a single user or multiple users in the C-1 zoning district. Lot 3A is currently proposed to have seventeen (17) parking spaces but could accommodate an additional nine (9) spaces if warranted by the specific use(s) to occupy the building. The current request will decrease the total building square footage by 44 percent, decrease parking spaces by 43 percent and increase open/green space by over 5,860 square feet from the March 21, 2006, approval. The proposed open/green spaces total 88,054 square feet or approximately 50 percent of the total development area. I am serving as the engineer for the proposed rezoning and represent myself as owner of Lots 1 and 2; Mr. Lane Shumaker of Battery Outfitters, proposed buyer of Lot 2; and Mr. J.J. Childers, owner of Lot 3. The subject properties were rezoned for office uses in 2006 with the intent of marketing the sites for executive lease office and office condominiums. Unfortunately, these marketing efforts have been unsuccessful over the last five years. Since the 2006 rezoning, other properties east of this site were redeveloped as mixed use projects consisting of commercial and office uses.. These successful projects are characterized by a commercial anchor to facilitate development of remaining space for office use. An example of the anchored mixed use that has occurred is the Regions bank branch, which was followed later by a dentist office and a pain clinic on the same parcel. Later still, a fast-food restaurant was allowed east of the bank location as a retail anchor portion of a larger mixed use development. Our current proposal is therefore based on the same premise as the other successful projects that have been approved to the east. We are, however,. mindful of our closer proximity to the Westchester neighborhood and are proposing o have only light retail uses that are suitable for operation near a residential neighborhood. In addition to the limited retail uses, we propose to greatly reduce the site use intensity from that which would have resulted from the 2006 plan. Page Two Compared to the 2006 plan, the current proposal would reduce the total building square footage by 44%, decrease the number of parking spaces by 43%, and increase open/green space by over 5,860 square feet. The proposed changes represent significantly less site use intensity than the previous plan. With the changes proposed, the total amount of space to be devoted to open/green space increases to approximately 50% of the total development area. Coupled with greatly reduced parking needs, the proposed development will provide present a more campus -like appearance than the previous plan that called for very large office buildings with attendant large parking capacity. The specific use proposed for Lot 2, Battery Outfitters, will be the principal retail anchor for the overall project. This use involves only daytime hours of operation, six days per week, and relatively few restocking deliveries each month with deliveries scheduled to arrive only during off-peak traffic hours. The business is neighborhood oriented and typically serves -a customer base within an eight mile radius of a store location. Women customers are a substantial portion of the business so the operation places a high priority on cleanliness and orderliness. There are no hazardous chemicals or other hazardous materials involved in the operation, and discarded batteries are picked up for recycling on a regular basis. The customer volume is relatively light compared to most retail operations due to the nature of the products sold, which can be characterized as specialty consumer product batteries. Example products include marine batteries, wheelchair batteries, batteries and battery packs for computers and electronic devices, ATV and jet-ski batteries, and a variety of rechargeable batteries for computers and, hand power tools. In-store customer service is also provided for replacement of watch batteries, computer power supplies, and even assembly of composite battery packs for uncommon appliances and applications that would otherwise be difficult to replace without going back to the device manufacturer. The staff analysis makes note of our further efforts to minimize the intensity of the proposed site uses in that no commercial uses will be allowed within the office portions of the development, and no eating establishments will be permitted in the light retail use proposed for Lot 3A. Please note that our proposal for Lot 3A use as submitted would allow multiple retail users within the 5,625 square foot building. The staff analysis also noted that building setbacks and landscape strips shown on the current proposal are in keeping with the previously approved plan. However, exception is taken to the comment that the backup slot on Lot 3A extends into the 25 foot side yard setback due to the fact that this was also the case with the development plan approved in 2006. If correction is required for the current proposal, this can be done without adverse impact to the building size or amount of parking. The previous approval of variances on setbacks and landscape strips was granted due to the progressively diminishing parcel sizes along the north side of Cantrell from Walgreens to Rummel Road. The subject three parcels are the smallest along this stretch of Cantrell due primarily to the northwest bearing of the roadway, which greatly affects the parcel depths and the opportunity for mixed use redevelopment on any one parcel. Although our proposal exceeds the minimum 51% office use (proposal as submitted is 52% office), staff has recommended denial on the basis of 48% light retail use being considered still too intense, despite the fact that the current proposal represents a much less intensive site use than the previously approved development plan (allowable retail use under the code is 49%). Even though our submittal meets code requirements for retail/office mixed use, in our. continuing efforts to satisfy both City and neighborhood concerns we would like to propose a change in the Lot 3A building from multiple -user light retail to mixed office and retail to further reduce the overall development intensity. The proposed change for your consideration limits retail use the 5,625 square foot building to no more than 50% of the total building space with the balance to be strictly office with no allowance for any amount of retail use within the office portion. The proposed use change for the Lot 3A building will reduce the total proposed retail use from 48% to 36% and increase the percentage of office use from 52% to 64%; these figures are 26.5% lower than the maximum allowable retail use and 26.5% over the minimum required office use stipulated in the code. The incursion is needed in order to have adequate "blind side" backing distance and backing turn radius for truck deliveries to the loading dock in the rear of the Lot 2 building. 3. The current proposal retains the reduced setbacks previously approved for this property. 4. Monument signage will not exceed 6' in height and 72 square feet in area. A Site Grading and Drainage Plan is submitted herewith that shows proposed finish grade contours. No variance to permit advance grading of lots is proposed. 5. Surface stormwater storage facilities are proposed as shown on the plans for Lots 2 and 3. Lot 1 will retain the previously approved underground storage facilities.
