Public Works Comments: Z -5808-B Pat Watson 4511 Asher Avenue Lots 4-11, Block 5, Remmel Addition I-2 A variance is requested from the area regulations of Section 36-320 to permit construction of a building with a reduced rear yard setback. The property is only 130 feet deep. Meeting the I-2 setbacks and providing the required on-site parking reduces the buildable area available on the site. Vacant, asphalt paved lots Econo auto painting Master Street Plan right-of-way requirement for Asher Avenue is 45 feet from centerline as indicated on the drawing submitted for Board of Adjustment application. If this dedication has not taken place, dedicate right-of-way prior to construction. With construction, the curb line on Asher Avenue should be reconstructed to 30 feet from centerline. A five foot sidewalk should be constructed on the frontage with appropriate handicap accessible ramps according to ADA standards. Adams Street needs a 5 foot sidewalk constructed on its frontage and widen Adams to 18, from centerline with curb and gutter. Improve corner radius of the curb line between at the intersection of Adams and Asher Avenue to 31.5 feet. Dedicate a 20 foot radial area at this corner intersection between the two perpendicular property lines. Driveways will be limited to one driveway for the frontage on Asher Avenue. Driveways at this intersection are to be 100 feet from the intersection and are limited to 40 foot maximum width. A grading permit and development permit for October 28, 1996 Item No.: B Cont special flood hazard areas is required prior to construction permit. B. Staff Analysis: The property located at 4511 Asher Avenue was rezoned from C-3 to I-2 on July 11, 1996. The site is vacant and was once part of properties occupied by Longbell Lumber Company. The applicant proposes to construct a new 7,200 square feet building on the property to be the new home of Econo Auto Painting, currently located farther west on Asher Avenue. The proposed new building will have a rear yard setback of 15 feet. The I-2 district requires a rear yard setback of 25 feet. The proposed building will have a front yard setback of 65 feet, exceeding the Ordinance requirement of 50 feet. The applicant believes this amount of front yard setback is necessary to provide for proper construction of parking and code required landscape areas. The property is only 130 feet deep, since the recently required dedication of 10 feet for Asher Avenue right-of-way. Providing the 65 foot front yard setback has the effect of pushing the building back and reducing the rear yard setback. The property to the rear is occupied by a large, vacant warehouse building. This property is also owned by the applicant. There will be a separation of some 27-28 feet between the two structures. Staff believes the reduced rear yard setback will not have a negative impact on adjacent properties and is supportive of this infill development. C. Staff Recommendation: Staff recommends approval of the requested rear yard setback variance subject to the following conditions: 1. Compliance with Public Works Comments 2. Compliance with the City's Landscape and Buffer Ordinances 3. Compliance with the off-street parking provisions of Section 36-502 BOARD OF ADJi7STMENT: (SEPTEMBER 30, 1996) The applicant was not present. There were no objectors present. Staff presented the item and a recommendation of approval, with conditions. The motion was approved by a vote of 7 ayes, 0 noes and 2 absent. BOARD OF ADJUSTMENT: (OCTOBER 28, 1996) Jim Osborne was present representing the applicant. There were no objectors present. Staff presented the item and a recommendation of approval, with conditions. Mr. Osborne offered no additional comments. In response to a question, he stated that he was aware of the Public Works issues. A motion was made to approve the rear yard setback variance subject to compliance with the conditions outlined in the staff recommendation. The motion was approved by a vote of 6 ayes, 0 noes, 2 absent and 1 open position. 3
