Community Activities: The community is welcomed into this church including the community activities
listed here:
The church holds a "pot luck" style buffet dinner twice per month to raise money for the expenses
of the church. During these dinners, the church accepts donations to support the recurring
expenses of the church but a donation is not required to eat with the community at these dinners.
"Sunday afternoon after services is a time to enjoy soccer or volleyball. On occasion, we will
have guest musicians, evangelists and children's programs. We will place banners outside
welcoming all to these events. We will have NO events in which alcohol is served — not even at
weddings or quinceaneros.."—Iglesia Samaritano Internacional
The church will be used for religious events primarily.
Lighting and Security: The church plans on installing an alarm system. They will also abide by the
lighting requirements and will put spotlights on their chuch sign.
Parking: The church plans will condition the existing lot for 25 cars with plans to add parking inside the
fenced area.
The church has a great need to occupy and begin remodeling on the existing structure to open its doors to
the community and its current congregation as soon as possible. They would like to get the current
structure up to code (plumbing, electrical and HVAC) as soon as possible and continue further
renovations in the future.

CONTRACT TO PURCHASE REAL ESTATE
This Contract to Purchase Real Estate ("Contract") is entered into between Quenia
Rodriguez Lozano {°`Seller") and Iglesia Samaritano Internacional, ("Buyer").
SECTION I: AGREEMENT TO PURCHASE
Seller agrees to sell the following described real property located on at 11820 Chicot, Mabelvale,
Arkansas 72103 to Buyers for the price, on the terms, and subject to the conditions hereinafter set
forth:
Legal Brief: Tract 1 which is 107,066 square feet or 2.4579 acres. With easement
being given to seller for access to Tract shown on copy of new survey held by seller
and buyer.

SECTION 2: SALES PRICE
Buyers hereby agree to pay and Seller agrees to accept for the aforesaid property the sum cAN&

From the date this Contract is executed until such time as Buyers have refinanced or paid in full
the aforementioned indebtedness, Buyer shall make successive equal, monthly installments in the
sum of One thousand Eight Hundred Seventy Five Dollars and Forty One Cents ($1875.41.).
Each of Buyers' monthly payments shaII be due and owing on the first day of each month from
July 2013 until such time as Buyers have refinanced and/or paid in full the balance due and
owing under this Contract. This payment is to be made in the form of personal check, cashiers
check or money order, payable to the Seller at the address listed below. A late fee of Fifty
Dollars ($50.00) shall be assessed if the aforementioned payment is not received by the 5th of the
month.
SECTION 3: CONDITION OF PROPERTY
Seller is selling the Property to Buyers in an "as is, where is" condition.
Buyer understands and agrees that property has reverted by to residential zoning due to property
being vacant for more than one year and it is at the buyers costs to obtain zoning needed for buyer
to use property as needed for their specific use.
SECTION 4: TITLE DOCUMENTS

Upon Buyers paying off in full the indebtedness due and owing pursuant to this Contract and/or
Buyers successful refinancing of that indebtedness, and the completion and performance of the
covenants herein made by Buyers, Seller shall make, execute and deliver to Buyers Seller's
warranty deed conveying the aforesaid property free and clear of all liens and encumbrances.
SECTION S: POSSESSION
Buyers shall be entitled to possession of the property immediately upon the execution of this
Contract. Buyers have permission to start working on the property prior to closing.
SECTION 6: TAXES ,AND ASSESSMENTS
Buyers shall be responsible for all taxes associated with the property which are subject to increase.
Buyers shall provide Seller with proof of such payment. Seller is responsible for taxes prior to ,lune
1, 2013 and Buyer will be responsible for taxes starting June 1, 2013.
SECTION 7: INSURANCE
Buyers shall be responsible for all insurance associated with the property and provide Seller with
Proof of such, listing Seller as Mortgage holder.
SECTION 8: MAINTENANCE OF PREMISES
Buyers agree to keep and maintain the property in a clean and orderly condition at all times, free
Of waste or destruction at all times during this contract. The standard of maintenance to which
Buyers agree to maintain the premises is the highest state of repair which the same has been or
may be at any time during the period of this contract.
SECTION 9: NOTICES
Any notice or consent required to be given hereunder shall be deemed to have been duly

when reduced to writing, delivered by United States Certified Mail, Return Receipt Requested,
Postage prepaid or by personal delivery as evidenced by a receipt of delivery and addressed as

Either party may change its address as set forth above, so long as that party notifies the other party
of the change of address within five (5) days from the date the address has been changed.
SECTION 11: BINDING EFFECT

This Contract is binding upon and shall inure to the benefit of the parties executing this Contract
and their respective successors, assigns, executors and personal representatives. From the
execution of this Agreement, the parties are to act as if this property belongs to and is maintained by
Buyers. Seller does not have the right to enter the property without notice or permission by Buyer
unless Buyers are in default of this agreement.
SECTION 12: TIME OF THE ESSENCE
The time of making payments and keeping of the agreements herein made between the parties is
specifically made of the essence of this Agreement.
SECTION 13: ENTIRE AGREEMENT
This Contract constitutes the entire understanding of the parties. There are no representations,
warranties, promises, covenants or undertakings, oral or otherwise, other than those expressed
herein. This Contract can not be annulled, canceled, changed, altered, deleted, or modified
except in writing signed by all parties hereto.
SECTION 14: SEVERABILITY
Each and every paragraph of this Contract is severable from all other paragraphs herein. In the
event any Court of competent jurisdiction determines that any paragraph or subparagraph herein
is invalid or unenforceable for any reason, all remaining paragraphs and subparagraphs will
remain in full force and effect.
SECTION 15: EXECUTION OF DOCUMENTS
Seller and Buyers agree to execute any and all documents which may be required or necessary to
effectuate this Contract.
SECTION 16: AMENDMENT
This Contract cannot be amended except by written instrument executed by both parties.
SECTION 17: DEFAULT
In the event Seller defaults in the performance of his obligations under this Contract or refuses to
transfer the Property, Buyers shall have all remedies available to it under Arkansas Law including
the right of specific performance.
In the event that Buyers should default in making the payments or in keeping the covenants on
the Buyers' part to be made and kept hereunder, and should a default in the making of any
payment continue for a period of thirty (30) days from the date when such payment hereunder

became due, Seller may, at Seller's option, declare this contract to be breached. At such time,
this Contract will revert to a lease. Seller may also pursue any and all remedies available
pursuant to Arkansas law. Buyer is aware that in the event Buyer defaults they must
immediately vacate property and no monies given as down payment or payments will be
refunded.
The waiver by Seller of a breach by Buyers of any of the covenants or conditions of this contract
on Buyers' part to be made and kept shall not constitute a waiver of the same or a similar default
by Buyers on any subsequent occasion.
Buyers hereby agree to pay all of the expenses incurred by Seller in connection with the
prosecution of any of the remedies of Seller afforded to Seller in the event of a default by Buyers
including, without limitation, the reasonable attorneys, fees of seller.
SECTION IS: EFFECTIVE DATE
The effective date of this Contract is the date upon which Seller sign the Contract. Seller shall have
five (S) business days from the date the Contract is signed by Buyers to sign the Contract,
otherwise, the Contract terminates.
SECTION 19: RISK OF LOSS
Until closing, the risk of loss for damage to the property remains with Seller.

CONDITIONAL USE PERMIT — 11820 CHICOT ROAD 7-5805-D
Planning Staff Comments:
1. There is no Bill of Assurance for this acreage tract.
2. The survey submitted with the application indicates the subdividing of the 4.25 acre tract into two lots, one
of which does not have street frontage. This requires review and approval through the Planning
Commission as a separate application.
3. There is insufficient parking on the site. A church with a seating capacity of one hundred twenty (120)
requires forty (40) parking spaces. An increase in seating to two hundred (200) persons requires fifty (50)
spaces. It appears there may be parking for sixteen (16) vehicles. Submit plans showing the construction of
additional parking. The parking must be paved, designed and landscaped to comply with all ordinance
standards.
4. Signage must comply with that allowed in office and institutional zones.
5. Locate dumpster/trash collection area and required screening.
6. All new site lighting must be low-level and directional, aimed downward and into the site.
7. Locate and describe all existing and new fencing.
8. All remodeling of the building to accommodate the proposed church must be done in compliance with all
building and fire codes and all required permits must be obtained prior to any work commencing.
Variance/Waivers:

Public Works:
1. Chicot Road is classified on the Master Street Plan as a principal arterial. Dedication of right-of-way to
fifty-five (55) feet from centerline will be required.
2. With building expansion in the future, provide design of street conforming to the Master Street Plan.
Construct one-half street improvement to Chicot Road including five (5) foot sidewalks with planned
development.
3. At the time of future building expansion, storm water detention ordinance applies to this property. Show
the proposed location for storm water detention facilities on the plan.
4. At the time of future building expansion, driveway locations and widths do not meet the traffic access and
circulation requirements of Sections 30-43 and 31-210. The lots must share a driveway with the property
to the north. The width of driveway must not exceed thirty-six (36) feet.
Utilities and Fire De artment/Coun Planning:
Wastewater: Sewer available to Tract I only. Tract 2 will require sewer main extension with easements to service
this tract.
Entergy: Entergy has no objections to proposal.
Centerpoint Energy: No comment received.
AT&T (SBC): No comment received.
Water: All Central Arkansas Water requirements in effect at the time of request for water service must be met.
Contact Central Arkansas Water regarding the size and location of the water meter.

If there are facilities that need to be adjusted and/or relocated, contact Central Arkansas Water. That work would
be done at the expense of the developer.
Contact Central Arkansas Water if additional fire protection or metered water service is required.
The Little Rock Fire Department needs to evaluate this site to determine whether additional public and/or private
fire hydrant(s) will be required. If additional fire hydrant(s) are required, they will be installed at the Developer's
expense.
Due to the nature of this facility, installation of an approved reduced pressure zone backflow preventer assembly
(RPZ) is required on the domestic water service. This assembly must be installed prior to the first point of use.
Central Arkansas Water (CAW) requires that upon installation of the RPZA, successful tests of the assembly must
be completed by a Certified Assembly Tester licensed by the State of Arkansas and approved by CAW. The test
results must be sent to CAW's Cross Connection Section within ten days of installation and annually thereafter.
Contact the Cross Connection Section at 377-1226 if you would like to discuss backflow prevention requirements
for this project.
Fire Department: Approved as submitted.
County Planning: No Comments.
CATA: The site is located about three -fourth (3/4) mile from a CATA bus route.
Planning Division: No Comments,
Landscape: Site plan must comply with the City's minimal landscape and buffer ordinance requirements.
The zoning buffer ordinance requires a fifty foot (50') wide land use buffer along the western perimeter of the site
next to the residentially zoned property. Seventy percent (70%) of this area must remain undisturbed.
The zoning street buffer requires an average fifty foot (50') street buffer along Chicot Road and in no case to be
less than half.
The zoning buffer ordinance requires a sixteen foot (16') wide land use buffer along both the northern and southern
property lines, next to the residentially zoned properties. Seventy percent (70%) of this area must remain
undisturbed.
The property to the north, south, and west is zoned residential; therefore, a six (6) foot high opaque screen, either a
wooden fence with its face side directed outward, a wall, or dense evergreen plantings, is required along the
northern, the southern, and the western perimeters of the site.
Landscaping will be required in conjunction with any new parking lot(s).
A small amount of building landscaping will be required.
An automatic irrigation system will be required.
Prior to the issuance of a building permit, it will be necessary to provide an approved landscape plan stamped with
the seal of a Registered Landscape Architect.
The City Beautiful Commission recommends preserving as many existing trees as feasible on this site. Credit
toward fulfilling Landscape Ordinance requirements can be given when preserving trees of six (6) inch caliper or
larger.
Other: Submit responses to staff issues and four (4) copies of a revised site plan (if required) no later than
Wednesday July 24, 2013. Required notices are to be sent via certified mail to all owners of properties located
within two hundred (200) feet of the site no later than Wednesday July 24, 2013. The City -provided notice form
must be used. Proof of notice is to be provided to staff no later than August 2, 2013.

Site plan must comply with the City's minimal landscape and buffer ordinance
requirements.
A total of eight (8) percent of the interior of the vehicular use area must be
landscaped with interior landscaping islands. These interior landscape islands
must be at least 300 square feet in area and be generally evenly distributed. On
additional island is needed along the eastern perimeter of the site.
Scenic highway corridor 430 lies next the eastern property line; what are the
intentions for the thirty-one foot (31') to thirty-five foot (35') area along the
interstate.
A small amount of building landscaping will be required.
An automatic irrigation system will be required.
Prior to the issuance of a building permit, it will be necessary to provide an
approved landscape plan stamped with the seal of a Registered Landscape
Architect.
The City Beautiful Commission recommends preserving as many existing trees as
feasible on this site. Credit toward fulfilling Landscape Ordinance requirements
can be given when preserving trees of six (6) inch caliper or larger.
