HomeMy WebLinkAboutZ-5804 ApplicationBILL OF ASSURANCE KNOW ALL MEN BY THESE PRESENTS: WHEREAS, BAPTIST MEDICAL SYSTEM, 9601 Interstate 630, Exit 7, Little Rock, Arkansas, is the sole owner of the following described lands situated in Pulaski County, Arkansas, to wit: PROPERTY DESCRIPTION Part of the Southeast 1/4 of the Southeast 1/4 of Section 3 and part of the Northeast 1/4 of the Northeast 1/4 of Section 10 all in T -1-N, R -13-W, Pulaski County, Arkansas being more particularly described as follows: Beginning at the Northwest corner of Lot 7, Baptist Medical Center development as recorded in Plat Book A at Page 477; thence North 01'49'18" East along the East right-of-way line of Emergency Drive 729.22 feet; thence continuing along said East right-of-way line on a curve to the right having a radius of 40.00 feet, an arc distance of 81.34 feet and a chord which bears North 60°04'50" East 68.03 feet to the South right-of-way line of Lile Avenue; thence along said South right-of-way line of Lile Avenue on a curve to the left having a radius of 554.51 feet, an arc distance of 164.79 feet and a chord which bears South 70°10'21" East 164.19 feet; thence South 01'49'18" West 716.77 feet to the North line of said Lot 7; thence North 87030'22" West along said North line of Lot 7 a distance of 214.01 feet to the POINT OF BEGINNING containing 3.655 acres, more or less. shown on the plat herein mentioned as Lot 13 of Baptist Medical Center Campus, City of Little Rock, County of Pulaski, State of Arkansas; and WHEREAS, said owner desires to subdivide the above property into a single lot; NOW, THEREFORE, the said BAPTIST MEDICAL SYSTEM, hereinafter referred to as the "Grantor", has caused said property to be surveyed by The Mehlburger Firm, Registered Professional Engineers and Registered Professional Land Surveyor, and a plat thereof which in identified by the title, "Lot 13 of Baptist Medical System Campus", to the City of Little Rock, Pulaski County, Arkansas," and dated to 18th day of June , 1994 and by the signature of the Circuit Clerk and ex -officio Recorder of Pulaski County, Arkansas and being now of record in Plat Book D at page 727 , in the records of the said Circuit Clerk; therefore, the Grantor herein does make this Bill of Assurance. Bill of Assurance Page 2 of 5 The Grantor hereby certifies that it has laid off, platted and subdivided, the said lands in accordance with said plat. The lands embraced in said plat shall be forever be known and described as "Lot 13 of Baptist Medical Center Campus" to the City of Little Rock, Pulaski County, Arkansas, and conveyance of said land by lot number shown on the plat shall be considered a complete and proper description thereof. There are certain strips of ground shown and described on the plat, marked "Utility Easements and reserved for the use of public utilities purposes, subject at all times to the proper authorities and to the easements herein reserved. Owners of the above-described property shall take their title subject to the rights of public utilities and the public. The filing of this Bill of Assurance and plat for record in the Office of the Circuit Clerk and ex -officio Recorder of Pulaski County shall be a valid and complete delivery and dedication of the easements and street rights -of -ways shown on the said plat. The lot shall be subject to the following covenants: 1. Any rights-of-way behind the curb of the lot shall be maintained by the owners of the lot. 2. Said land within said lot shall be held, owned, and used in compliance with the zoning, subdivision, landscaping, runoff detention, excavation and sign ordinances of the City of Little Rock as they applied to said land at the time of recording hereof or as such ordinances may be amended from time to time to provide for less restrictive use. 3. Easements of way for streets shown on the plat filed herewith have heretofore been donated and dedicated to the public, and person, firms or corporations Bill of Assurance Page 3 of 5 engaged in supplying public utility services, the same being without limiting the generality of the foregoing, electric, power, gas, telephone, water and sewer, shall have the right to use and occupy said easements of way and street for the installation, maintenance, repair and replacement of such facilities as are necessary to supply such utility services. Easements for the installation, maintenance, repair and replacement of utility facilities and services, sewer and drainage, have theretofore been reserved, said easements being of various widths, reference being made to the plat filed herewith for a specific description of the width and location thereof. Excavations within the area of such easements of the erection of any fence (wood, wire, stone, brick or any other material) or for any other purpose shall be made without interference with the installation, maintenance, repair and replacement of any utitility facilities and services. 4. These covenants and restrictions shall run with the land and shall be binding on all parties claiming under them in perpetuity. 5. The covenants and restrictions herein set forth shall run with the land and shall bind the present owner, its successors and assigns, and all parties claiming by through under it shall be taken to hold, agree and covenant with the owner of the lots hereby restricted, and with its successors and assigns, and with each of them to conform to and observe said covenants and restrictions as to the use of such lots in the construction of improvements thereon, but no restrictions herein set forth shall be personally binding upon any corporation, person or Bill of Assurance Page 4 of 5 person, except in respect to breaches committed during its, his or their seisin of title to said land, and Grantor, its successors and assigns, and also the owner or owners of the lot hereby restricted shall have the right to sue for and obtain in injunction, prohibited or mandatory, to prevent the breach of or to enforce the observance of the covenants and restrictions above set forth, in addition to ordinary legal action for damages. Failure of Grantor, its successors or assigns, or any owner of owners of such lots to enforce any of the covenants restrictions herein set forth at the time of its violations shall, in no event, be deemed to be a waiver of the right to do so thereafter. 6. In the event any provision of this Bill of Assurance shall be determined to be invalid by a court of competent jurisdiction, such invalidity shall not affect the remaining provisions, which shall remain in full force and effect. 7. Any and all of the covenants set forth herein may be amended, modified, extended, changed or canceled in whole or in part from time to time by written instrument signed and acknowledged by the owner or owners of tow - thirds (2/3rds) of the total land included in Lot 13. Planning Zoning and Subdivision B. Zu Zu's (Z -5524-B) The proposed 6 ft. high opaque wood fence needs moved eastward 4 ft. to provide greenspace between the vehicular use area and screening fence. This fence must be the good neighbor type. The dumpster must be enclosed on three sides t-,zth an 8 ft. high opaque wall or fence. *The plan submitted is short of the 6% interior landscaping required by 270 sq. ft. 7. P&L Investment Co. (Z -4016-D) The landscaping has deteriorated and needs to be fiilly reinstalled and maintained. 8. Freeway Business Park(Z-4249-A) Landscape areas equal to a 3 ft. wide landscape strip are required between public vehicular parking areas and the bldg. they serve. A 6 ft. high opaque screen is required along the southern and eastern perimeters adjacent to lands zoned residential. This screen must be a good neighbor wood fence or dense evergreen plantings. 9. The Wishing Well (Z -5106-A) An opaque screen 6 ft. in height is required to screen the proposed use from the residential property use from the residential property to the south, east and west. This screen can be a good neighbor wood fence or dense evergreen plantings. The landscape strip width west of the proposed parking lot must be increased to 6 ft. 10. Walgreens (Z -5412-B) The full average buffer width required along Hinson Rd. is 20 ft. and 12 ft. along Rodney Parham Rd. The buffer width along Hinson Rd. should be increased to a minimum of 13 ft. in width. A 6 ft. high opaque screen is required along the western perimeter to screen the proposed use from the. residential zoned property to the west. 11. The Oaks of Chenal (Z -5588-A) N/A 12. Barrow 1<'Iin-Storage (Z-5709) The buffer width along Barrow Rd. and the western perimeter should be increased to 24 ft. in order to rneet the full requirement. The buffer «idths along Labette Dr. and the southern perimeter should be increased to an average width of 16 ft. A 6 ft. high opaque screen will be required to screen business activity from the residential properties to the south and west. 13. Coulson Oil Co. (Z-5799) The Highway 10 Overlay Ordinance requires additional screening and trees along Cantrell Rd. above that required by the Landscape Ordinance. A sprinkler system to water the plants will be necessary. 14. Bowman Commercial Park (Z-5800) The buffer width along Bowman Rd. should be increased to an average minimum width of 27 ft. and along the eastern perimeter to 33 ft. The full buffer requirements without transfers are 40 ft. and 50 ft. respectively. A 6 ft. high opaque Qood neighbor wood fence or dense evergreen plantings will be required to screen this use from the residential properties to the north, south and east. 15. Afedical Electronics, Inc. (Z-5801) This site will be required to be screened from the residential properties to the south, east and west. The applicant desires to develop a 2.21 acre site into a facility to house and treat adolescents enrolled in a program for transitional living. The site has been final platted as Lot 5, Baptist Medical Center Development. The first phase of the project will consist of the construction of two housing facilities and accompanying driveway and parking. The structures will be one story masonry and frame type construction of a residential character comprising appro;�imatel1 6032 sq. ft. A third building will be built as indicated on the site plan in the second phase of the project. The structures will cover approximately 12.5% of the site and the paved area will occupy aprroximately 14.8% of the site. There will be a total of 21 parking spaces with 2 spaces being dedicated for handicap usage. The site is currently wooded and the intent is to preserve as much of the natural setting as possible.
