Dear John:
As I related to you last week, Cy Carney, Assistant City Manager, has approved your requested
area increase for the proposed north building (originally known as the "Toys -R -Us" site) on the
referenced site. This will permit the construction of a building as shown on the "signed -off site
plan, attached, which is basically 154 feet north -to -south, and 212 feet east -to -west, with the 22
foot wide loading dock. (Recall that there are strict conditions imposed in the PCD regarding the
loading dock. It must be completely enclosed, with the same roof line as the rest of the building,
and waiting trucks must be inside the building.) Also, the placement of the dumpster has not been
shown on the site plan, and there are strict conditions which will be imposed regarding the
dumpster location and servicing hours.

The purpose of this communication is to provide a response to your request of May 20, 1996 in
which you conveyed a request of Mr. John Rees, the proposed developer of Linens and Things.
Mr. Rees' application is one of several that this office has reviewed with respect to the proposed
Planned Commercial Development site. On at least one previous occasion, your office
authorized an expansion of the building beyond that which had been authorized by the Planning
Commission and City Board. That expansion fell within the authorized 5% and in our opinion is
the only modification that should occur on this project site without further review by the
Planning Commission.
The subject proposal is not a significant enlargement of the building; however, it does
significantly encroach onto the pedestrian way being the large sidewalk in front of the structure.
As a vestibule, it will be a closed heated and cooled element of the building with side walls and
a roof in a conventional building manner. With this being the case, we could not in any way
identify this as a canopy. If Mr. Rees desires to erect a cloth canopy over the sidewalk mounted
on freestanding poles, we could perhaps authorize it. This would not be considered expansion of
the floor space of the building. In any event, close scrutiny should be given to any expansion of
this PCD project site in as much as this was a very controversial item with much neighborhood
involvement and much discussion at the City Board level prior to the approval of the ordinance.
We would suggest that Mr. Rees proceed with the project in the fashion that it is currently
authorized. If he desires to make the expansion that he proposes, file an application for
Planning Commission review. The filing deadline for

SUBJECT: BEST BUY SITE LIGHTING AND OTHER NEIGHBORHOOD ISSUES
This memo is submitted in response to your request for information about a complaint of
Havis Jacks, a neighbor of the Best Buy project on Bowman Road.
Mr. Jacks reported to this office approximately two weeks ago that he observed the parking
lot lights exceeding the approved light scatter into his block.
The Enforcement Office sent an enforcement officer to visit the site to determine whether the
light shields had fallen or were in some way not properly set. The report was that they
appeared to be as originally installed and shielded. The only increase in spillover we can
determine would be that more of the adjacent tree cover has been removed and several new
businesses have been constructed with lighting.
As to the question of the house on Autumn Road converted to an office, this staff reviewed
the owner's proposal and determined there was little or nothing to review since he was going
to occupy it as it existed, only interior painting, some remodeling.
The permit for his occupancy specifically stated that he cannot do any exterior expansion or
building without Planning Commission review. This includes parking lot or drives.

heated and cooled space to the building. The Neighborhoods and Planning Department review
interpreted the canopy proposal to include enclosed climate control building space.
Based on your letter and the resubmitted plan which clearly indicated that the canopy is only a shelter
for customers and is not included in the building total, your request is not a major change to the
approved Planned Unit Development. Based on your assurance that the proposed structure is only
a roof structure with the four support poles and not an addition to the building space, the
modification is hereby approved.
