Moore City Manager The applicant is requesting rezoning of the site from 0-3, General Office District and C-3, General Commercial District to Planned Development Commercial to allow the existing business to remove a portion of an existing structure and construct a new building on the site. None. Staff recommends approval of the requested PD -C zoning. The Planning Commission voted to recommend approval of the PD -C zoning by a vote of 10 ayes, 0 noes and 1 absent. The Planning Commission reviewed the proposed PD -C request at its November 19, 2015, meeting and there were no registered objectors present. All property owners located within 200 -feet of the site along with the Forest Hills, Hope and Oak Forest Neighborhood Associations were notified of the Public Hearing. BACKGROUND The applicant is requesting rezoning of the site from 0-3, General Office District and C-3, General Commercial District to Planned Development Commercial to allow the existing business, Horton's Orthotics and Prosthetics, to remove a portion of an existing structure and construct a new building on the site. Horton's Orthotics and Prosthetics has been in operation at this location for approximately 25 -years. Originally the Horton's purchased the property and built an addition to the existing old home, all of which housed their prosthetics business. In 1994 a second addition to the building was constructed to expand the business. At this point the original home is no longer serviceable due to failing foundations and roof, as well as poor electrical and HVAC components, and in fact the Iayout of the old house no longer works well as a business office for the business. The owner is now proposing to remove the old home and replace it with a new structure to tie into the earlier additions. The applicant is requesting a variance from the typical development standards for the driveway located on West 12'h Street The drive is indicated 25 -feet from the western property line. Specifically this business sees patients in exam rooms and produces, on site, orthotic and prosthetic devices to treat the patient. The facility also houses the administrative offices for the business which has other clinics off site. • The site was originally platted as five lots. The current zoning for each is as follows: Lots 1,2 and 3 are C-3 General Commercial District. Lots 4-5 are 0-3 General Office District. By applying for a PZD the owner seeks approval for C-3 zoning on all five lots as shown on site plan. • Additional R.O.W. was dedicated on 12m Street in 1995. The city will ask for 5' of additional R.O.W. on Harrison Street. The owner asks for a reduction of R.O.W. on Harrison Street as shown on site plan. • The owner is asking for a variance for the distance of the east driveway from the property line. • In this PZD the owner is asking for acceptance of the parking layout shown based on the square footage of each use area (see `Parking' notes on site plan). Due to the physical limitations of some patients the owner is providing an extra accessible parking space above city requirements. It should also be noted that the owner has a shared parking agreement with the adjacent property owner to the east although Horton's has rarely needed to make use of this.
