7 WHEREAS, a petition for voluntary annexation (the "Petition") was filed with the County Clerk of
8 Pulaski County, Arkansas, by the owner of hereinafter designated lands praying that said lands be
9 annexed to and made part of the City of Little Rock, Arkansas; and,
10 WHEREAS, on March 24, 2016, the County Court of Pulaski County, Arkansas found that the
11 Petition was signed by a majority of the total number of the real property owners of the area to be
12 annexed and by the owners of some 13.68 acres of said area; and,
13 WHEREAS, said lands are contiguous to and adjoining the present corporate limits of the City of
14 Little Rock; and,
15 WHEREAS, an accurate map of said lands has been filed with and made a part of said Petition; and,
16 WHEREAS, proper notice has been given for the time and in the manner prescribed by law; and,
17 WHEREAS, all things pertaining thereto have been done in the manner prescribed by law and that
18 said lands should be annexed to and made part of the City of Little Rock.
19 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
20 OF LITTLE ROCK, ARKANSAS:
21 SECTION 1. The following described territory contiguous and adjoining the City of Little Rock,
22 Arkansas is accepted as annexed to and made a part of the City of Little Rock, Pulaski County, Arkansas,
23 to wit:

25 NORTH, RANGE 13 WEST, PULASKI COUNTY, ARKANSAS, BEING MORE
26 PARTICULARLY DESCRIBED AS FOLLOWS: BEGINNING AT THE
27 NORTHWEST CORNER OF LOT 1, KANIS CREEK SUBDIVISION AND ALSO
28 BEING ON THE SOUTHERLY RIGHT -OF- WAY LINE OF PRIDE VALLEY

or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or
adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and
effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the
ordinance.
SECTION 4. Repealer. All ordinances or resolutions of the City in conflict herewith are hereby
repealed to the extent of such conflict.

The request is a rezoning from 0-2, Office and Institutional
to PCD (Planned Commercial Development) to allow the
development of 12.95 acers with a mixed use development
including single-family, office and mini -warehouse.
None.
Staff recommends approval of the requested PCD zoning.
The Planning Commission voted to recommend approval
of the PCD zoning by a vote of 10 ayes, 0 noes and
1 absent.
The Planning Commission reviewed the proposed PCD
request at its April 23, 2015, meeting and there were no
registered objectors present. All property owners located
within 200 -feet of the site along with the Kanis Creek
POA, the Parkway Place POA, the Spring Valley Manor
POA and the Woodlands Edge Community Association
were notified of the Public Hearing.
BACKGROUND

The site contains 12.95 -acres and is located on the
northwest corner of Kanis Road and Pride Valley Road.
Ordinance No. 16,732 adopted by the Little Rock Board of
Directors on August 16, 1994, rezoned the site from R-2,
Single-family to 0-2, Office and Institutional.
A proposal to allow the development of 142 -units (for a
proposed density of 11.24 -units per acre) of condominium
style housing under a horizontal property regime was
proposed by a previous applicant but was withdrawn prior
to the Commission considering the request at their
December 7, 2006, public hearing.
A proposal to allow the development of 230 -units of
multi -family housing was to be considered by the
Commission at their December 18, 2014, public hearing
but was withdrawn from consideration at the request of the
applicant.
On March 12, 2015, the Little Rock Planning Commission
denied a request to rezone the site to PCD to allow the
development of the site with a mixed use development.
Lot A was proposed as a future phase of Chenal Kanis
Storage, a mini -warehouse development. Lot B was
proposed with frontage along Kanis Road with C-3,
General Commercial District uses as allowable uses. Tract
C was proposed with detention and Tract D was proposed
as open space. The development included 15 single-
family lots fronting onto Pride Valley Road. The lots were
proposed with 50 -foot widths, 30 -foot front yard setbacks,
20 -foot rear setbacks and 5 -foot side yard setbacks.
The applicant is now proposing to rezone the site from 0-2,
Office and Institutional to PCD to allow the development
of the site with the same number of lots and layout but
limiting the development of Lot B to 0-2, Office and
Institutional Zoning District uses.
Lot A is proposed as a future phase of Chenal Kanis
Storage, a mini -warehouse development, located west of
the site. Lot B is proposed with frontage along Kanis Road
with 0-2, Office and Institutional uses as allowable uses.
This area will be subdivided into additional lots in the
future as dictated by market demand. Tract C is proposed
with detention and Tract D is proposed as open space.

BACKGROUND
CONTINUED
The development includes 15 single-family lots with
frontage along Pride Valley Road. The lots are proposed
with 54 -foot lot widths, 30 -foot front yard setbacks, 24 -foot
rear setbacks and 5 -foot side yard setbacks.
Phase I of the project will consist of construction of the
residential lots on Pride Valley Road and grading of the
site. The applicant is requesting a variance from the City's
Land Alteration Ordinance to allow grading of future
phases with the development of the single-family homes.
The applicant has indicated the advanced grading will
include all of Lot A, the residential lots and the rear 50 -Feet
of Lot B. The request also includes the allowance of
2:1 slopes within the mini -warehouse portion of the
development.
Staff originally did not support the request. At the
April 23, 2415, Planning Commission hearing the applicant
stated all efforts would be made to place the new
single-family lots into the Kanis Creek Subdivision, which
is located to the east across Pride Valley Road, by
amending the Bill of Assurance for the Kanis Creek
Subdivision and allow the new single-family lots, located
on the west side of Pride Valley Road, to be included in the
Kanis Creek Property Owners Association. Staff's initial
concerns have been minimized since the new single-family
lots will now be a part of the adjoining Kanis Creek
Subdivision.

SECTION 2. That the preliminary site development plan/plat be approved as
recommended by the Little Rock Planning Commission.
SECTION 3. That the change in zoning classification contemplated for PVK
Development Long -form PCD (Z -5758-E), located on the Southwest corner of Kanis and
Pride Valley Roads is conditioned upon obtaining a final plan approval within the time
specified by Chapter 36, Article VII, Section 36-454 (e) of the Code of Ordinances.
SECTION 4. That the map referred to in Chapter 36 of the Code of Ordinances
of the City of Little Rock, Arkansas, and designated district map be and is hereby amended to
the extent and in the respects necessary to affect and designate the change provided for in
Section 1 hereof.
SECTION 5. That this Ordinance shall not take effect and be in full force until
the final approval of the plan.
SECTION 6. Severability. In the event any title, section, paragraph, item,
sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid or
unconstitutional, such declaration or adjudication shall not affect the remaining portions of
the ordinance which shall remain in full force and effect as if the portion so declared or
adjudged invalid or unconstitutional was not originally a part of the ordinance.
SECTION 7. Repealer. All laws, ordinances, resolutions, or parts of the same
that are inconsistent with the provisions of this ordinance are hereby repealed to the extent of
such inconsistency.

Included herewith are 18 copies of the above mentioned Planned Commercial Development. We would
like to be placed on the April 23rd Planning Commission Meeting Agenda. We are requesting the
following items with this development:
1. Lot "A" shall be future phases of Chenal Kanis Storage located to the west of this
property.
2. Lot "B", located along the frontage of Kanis Road, shall maintain its current zoning of 0-
2. The lot widths shall be market driven.
3. Tract "C" shall be used for detention and open space.
4. We are proposing to develop the frontage of Pride Valley as single family lots.
We request the minimum lot sizes to be 50' in width with 30 foot front setbacks, 20' rear
setbacks and 5 foot side setbacks.
5. Phase 1 of the project will consist of the residential lots on Pride Valley, grading of Lot
"A", and grading the rear 50 feet of Lot "B". Therefore, we request an Advanced Grading
Permit for all of the residential lots, Lot "A" and the rear 50 feet of Lot "B".
6. We request to grade the slopes around Lot "A" as shown on the plan to 2:1.
7. The detention basin will be constructed with Phase 1.
8. We will improve Pride Valley Road to collector standards with Phase 1.
9. The property is currently not within the city limits, but we will request annexation as part
of this review process.

Good morning Mr. Malone,
It is our understanding that today a voting meeting will take place regarding the proposed zoning changes to the
land located between Kanis and Pride Valley Road. As you know, the land affected is directly across the street
from our Kanis Creek neighborhood POA.
We've been told by the developer, Graham Smith Construction, that the plans for the land include small homes
along Pride Valley Road and additional storage facilities behind the homes facing Kanis Road. We've been told
that the homes will be of like quality to ours inside and out with no siding etc. We've been told that the
additional storage facilities will "set low" on the land behind the homes and large fences will be built in the
backyards so that the storage facilities are not visible to us.
Our POA President, Eric Stoffel, asked that I write you this email to say that we generally support the proposal
as orally described to us above. It is our understanding that the developer and the City would like Kanis Creek
POA to absorb the new homes into our POA. We may be in support of doing so, but we would like the
following to happen: no additional entryways into the storage facility from Pride Valley Rd, and most
importantly we would like the developer or the city to pay to have a roundabout constructed on Pride Valley
Road where it intersects Kanis Creek Place. This will prevent people from speeding up and. down Pride Valley
Road at speeds sometimes upwards of 70 miles per hour. It's dangerous to the neighborhood and will only be
more dangerous when additional homes are built on the opposite side of the street.

D105.1 Where Required. Where the vertical distance between the grade plane and the highest
roof surface exceed 30', approved aerial fire apparatus access roads shall be provided. For the purposes
of this section the highest roof surfaces shall be determined by measurement to the eave of a pitched
roof, the intersection of a roof to the exterior wall, or the top of the parapet walls, whichever is greater.
D105.2 Width. Aerial fire apparatus access roads shall have a minimum unobstructed with of
26', exclusive of shoulders, in the immediate vicinity of the building or portion thereof.
D105.3 Proximity to building. At least one of the required access routes meeting this condition
shall be located within a minimum of 15 feet and a maximum of 30 feet from the building, and shall be
positioned parallel to one entire side of the building. The side of the building on which the aerial fire
apparatus access road is positioned shall be approved by the fire code official.
D105.4 Obstructions. Overhead utility and power lines shall not be located over the aerial fire
apparatus access road or between the aerial fire apparatus road and the building. Other obstructions
shall be permitted to be places with the approval of the fire code official.
Gates
Maintain fire apparatus access road gates as per Appendix D of the 2012 Arkansas Fire Prevention
Code Vol. 1 Section D103.5 Fire apparatus access road gates. Gates securing the fire apparatus access
roads shall comply with all of the following criteria:
1. Minimum gate width shall be 20 feet.
2. Gates shall be of swinging or sliding type.
3. Construction of gates shall be of material that allow manual operation by one person.
4. Gate components shall be maintained in an operable condition at all times and replaces or
repaired when defective.
5. Electric gates shall be equipped with a means of opening the gate by fire department personnel
for emergency access. Emergency opening devices shall be approved by the fire code official.
6. Manual opening gates shall not be locked with a padlock or chain and padlock unless they are
capable of being opened by means of forcible entry tools or when a key box containing the keys
to the lock is installed at the gate location.
7. Locking device specifications shall be submitted for approval \by the fire code official
8. Electric gate operators, where provided, shall be listed in accordance with UL 325.
9. Gates, intended for automatic operation shall be designed, constructed and installed to comply
with requirements of ASTM F 2200.
One- or Two -Family Residential Developments.
As per Appendix D, Section D107.1 of the Arkansas Fire Prevention Code Vol. 1, One- or Two -Family
dwelling residential developments. Developments of one- or two-family dwellings where the number of
dwelling units exceeds 30 shall be provided with two separate and approved fire apparatus access
roads, and shall meet the requirements of Section D104.3.
Exceptions:
Where there are more than 30 dwelling units on a single public or private fire apparatus
access road and al dwelling units are equipped throughout with an approved automatic
sprinkler system in accordance with Section 903.3.1.1, 903.3.1.2 or 903.3.1.3 of the
Arkansas Fire Code, access from two directions shall not be required.
The number of dwelling units on a single fire apparatus access road shall not be increased
unless fire apparatus access roads will connect with future development, as determined by
the fire code official.

apparatus access road or between the aerial fire apparatus road and the building. Other obstructions
shall be permitted to be places with the approval of the fire code official.

planning. The proposal has potential impact to service by restricting the turning area at Pride
Valley Rd and Kanis Road with an island. The turning radius should accommodate a 40' bus and
para -transit vehicle.
The proposal has no impact to current service. Maintaining the bicycle and pedestrian way in this
area is important to accessing transit. We have noted an improved sidewalk plan in this
configuration.

A land use buffer six (6) percent of the average width / depth of the lot will be required
when an adjacent property has a dissimilar use of a more restrictive nature. The minimum
dimension shall be nine (9) feet. The maximum dimension required shall be fifty (50)
feet. As a component of all land use buffer requirements, opaque screening, whether a
fence or other device, a minimum of six (6) feet in height shall be required upon the
property line side of the buffer. A minimum of seventy (70) percent of the land use buffer
shall be undisturbed. Easements cannot count toward fulfilling this requirement. The
