NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
OF LITTLE ROCK, ARKANSAS:
Section 1. That the zoning classification of the following described property be changed from PCD
to Revised PCD:
Lot 2-B, Erwin Addition to the City of Little Rock, Pulaski County, Arkansas.
Section 2. That the approval of Bowman Heights Center Revised Short -Form PCD (Z -5756-D),
located at 301 and 303 South Bowman Road, is subject to compliance with the following additional
conditions:
That the preliminary site development plan/plat be approved as submitted, including all
staff comments and conditions as outlined in the Planning Commission Agenda Staff
Report in paragraphs D, E, F and including any conditions indicated in the staff analysis
in paragraph H and subject to additional conditions imposed at the Planning Commission
Public Hearing as amended by the applicant.
Section 3. That the preliminary site development plan/plat be approved as recommended by the
Little Rock Planning Commission.
Section 4. That the change in zoning classification contemplated for Bowman Heights Center
Revised Short -Form PCD (Z -5756-D), located at 301 and 303 South Bowman Road, is conditioned upon
obtaining a final plan approval within the time specified by Chapter 36, Article VII, Section 36-454 (e) of
the Code of Ordinances.
Section 5. That the map referred to in Chapter 36 of the Code of Ordinances of the City of Little
Rock, Arkansas, and designated district map be and is hereby amended to the extent and in the respects
necessary to affect and designate the change provided for in Section 1 hereof.

Section 6. That this Ordinance shall not take effect and be in full force until the final approval of the
plan.
Section 7. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or
adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and
effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the
ordinance.
Section 8. Repealer. All laws, ordinances, resolutions, or parts of the same that are inconsistent
with the provisions of this ordinance are hereby repealed to the extent of such inconsistency.

The applicant is requesting a revision to the PCD zoning to
allow the addition of audio and video equipment
installation including car audio sales and installation as an
allowable use for the site.
None.
Staff recommends approval of the requested PCD zoning.
The Planning Commission voted to recommend approval of
the requested zoning by a vote of 9 ayes, 1 no and 1 absent.
The Planning Commission reviewed the proposed PCD
request at its July 14, 2011, meeting. There were no
registered objectors present. The Birchwood Neighborhood
Association, all residents who could be identified located
within 300 feet of the site and all property owners located
within 200 -feet of the site were notified of the Public
Hearing.
BACKGROUND
The site was zoned PCD by Ordinance No. 16,573 adopted
by the Little Rock Board of Directors on January 18, 1994.
This followed the Planning Commission's recommendation
of approval on November 16, 1993. The uses for the site
were limited to those contained in the schedule of permitted
uses in the C-1, Neighborhood Commercial District, plus an
additional use, a video rental store. Additional conditions
were: 1) dumpster pickup was to be limited to 7:00 am to
6:00 pm; 2) no doors or windows were to be allowed on the
rear or east of the building (except emergency doors
required by the Fire Marshall; 3) a six foot tall screening
fence was to be erected along the top of the retaining wall
off the rear of the property line; and 4) evergreen plantings,
which, when mature, would grow to a minimum of fifteen
(15) feet in height, were to be planted in the overlap to
provide a solid screening of the site from the east.
Two subsequent proposals to modify the PCD were
withdrawn by the applicant. On July 20, 2004, Ordinance
No. 19,138 was approved which allowed a small area of
outdoor display of playground equipment in conjunction
with one of the businesses on the site.
The applicant is requesting a revision to the PCD zoning to
allow the addition of audio and video equipment
installation including car audio sales and installation as an
allowable use for the site. The original submission by the
applicant included a number of additional uses which staff
did not support. Prior to the Commission acting on the
request the applicant amended the request to limit the uses
to the uses as were approved with the original approval and
the addition of audio and video equipment installation
including car audio sales and installation.

AMENDING THE OFFICIAL ZONING MAP OF THE
CITY OF LITTLE ROCK; AND FOR OTHER PURPOSES.
BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF
LITTLE ROCK, ARKANSAS.
SECTION 1. That the zoning classification of the following described
property be changed from PCD to Revised PCD:
Lot 2-B, Erwin Addition to the City of Little Rock, Pulaski
County, Arkansas.
SECTION 2. That the approval of Bowman Heights Center Revised Short -
form PCD (Z -5756-D) located at 301 and 303 South Bowman Road is subject to
compliance with the following additional conditions:
That the preliminary site development plan/plat be approved as
submitted, including all staff comments and conditions as outlined
in the Planning Commission Agenda Staff Report in paragraphs D,
E, F and including any conditions indicated in the staff analysis in
paragraph H and subject to additional conditions imposed at the
Planning Commission Public Hearing as amended by the applicant.

4 SECTION 4. That the change in zoning classification contemplated for

6 South Bowman Road is conditioned upon obtaining a final plan approval within the
7 time specified byl-Chapter 36, Article VII, Section 36-454 (e) of the Code of
8 Ordinances.

10 SECTION 5. That the map referred to in Chapter 36 of the Code of
11 Ordinances of the City of Little Rock, Arkansas, and designated district map be and is
12 hereby amended to the extent and in the respects necessary to affect and designate the
13 change provided for in Section 1 hereof.

15 SECTION 6. That this Ordinance shall not take effect and be in full force
16 until the final approval of the plan.

18 SECTION 7. Severability. In the event any title, section, paragraph,
19 item, sentence, clause, phrase, or word of this ordinance is declared or adjudged to be
20 invalid or unconstitutional, such declaration or adjudication shall not affect the
21 remaining portions of the ordinance which shall remain in full force and effect as if
22 the portion so declared or adjudged invalid or unconstitutional was not originally a
23 part of the ordinance.

25 SECTION 8. Repealer. All laws, ordinances, resolutions, or parts of the
26 same that are inconsistent with the provisions of this ordinance are hereby repealed to
27 the extent of such inconsistency.

Dear Dana,
I have spoken with Richie White, the owner of Music Mart, located at 303 S. Bowman Road
here in Little Rock and he has agreed to the following conditions to be added to our PCD now
being considered by the Planning Commission and Planning Staff of the city of Little Rock. We
are requesting that the present PCD zoning be amended to also include for the sales, service
and installation of 12 volt audio/video equipment and accessories.
Additional Conditions to the PCD:
1. Tenant shall agree to close the garage door located on the south end of the
property at all times except when a vehicle is entering or leaving the
Premises.
2. Tenant agrees to post signs on the interior of the shop and on the outside on
the exterior brick wall informing customers that playing their stereo equipment
in the parking lot is "Strictly Prohibited".
3. Tenant agrees to limit its operating hours from 9:00 am to 6:00 pm Monday
through Saturday.
4. Tenant agrees to tell its customers to not play their car stereo loudly in the
Bowman Heights parking areas or drives and only with the windows rolled up.
5. Tenant will agree to be mindful and considerate to all of its neighbors and to
cure promptly any problem or complaint that might occur by calling Richie
White at 501-664-0101.
We hope these 5 conditions will now allow the Planning Staff to give us a positive
recommendation to the Planning Commission. Mr. White has assured me that he will be a good
neighbor and abide by the above rules. He likes this location and fears that if required to move
he may have to shut down the business. Mr. White has been a great tenant for me and hasn't
caused us any problems with noise before and I'm sure he will abide by these rules and
continue to offer a great service to all of his customers in central Arkansas. Thank you very
