NEW STREET: 0 ALLOWED USES: PROPOSED USE: General Office General Office and Massage Therapy VARIANCES/WAIVERS REQUESTED: None requested. BACKGROUND: The property at 11300 Financial Center Parkway is zoned 0-3 and contain as existing office building. In 0-3 zoning, accessory commercial uses are allowed to occupy a maximum of ten (10) percent of the total building floor area. Ten (10) percent of the existing office building at thissite is currently occupied by -accessory commercial use. A. PROPOSAL/REQUEST: The applicant, Dr. Hal Bienvenu, M.D., is requesting a conditional use permit to allow approximately ten (10) percent (98 square feet) of his medical office space (Suite 800) to be occupied for therapeutic massage. Dr. Bienenvu notes that the therapeutic massage will be by a duly - licensed massage therapist, and the massage therapy will include both pre -operative and post-operative therapies for patients preparing for and recovering from cosmetic and reconstructive surgeries as well as patients needing July 26, 2001 ITEM NO.: 6 FILE NO.: Z -5738-A therapeutic massage for treatment of musculoskeletal conditions. The massage therapy is to be performed under the supervision and guidance of a licensed Arkansas physician and will function as a part of Dr. Bienvenu's medical practice. This application is a use issue only, as no changes are proposed to the existing site plan. B. EXISTING CONDITIONS: There is an existing office building with paved parking area on the site. There is a bank located immediately east of the site, with other office uses further east and a hotel to the northeast. There are single family residences to the north. There is a mixture of uses, including office, commercial and a hotel, to the south across Financial Center Parkway. There is a mixture of commercial uses to the west along Financial Center Parkway/Chenal Parkway. C. NEIGHBORHOOD COMMENTS: The Birchwood Neighborhood Association was notified of the public hearing. As of this writing, staff has received no comment from the neighborhood. D. ENGINEERING COMMENTS: PUBLIC WORKS CONDITIONS: 1. Repair or replace any curb and gutter or sidewalk that is damaged in the public right-of-way prior to occupancy. 2. Property frontage needs to have the sidewalks and ramps brought up to the current ADA standards. E. UTILITIES AND FIRE DEPARTMENT/COUNTY PLANNING: Wastewater: Sewer available, not adversely affected. Entergy: No Comment. ARKLA: No Comment received. Southwestern Bell: No Comment. Water: No Comment. Fire Department: No Comment. County Planning: No Comment received. SUBDIVISION COMMITTEE COMMENT: (JULY 5, 2001) Fletcher Hanson was present, representing the application. Staff briefly explained the proposed conditional use permit, noting that no changes were proposed to the existing site plan. There being no technical/site design issues to discuss, the Committee forwarded the application to the full Commission for final action. H. ANALYSIS: As noted in paragraph A., the applicant is requesting a conditional use permit to allow massage therapy as part of a cosmetic/reconstructive surgery clinic. The massage therapy will occupy approximately ten (10) percent (98 square feet) of the medical office space (Suite 800). This conditional use permit is only a use issue, as no changes are proposed to the existing developed site. Staff feels that the requested conditional use permit to occupy 98 square feet of a cosmetic/reconstructive surgery clinic for massage therapy is reasonable and should have no adverse impact on the general area. I. STAFF RECOMMENDATIONS: Staff recommends approval of the conditional use permit subject to compliance with the Public Works requirement, as noted in paragraph D. of this report. PLANNING COMMISSION ACTION: (JULY 26, 2001) Staff presented a positive recommendation on this application, as there were no further issues for resolution. FILE NO.: Z -5738-A The Chairman placed the item before the Commission for inclusion within the Consent Agenda for approval as recommended by staff. A motion to that effect was made. The motion passed by a vote of 9 ayes, 0 nays and 2 absent. 4
