OPOOAL: The applicant requests a
conditional use permit to allow for
the placement of a 24 foot by 60
foot portable building on an R-3
zoned lot, adjacent to the existing
church site. The new building will
be made permanent and is to be used
as a 100 seat sanctuary and
classrooms. The existing church
building will be converted into
classroom space and a fellowship
hall.
-ORDINANCE DEEIGN STANDARDS:

Site Locatiorx
The existing church and the adjacent vacant lot are located
on the east side of South Louisiana Street, just south of
West 31st Street.
2. Compatibility with Neighborhood
A small neighborhood church has existed at 3105 South
Louisiana for many years. The church has now purchased the
vacant lot adjacent to the north and seeks to expand from
the one lot it now occupies.
The neighborhood is primarily zoned R-3 and single family
residential is the predominate use in the immediate
vicinity.
A small, commercial node is located directly east of the
proposed site. This commercial node, although zoned C-3,
has no commercial businesses in it. It is comprised of a
vacant commercial building, several vacant lots and a couple
of single family residential structures.
One-half block south of the church, an upholstery shop
occupies two C-3 zoned lots.
One-half block further south are the railroad right-of-way
and biddle yards, zoned I-3.

With proper attention to ordinance criteria and design
standards, the church should continue to be compatible with
the neighborhood.
3. On -Site Drives and Parking
A sanctuary seating 100 persons requires 25 on-site parking
spaces. The site plan, as submitted, shows no on-site
parking. The applicant states that there is parking around
the existing church building on the adjacent lot. Staff
feels that a better site plan should be submitted, showing
both lots, the existing building and any on-site parking.

Compliance with the City's Landscape and Buffer Ordinances
is required.
5. Qity Engineer Comments
Dedicate additional 15 feet of right-of-way to meet Master
Street Plan requirements.
6. Utility Comments
No comments as of this writing.
7. Analysis
Although staff is basically supportive of the concept, it is
felt that there has not been sufficient information
submitted to allow for a thorough review to assure
compliance with ordinance standards and design criteria. A
survey/site plan should be done incorporating the entire
church site, including the existing building and property as
well as any proposed improvements.
At this point, a deferral may be appropriate, to allow the
applicant time to address this issue.
8. Staff Recommendation
Staff recommends that this item be deferred until a more
complete, workable site plan has been submitted.

The applicant, Dorothy Ballard, was present. Staff and the
Committee discussed at length the kinds of issues the church
needs to address such as parking, building location, permit

requirements, signage, a workable combined survey and obtaining
advise from an architect.
Ms. Ballard agreed to deal with these issues prior to the public
hearing.
Staff pointed out that a deferral may be appropriate at this
point.
After further discussion, the Committee forwarded this item to
the full Commission.
PLANNING MM1 T ACTIO (AUGUST 24, 1993)
The applicant was not present. There were no objectors present.
Staff informed the Commission that the applicant had written
requesting a deferral to the October 5, 1993 Planning Commission
meeting. The deferral is requested in order to allow the
applicant time to develop a comprehensive site plan.
This item was placed on the Consent Agenda and approved for
deferral to the October 5, 1993 Planning Commission meeting.
The vote was 11 ayes, 0 noes and 0 absent.
BDIVISION COMMITTEE COMMENT: (SEPTEMBER 16, 1993)
Ms. Dorothy Ballard and Bishop H. L. Ballard were present
representing Old Landmark House of Prayer.
Staff presented the item and informed the Committee that a
revised site plan had been submitted showing the removal of the
existing church structure and the construction of a 25 space
parking lot. The Committee was also informed that there was no
need for additional right-of-way dedication, 50 feet of
right-of-way currently exists.
The applicant was informed that the two parking spaces at the
east end of the proposed parking lot need to be removed to
provide maneuvering area.
Ms. Ballard stated that the church was requesting a deferral of
the parking requirements for a period as yet undetermined.
She was advised to obtain estimates of the cost of constructing
the required parking lot and then to approach the Commission with
a definite time period for the requested deferral.

The Committee determined that there were no other outstanding
issues and forwarded this item to the full Commission for final
resolution.
PLANNING COMMISSION ACTIO : (OCTOBER 5, 1993)
Dorothy Ballard and Bishop H. L. Ballard were present
representing Old Landmark House of Prayer. There were no
objectors present.
The Planning staff presented the item and informed the Commission
that one letter of opposition, from the owner of an adjacent
property, had been received.
Staff stated that the applicant had submitted a site plan showing
the placement of the proposed new building on the site. The
existing building will be removed and a parking lot will be
constructed in its place.
The Commission was also informed that the applicant is requesting
a deferral of the parking requirement for a period of three years
after the new building is placed on the property. At that point,
the existing building will be removed and the parking lot will be
constructed as shown on the site plan.
A staff recommendation of approval, subject to compliance with
the City's Landscape and Buffer Ordinances, was offered.
The Commission determined that there were no outstanding issues
and placed this item on the Consent Agenda for approval,
including the requested 3 -year deferral of the parking
requirement.
The vote was 8 ayes, 0 noes and 3 absent.
