Site Location Calvary Apostolic Church Day Care Center - Conditional Use Permit West 44th Street and Potter Street (NW corner) Calvary Apostolic United Pentecostal Church The applicant proposes to establish a day care center within the existing church on this R-3 zoned property. Four Sunday School rooms, a nursery, and the fellowship hall will be utilized from 6:00 a.m. to 6:00 p.m., Monday to Friday, for a day care center accommodating 80 children with a staff of 7. The site is located at the northwest corner of West 44th Street and Potter Street, approximately 1/2 block north of Asher Avenue. 2. Compatibility with Neicthborhood To the north and west of this site is a large area of R-3 Single Family zoning, John Barrow Subdivision. Directly across both West 44th and Potter Streets is Borden Dairy, on I-2 zoned properties. A large area of vacant MF -12 zoned property is located one block north of the church site. The church is planning no additions to the building, parking lot or playground and should continue to be compatible with the neighborhood. 3. On -Site Drives and Parkin There are currently approximately 100 parking spaces on the church property. No increase in parking is proposed or required. City Engineer Comments Dedicate additional 5 feet of right-of-way on both 44th Street and Potter Street. 6. Utility�nents No comments 7. Analysis A church has existed continuously at this site since the area's annexation to the city in 1959. The proposed day care center will not involve any expansion of the building, parking lots or playground area. The applicant has indicated that the existing church sign will be sufficient, so no additional signage is proposed. Staff feels this is a reasonable proposal and is supportive of the application, as filed. 8. staff Recommendation Staff recommends approval of the application as filed subject to compliance with City Engineer Comments. SUBDIVISION C[3MMITTEE COMMENT: (JUNE 24, 1993) Percy A. Billingsley, Pastor of Calvary Apostolic Church, was present. Staff presented the item and outlined the proposal to the Committee. Mr. Billingsley informed the Committee that the church had agreed to dedicate the required right-of-way and would not be erecting any additional signage. After a brief discussion, the Committee determined that there were no outstanding issues and forwarded this item to the full Commission for final resolution. There were no objectors present. Dana Carney, of the Planning staff, presented the item and informed the Commission that the applicant had agreed to the staff recommendation. Commissioner oleson asked if any additional signage would be required for the day care center. She was informed that there would be no additional signage. It was determined that there were no outstanding issues and this item was placed on the Consent Agenda for approval, subject to compliance with the City Engineer Comments and no additional signage for the day care center.
