HomeMy WebLinkAbout16048 1 RESOLUTION NO. 16,048 2 3 A RESOLUTION TO AMEND RESOLUTION NO. 14,872 (OCTOBER 1, 4 2018), TO AUTHORIZE THE CITY MANAGER TO MODIFY THE 5 CONTRACT WITH GARVER, LLC, FOR AN ADDITIONAL AMOUNT 6 NOT TO EXCEED ONE HUNDRED ONE THOUSAND,SEVEN HUNDRED 7 SEVENTY-THREE DOLLARS ($101,773.00), FOR ENGINEERING AND 8 DESIGN SERVICES FOR THE WEST 4TH STREET DRAINAGE AND 9 STREET IMPROVEMENT PROJECT, FROM VALENTINE STREET TO 10 MARTIN STREET; AND FOR OTHER PURPOSES 11 12 WHEREAS, Engineering Consultants for Professional Services related to the 2019-2021 Street and 13 Drainage Capital Improvement Program were selected pursuant to an annual Statement of Qualifications 14 process, Bid No. 17201, to provide Engineering Services for surveying, design, and on-call construction 15 assistance; and, 16 WHEREAS, pursuant to this Request for Qualifications, the approved Selection Committee selected 17 Garver, LLC, to perform Engineering & Design Services for the West 4th Street Drainage and Street 18 Improvement Project; and, 19 WHEREAS, on October 1, 2018, the City Board of Directors adopted Resolution No. 14,872 to 20 authorize the City Manager to enter into an agreement with Garver, LLC, in an amount not to exceed Five 21 Hundred Thirty-One Thousand, Five Hundred Thirty-Nine Dollars ($531,539.00) for the design of three 22 (3) projects, including the West 4th Street Drainage, from Valentine Street to Martin Street; and, 23 WHEREAS, a Contract for Professional Services was executed November 1, 2018, between the City 24 of Little Rock and Garver, LLC, to provide for Engineering and Design Services for the West 4th Street 25 Drainage and Street Capital Improvement Program; and, 26 WHEREAS, after completing 60% of the Design Plans and meeting with affected residents it was 27 determined that substantial revision to the project design was necessary to mitigate the substantial impacts 28 of construction on neighboring residents; and, 29 WHEREAS,the modified contract will provide for the re-routing of drainage to reduce these impacts 30 through detailed plans, specifications, and environmental clearances; and, 31 WHEREAS, funds for the additional project cost are allocated in the 3/8-Cent Capital Improvement 32 Sales and Compensating Use Tax Funds and the Limited Tax Obligation Capital Improvement Bonds as 33 authorized by Resolution No. 14,803, Account No. B3B0071; and, 1Page t of21 1 WHEREAS, the amended Garver, LLC, contract cost for Engineering and Design Services shall not 2 exceed One Hundred One Thousand, Seven Hundred Seventy-Three Dollars ($101,773.00), for a total 3 revised contract amount of Six Hundred Thirty-Three Thousand, Three Hundred Twelve Dollars 4 ($633,312.00). 5 NOW,THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY 6 OF LITTLE ROCK,ARKANSAS: 7 Section 1. The Board of Directors hereby authorizes the City Manager to execute an amendment to 8 the Contract for Professional Services with Garver, LLC, in the amount of One Hundred One Thousand, 9 Seven Hundred Seventy-Three Dollars ($101,773.00) for revisions to the West 41'' Street Drainage and 10 Street Improvement Project, for a total revised contract amount of Six Hundred Thirty-Three Thousand, 11 Three Hundred Twelve Dollars($633,312.00). 12 Section 2. Funds for the additional amount are allocated in the%-Cent Capital Improvement Sales and 13 Compensating Use Tax Funds and the Limited Tax General Obligation Capital Improvement Bonds as 14 authorized by Resolution No. 14,803, Account No. B3B0071. 15 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or 16 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or 17 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and 18 effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the 19 resolution. 20 Section 4. Repealer. All laws, ordinances, resolutions, or parts of the same, that are inconsistent with 21 the provisions of this resolution, are hereby repealed to the extent of such inconsistency. 22 ADOPTED: July 18,2023 23 ATT A.
