Site Location Powell Garden Center - Conditional Use Permit 7305 West 12th Street Wilbert Powell The applicant proposes to utilize this existing C-3 zoned building and site as a garden center with limited outside display. The proposal also includes the construction of an approximately 60 foot by 40 foot greenhouse structure to be erected at the rear of the existing building. The greenhouse will be constructed of steel pipe covered with a copolymer greenhouse covering, and will require a variance from the required 25 foot rear yard setback. This site is located on the south side of West 12th Street, just east of its intersection with South Rodney Parham Road. 2. compatibility with Neighborhood This proposed use will occupy half of a small tract of C-3 zoned property on the south side of West 12th Street. The majority of the uses on the south side of West 12th Street, in the immediate vicinity, are industrial in nature. Directly south of and adjacent to this site is a nonconforming concrete batch plant. Both east and west of this site are large areas of I-2 zoning occupied by warehousing and wholesaling businesses. Across West 12th Street is a vacant tract of C-3 zoning and adjacent to that is a cemetery. The applicant proposes to construct a greenhouse structure behind the existing building and utilize an area on the west side of the building for outdoor display of plants and landscape materials. This proposed use appears to be compatible with the adjacent neighborhood. 3. on-site Drives_ and Parking This site was previously occupied by a car wash and is paved from property line to property line. The proposed greenhouse structure will be constructed in this area and will be screened by the wood fence. Since the property is currently paved and the proposed greenhouse is more of a "temporary" type structure, only a small upgrade in landscaping is required. City Engineer Comments No comments utility Comments No negative utility comments as of this writing. 7. Analysis 8. A lawn and garden center, enclosed is an allowed use within the C-3 zone. The fact that Mr. Powell is proposing to maintain an area of open display generates the need for a conditional use permit. The proposed greenhouse structure will be screened almost entirely by the existing building and 7 foot solid wood fence, and should not have an adverse effect on the adjacent property. Staff feels that this use is appropriate for the area and supports the proposal with the stipulation that the area of outdoor display be limited to that area shown on the site plan. Staff presented the item and explained the proposed construction of the greenhouse structure. A brief discussion took place with Mr. Powell regarding some needed landscaping upgrade. Mr. Powell agreed to place some additional landscaping on the west side of the proposed greenhouse as well as in front of the existing building. After further discussion, this item was forwarded to the full Commission for final resolution. PLANNING COMMISSION ACTION: The applicant was not present. (Mr. Powell later informed the to a death in his family.) (MARCH 9, 1993) There were no objectors present. staff that he was out-of-town due Dana Carney, of the Planning staff, presented the item. He informed the Commission that Mr. Powell had amended his proposal to include a smaller greenhouse structure to be placed directly west of the building, in the area shown for outdoor display. The smaller structure is to be designed of the same material as the proposed larger structure located behind the building. Mr. Carney told the Commission that staff was recommending approval of the proposal as amended to include the second greenhouse structure. After a brief discussion, a vote was taken. The vote was 7 ayes, 0 noes and 4 absent. The application was approved. 3
