3 AN ORDINANCE TO ABANDON THE EAST FIFTEEN (15) FEET OF
4 THE POLK STREET RIGHT-OF-WAY, LOCATED ADJACENT TO LOT
5 7, BLOCK 20, NEWTON'S ADDITION IN THE CITY OF LITTLE ROCK,
6 ARKANSAS (G-23-488); AND FOR OTHER PURPOSES.

8 WHEREAS,the adjacent property owner at 5423 Country Club Boulevard requested to abandon the
9 east fifteen (15) feet of the Polk Street Right-of-Way (fifteen (15) feet by 140 feet), located adjacent to
10 Lot 7, Block 20,Newton's Addition at 5423 Country Club Boulevard;and,
11 WHEREAS, the Polk Street Right-of-Way at this location is currently eighty (80) feet wide, and a
12 fifty (50)-foot wide right-of-way is typically required in single-family residential areas. The fifteen (15)-
13 foot wide portion of right-of-way proposed for abandonment is excess right-of-way; and,
14 WHEREAS, the abandonment is requested in order to incorporate the area of abandonment into the
15 single-family residential lot for extra yard space.
16 WHEREAS,the abandonment of this right-of-way will have no adverse impact on the public welfare
17 and safety. The Little Rock Fire Department submitted no negative comments to the proposed
18 abandonment request; and,
19 WHEREAS, the applicant submitted a letter from an abstract company stating that there are no
20 reversionary clauses attached to the right-of-way requested for abandonment; and,
21 WHEREAS, all of the public utility companies have reviewed and approved the requested right-of-
22 way abandonment; and,
23 WHEREAS, there are no Master Street Plan issues associated with this abandonment request, as the
24 right-of-way is not classified as a collector street or higher.
25 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
26 OF LITTLE ROCK,ARKANSAS:
27 Section 1. The City of Little Rock, hereby releases, vacates, and abandons the following rights-of-
28 way property located at the east fifteen (15) feet of the Polk Street Right-of-Way (fifteen (15) feet by 140
29 feet), located adjacent to Lot 7, Block 20,Newton's Addition at 5423 Country Club Boulevard.
30 Section 2. A copy of this ordinance duly certified by the City Clerk, shall be filed in the Real Estate
31 Records of the Recorder of the Circuit Clerk in Ex-Officio Recorder of Pulaski County, Arkansas.
32 Section 3. Severability. In the event any section, subsection, subdivision, paragraph, subparagraph,
33 item, sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid or

1 unconstitutional, such declaration or adjudication shall not affect the remaining provisions of this
2 ordinance, as if such invalid or unconstitutional provision was not originally a part of this ordinance.
3 Section 4. Repealer. All ordinances, resolutions, bylaws, and other matters inconsistent with this
4 ordinance are hereby repealed to the extent of such inconsistency.
