3 AN ORDINANCE TO LITTLE ROCK, ARK., REV. CODE CHAPTER 8,
4 ARTICLE I, § 8-2(a)(9) (1988), TO PROVIDE FOR THE ADOPTION BY
5 REFERENCE OF THE 2021 INTERNATIONAL EXISTING BUILDING
6 CODE; AND FOR OTHER PURPOSES.

8 WHEREAS, Little Rock, Arkansas Rev. Code §8-2(a)(9) adopts by reference the 2021 edition of the
9 International Existing Building Code and Appendices(A), (B),(C),as published by the International Code
10 Council, Falls Church,Virginia; and,
11 WHEREAS, the City has complied with Arkansas Code Ann. §§14-55-207 (1987) by publishing a
12 notice of intent to adopt these technical codes by reference in a paper of general circulation within the
13 municipality and three(3)copies of Codes have been available for inspection in the City Clerk's Office for
14 the public prior to their adoption; and,
15 WHEREAS,this ordinance amendment is necessary to update the City Code and authorize the use of
16 2021 Edition within the City.
17 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
18 OF LITTLE ROCK,ARKANSAS:
19 Section 1. This Section of Little Rock, Arkansas, Rev. §Code 8-2(a)(9) is hereby amended to read as
20 follows:
21 (A)The following publications are adopted by reference:
22 (9) The International Existing Building Code and Appendices(A), (B),(C)
23 (B) In the event of a conflict between the publications in Subsection (A), the more stringent
24 provisions shall govern.
25 (C)Notwithstanding the provisions of Subsections(A)and (B)above, the City, consistent
26 with other provisions of State Law, shall set the job qualification for its employees.
27 Section 2. All ordinances or parts of ordinances in conflict with this provision are hereby repealed to
28 the extent of the conflict.
29 Section 3. A copy of the 2021 International Existing Building Code, as adopted, will be maintained
30 in the Office of the City Clerk.
31 Section 4. Code Application. Permits obtained prior to the effective date of this ordinance will be
32 enforced under the previous adopted Code till final disposition of the Permit.
33 Section 5. Effective date of this Code shall be August 6, 2023.

1 Section 6. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
2 word of this ordinance is declared or adjudge to be invalid or unconstitutional, such declaration or
3 adjudication shall not affect the remaining portions of this ordinance, which shall remain in full force and
4 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of this
5 ordinance.
6 Section 7. Repealer. All laws, ordinances, resolutions, or parts of the same that are inconsistent with
7 the provisions of this ordinance are hereby repealed to the extent of such inconsistency.
