3 AN ORDINANCE TO AMEND LITTLE ROCK, ARK., REV CODE
4 CHAPTER 8, ARTICLE I, § 8-2(a)(1) (1988), TO PROVIDE FOR THE
5 ADOPTION BY REFERENCE OF THE 2021 ARKANSAS FIRE
6 PREVENTION CODE, VOLUME I (FIRE) WITH ARKANSAS
7 AMENDMENTS; AND FOR OTHER PURPOSES.

9 WHEREAS, Little Rock, Arkansas Rev. Code §8-2(a)(1)adopts by reference the 2021 Edition of the
10 Arkansas Fire Prevention Code, Volume I (Fire) with the most current Arkansas Amendments and 2021
11 Revisions and Appendices(B),(C),(D),(E),(F),(G),(H),(I),(J),(K),(L),(M),(N)and(0)(Based on the
12 2021 International Fire Code)as published by the International Code Council, Falls Church, Virginia; and,
13 WHEREAS, the City has complied with Arkansas Code Ann. 14-55-207 (1987) by publishing a
14 notice of intent to adopt these technical codes by reference in a paper of general circulation within the
15 municipality and three(3)copies of Codes have been available for inspection in the City Clerk's office for
16 the public prior to their adoption; and
17 WHEREAS,this ordinance amendment is necessary to update the City Code and authorize the use of
18 the 2021 Edition within the City;
19 NOW, THEREFORE BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
20 OF LITTLE ROCK,ARKANSAS:
21 Section 1. This Section of the Little Rock, Arkansas Rev. Code §8-2(a)(1) is hereby amended to read
22 as follows:
23 (A)The following publications are adopted by reference:
24 (1)The"2021 Arkansas Fire Prevention Code, Volume I (Fire) with the most current
25 Arkansas Amendments and 2021 Revisions and Appendices(B),(C),(D),(E),(F),
26 (G), (H), (I), (J), (K), (L), (M), (N) and (0) based on the (2021 International Fire
27 Code)
28 (B) In the event of a conflict between the publications in Subsection (A), the more stringent
29 provisions shall govern.
30 (C) Notwithstanding the provisions of Subsections(A)and (B)above,the City, consistent
31 with other provisions of State Law, shall set the job qualification for its employees.
32 (D) Any future adoptions of the Arkansas Fire Prevention Codes by the State of Arkansas will
33 be effective in the City of Little Rock on the effective date of state implementation.
34 Appendices if recommended will be required to be adopted by City Ordinance.

1 Section 2. All ordinances or parts of ordinances in conflict with this provision are hereby repealed to
2 the extent of the conflict.
3 Section 3. A copy of the 2021 Arkansas Fire Prevention Code, Volume I (Fire), as adopted, will be
4 maintained in the Office of the City Clerk.
5 Section 4. Code Application. Permits obtained prior to the effective date of this ordinance will be
6 enforced under the previous adopted Code till final disposition of the Permit.
7 Section 5. Effective date of this Code shall be August 6, 2023.
8 Section 6. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
9 word of this ordinance is declared or adjudge to be invalid or unconstitutional, such declaration or
10 adjudication shall not affect the remaining portions of this ordinance, which shall remain in full force and
11 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of this
12 ordinance.
13 Section 7. Repealer. All laws, ordinances, resolutions,or parts of the same that are inconsistent with
14 the provisions of this ordinance are hereby repealed to the extent of such inconsistency.
