Justification: Applicants Statement: We are requesting a zoning variance at 1901 Shadow Lane to allow encroachments into the front yard setback requirement of 25 feet and the north side yard setback of 7.5 feet. Our proposed plan includes a two story addition to the front of the existing house which extends into the front yard setback one foot, aligning with the front edge of an existing patio step. We feel this encroachment is justified not only for aesthetic reasons, but more importantly for safety. A one foot protruding corner at the entrance to the house could be a tripping hazard. While the addition is outside the 25 foot setback on the northwest corner it falls one foot into it due to the angle of the street. It is our opinion that such a minor encroachment would be inconsequential to the overall character of Shadow Lane. We also propose a one story addition to the north housing a new fireplace with built ins on each June 30, 1997 em No.: 2 side. To obtain the required depth for a television cabinet and a computer desk, our addition falls three and one half inches into the side yard setback. Since there are existing outbuildings within this setback and because of the minimal encroachment, we feel this variance is also justified. Present Use of Property: Single family Proposed Use of Property: Single family Staff Report: A. Public Works Issues: No issues. B. Staff Analysis: The applicant proposes to remodel the single family home at 1901 Shadow Lane including the construction of a two-story addition onto the front of the house and a smaller one-story addition onto the north side of the house. The addition on the front has a corner encroachment of approximately 1 foot across a platted 25 foot building line. The addition on the north side encroaches approximately 3.5 inches into the required 7.5 foot side yard setback. Due to the angle of the house in relationship to the front property line, the addition to the front of the house crosses the building at only one corner. The encroachment is approximately 1 foot. Staff believes this minor variance will have no impact on adjacent properties. The 3.5 inch encroachment on the north side is visually negligible and again should have no impact on adjacent properties. Should the building line variance be approved, the applicant will have to do a one -lot replat reflecting the change approved by the Board. The applicant should review the filing procedure with the Circuit Clerk to determine if the replat requires a revised Bill of Assurance. C. Staff Recommendation: Staff recommends approval of the requested side yard setback and building line variances subject to a replat of the lot reflecting the change in the building line as approved by the Board. 2 June 30, 1997 Item No.: 2 (Con BOARD OF ADJUSTMENT (JUNE 30, 1997) Carolyn Lindsey was present representing the application. There were no objectors present. Staff presented the item and a recommendation of approval subject to a one lot replat. Ms. Lindsey offered no additional comments other than to state that she understood staff's recommendation. The question was called and a vote taken on the variance requests subject to a replat of the lot. The vote was 8 ayes, 0 noes and 1 absent. 3
