A variance is requested from the

The applicant would prefer the new
addition to maintain the setback of
the existing building. This
variance was previously approved by
the Board on April 27, 1992.

Church
Right-of-way required for 12th Street is 70 feet, 35 feet
from centerline. Dedicate 5 feet of right-of-way for 12th
Street. Dedicate 5 feet of right-of-way for Madison to
bring to 30 feet from centerline. Driveways shall be
reduced to conform with City Ordinance one drive per 300
feet of frontage. Alley has 15 foot platted right-of-way.
Dedicate additional right-of-way to bring to 20 feet and
improve alley to minimum width to accommodate 2 way traffic.
Recommend 18 feet of alley from parking access to Madison
Street. Dedicate 20 foot radial area at intersection and
improve turn radius to 25 feet minimum. Improve sidewalks
and ramps to CLR standards. Submit 3 sets of P.E. plans for
widening of Madison Street to 18 feet from centerline and
include other construction within the right-of-way.

B. Staff Analysis:
On April 27, 1992, Holy Cross Baptist Church obtained a
variance from the Board of Adjustment which allowed for the
construction of a 4,381 square foot addition with a reduced
rear yard setback of 7 feet. At that time, the property was
zoned C-3 and the required rear yard setback was 25 feet.
The property has subsequently been rezoned to 0-3 which has
a rear yard setback requirement of 15 feet.
The addition has not yet been constructed. Article IV,
Section 2 of the Board of Adjustment Bylaws states "If an
application is approved by the Board, all permits necessary
for the initiation of work shall be obtained within two (2)
years from the date of approval, unless an extension of time
is granted by the Board. Otherwise, the Board approval of
the application shall be considered void." The Board's
approval was considered void on April 27, 1994. The church
is now ready to proceed with the project and is asking the
Board to again approve the rear yard setback variance to
allow for construction of the addition with a reduced rear
yard of 7 feet.
The purpose of the addition and justification presented for
the reduced setback is the same as in 1992. The addition
will include a connecting passageway, ten classrooms, a
conference room, corridors and restroom facilities. The
logical connection between the new and existing construction
is at an existing exterior doorway located 3 feet from the
existing rear wall. The rear wall of the existing structure
is located 7 feet off of the rear property line. Entry at
any other point will require extensive remodeling of the
existing building. Relocating the proposed building forward
will protrude into the front yard setback or will require
elimination of approximately 17 feet in the building
dimension. There is an existing asphalt paved alley which
separates the church site from the properties to the rear.
Staff feels the applicant's request is reasonable and
supports the requested rear yard setback variance.
The Public Works Department's Comments vary somewhat from
those in 1992 and may have an effect on driveway location
and setbacks once the required right-of-way dedication
occurs.
These issues do not directly affect the variance before the
Board and staff recommends approval of the variance request
subject to the applicant submitting a revised site plan
addressing those issues.

C. Staff Recommendation:
Staff recommends approval of the requested rear yard setback
variance subject to compliance with the following
conditions:
1. Compliance with the Public Works Comments
2. Compliance with the City's Landscape and Buffer
Ordinances
3. Submission of a revised site plan which addresses the
above issues
BOARD OF ADJUSTMENT:

Raymond Branton was present representing Holy Cross Baptist
Church. There were no objectors present. Staff presented the
item and briefly discussed the history of the project. Staff
recommended approval of the rear yard setback variance.
Mr. Branton addressed the Board in support of the item. He
described the project and stated that he would address each of
the Public Works Comments prior to obtaining a building permit.
He stated that the project would comply with the City's Landscape
Ordinance.
A motion was made to approve the rear yard variance subject to
compliance with the conditions noted in the staff recommendation.
The motion was approved by a vote of 7 ayes, 0 noes and 2 absent.
