I am the owner of the above property located in the original City of Little Rock,
under Block 54, Lots 9, 10 and 11. Please take note of the attached Order from Pulaski
County Court Quieting Title to said lots.
It has been explained to me that the Certificate of Appropriateness that was
approved, by the McArthur Park Commission, incorporates a stipulation that the adjacent
property owner's fence should remain in its present position.
I am submitting this letter to remind the Commission that such a matter relating to
bounds and mead for property owners falls within the realm of real estate law and not the
Commission's authority. The issuance of a Certificate of Appropriateness with such a
stipulation is outside of the authority of the Commission. Any request before the
Commission, regarding historic conformity or proposed dwellings, should not be
modified to include such a mandate.
In addition, if the adjacent property owner wishes to keep his fence in place outside of
his property's boundaries; then he must follow the normal channels for any purchase of
real estate and pay consideration for the land. The attachment of any easement, ride -of -
way or otherwise to the issuance of the C of A is unacceptable to me and any issuance of
easement rights without consideration, unequitable.
Please review the Certificate of Appropriateness with its stipulation for Commission
jurisdiction and authority. I shall expect your decision on this request, in writing.
In addition, all future decisions, considerations and advisements, either proposed or
stipulated should be sent to me in writing by facsimile at (718) 445-1352, ten (10) days,
prior to any meeting or hearing.
