ANALYSIS:
The C-4 request along Colonel Carl Miller Road is to reflect
an existing commercial use in an area shown as single family
on the land use plan.
STAFF RECOMMENDATION:
Staff recommends that Z -5513-B be denied and remain R-2.
PLANNING COMMISSION ACTION: (NOVEMBER 5, 1991)
Applicant John Crockett was represented by Mark Riable,
Attorney -at -Law. Ron Newman, Planning Manager presented the
item to the Commission, giving the Staff recommendation that
Z -5513-B not be rezoned and remain R-2.
Mr. Riable requested that Item Z -5513-B be deferred so that
he could consult with Mr. Crockett. A motion was made to
defer Z -5513-B to the December 17 meeting. The motion was
approved unanimously.

ANALYSIS:
The request at Crystal Valley and Col. Carl Miller Road
(Z -5513-A) is to rezone the entire tract to C-3. The north
one-half of that tract is commercial on the land use plan,
and is being used as a office/residence. The south half is
vacant land, primarily in the floodway.
The C-4 requests along Col. Carl Miller Road (Z -5513 -B&C)
are to reflect existing commercial uses in an area shown as
single family on the land use plan.
The request for C-4 zoning at the point where Crystal Valley
turns north (Z -5513-D), is to recognize an existing
commercial/residential use in an area shown as single family
on the land use plan.
STAFF RECOMMENDATION:
Staff recommends that Z -5513-A be rezoned to 0-3 on the
north half and remain R-2 on the south half.
Staff recommends that Z -5513-B, Z -5513-C and Z -5515-D be
denied and remain R-2.

PLANNING COMMISSION ACTION: (November 19, 1991)
Ron Newman presented the Staff report. At the request of
the Planning Commission, Item A was deffered to theis
meeting so that Staff could further review the area. Staff
reviewed the area and determined that their recommendation
had not changed.
Commissioner Walker questioned how far from the city limits
did Z-5513 A,B,C & D exist. All the properties are within a
mile of the city limits. Commissioner Nicholson asked about
the Master Street plan classifications of roads in the area
of Colonel Carl Miller Road. Mr. Malone responded to the
question. Commissioner Oleson had a concern of the number
of residential sites along Colonel Carl Miller Road. Mr.
Newman assired her that a majority of the area was
underdeveloped and there was a mixture of residential and
commercial sites.
Attorney Mark Riable, represents Clarence Bryles-Mini
Storage Business, spoke on behalf of Z-5513 C. Mr. Riable
state that the storage buildings had an 80% occupancy at
this time and that Mr. Bryles would like to expand his
business at some point. Mr. Riable requested a PCD
classification. There was no action on the request.
Commissioner McDaniel asked about the voting procedure for
Z-5513 on items A,B,C & D. Mr. Lawson stated that would be
best to divide the cases instead of one blanket vote for the
whole package. Commissioner Oleson suggested that the
commission hear from all of the applicants before voting.
Z-5513 A: Ralph Russell (owner). Mr. Russell stated that
the county had designated his property as commercial and
would like for the commission to leave it that way.
Commissioner McDaniel stated that if the commission did not
take action Mr. Russell's property will be zoned R-2. Mr.
Russell again stressed that his property had a commercial
designation as per the county. Mr. Russell questioned if he
could move a trailer in and out on his property with an
0-3/AF zoning. Mr. Newman stated that he could.
Commissioner Putnam stated that Mr. Russell take the 0-3/AF'
zoning and come back to the commission when the status of
his business changes. Commissioner Putnam moved to zone A-
5513 as 0-3 on the northwest corner and AF on the southhalf.
The motion passed 8 ayes, 1 abstention.
Z-5513 D: Virginia Jones -requesting that the sheet metal
shop on her property be zoned C-3 or PCD. Mrs. Jones lives
on the property and so does her son. Mrs. Jones actually
request is to have the sheet metal shop area zoned and the
residential area be left R-2. This application would be a
PCD because of the mixed uses on the property. Ron Newman
stated that the area is not shown as commercial on the land
use plan. Commissioner Nicholson asked why the area was
not designated as commercial and also why is staff
recommending that this property remain R-2. Newman

explained that staff recommends commercial or other than R-2
at intersections. Commissioner Putnam asked that Mr. Newman
explain what he had suggested to Mrs. Jones. Mr. Newman
stated that he suggested that Mr. Jones ask for a PCD
instead of commercial zoning because of the mixed nature of
her property, but that staff recommendation would still be
R-2 encompliance with the land use plan. Commissioner
Oleson asked if the Landscape Ordinace is not enforced
outside of the city limits. Commissioner Walker made a
motion that Z-5513 D be recommended for a PCD provided
that documentation was presented to the staff within 15
days. The motion was seconded and passed 8 ayes, 1
abstention.
5513 C: Mr. Riable asked that his client be granted a PCD
and that they would provide documentation and scaled
drawings within 15 days. Commissioner Nicholson moved that
Z-5513 C be approved for PCD and that the appropriate
documentation be provided within 15'days. The motion was
seconded.
Discussion: Commissioner Oleson was concerned if the
commission was thinking about the general good of the area.
Commissioner Walker asked if the applicant would agree to
the appropriate landscaping when buildings 3 & 4 were
constructed. The applicant agreed. Commissioner Nicholson
amended her motion to include that at such time buildings 3
& 4 be erected that it includes the normal screening as
provided in the landscape ordinance and that the applicant
provide the appropriate documentation within 15 days.
Motion passed 9ayes, 0 no.
Z-5513 B: Mark Riable also representing Crystal Valley Auto
Ranch. Mr. Riable asked that the commission grant the Auto
Ranch a PCD and that the appropriate documents would be
submitted within 15 days. Commissioner Oleson asked if this
particular type business could survive without a commercial
zoning. Commissioner Perkins stated that the business need
to be screened and buffered. After further discussion, Mr.
Riable asked that this item be deferred until the next
meeting. Commissioner Oleson moved to defer the item
Z-5513 B to the December 17, 1991 meeting. Motion seconded
and passed 9 ayes, 0 no.
