RIGGS, IN AN AMOUNT NOT TO 5 EXCEED ONE HUNDRED EIGHTY-NINE THOUSAND,TWO HUNDRED 6 FIFTY AND 27/100 DOLLARS ($189,250.27), PLUS APPLICABLE TAXES 7 AND FEES, FOR THE PURCHASE OF ONE (1) CATERPILLAR MODEL 8 313GC9TB EXCAVATOR WITH A THIRTY-SIX (36)-INCH BUCKET 9 AND HYDRAULIC THUMBER FOR THE PARKS & RECREATION 10 DEPARTMENT; AND FOR OTHER PURPOSES. 11 12 WHEREAS, the Parks & Recreation Department has demonstrated a need to purchase one (1) 13 Caterpillar Model 313GC 9TB Excavator with thirty-six a(36)-inch Bucket&Hydraulic Thumb,to replace 14 the one that was destroyed bythe E-3 Tornado that occurred on March 31,2023; and, 15 WHEREAS,vendor selection was made using Sourcewell Contract No. 032119-CAT;and, 16 WHEREAS, the total purchase price for one (1) Caterpillar Model 313GC 9TB Excavator with a 17 thirty-six(36)-inch Bucket and Hydraulic Thumb shall not to exceed One Hundred Eighty-Nine Thousand, 18 Two Hundred Fifty and 27/100 Dollars($189,250.27),plus applicable taxes and fees. 19 NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY 20 OF LITTLE ROCK,ARKANSAS: 21 Section 1. The City Manager is authorized to enter into an agreement with J.A.Riggs,for the purchase 22 of one (1) Caterpillar Model 313GC 9TB Excavator with a thirty-six (36)-inch Bucket and Hydraulic 23 Thumb, in an amount not to exceed One Hundred Eighty-Nine Thousand,Two Hundred Fifty and 27/100 24 Dollars($189,250.27), plus applicable taxes and fees,to be used by the Parks&Recreation Department. 25 Section 2. Funds for this purchase are allocated in various accounts. 26 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or 27 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or 28 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and 29 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the 30 resolution. 31 Section 4. Repealer.
