Patrick Herndon Location: 10501 I-30 Request: Rezone from R-2 to C-4 Purpose: Used car lot and transmission shop Size: Existing: 0.58 acres Used car lot and transmission shop SURROUNDING LAND USE AND ZONING North - I-30 Right -of- Way, zoned R-2 South - Vacant, zoned R-2 East - Single -Family, zoned R-2 West - Commercial, zoned R-2 STAFF ANALYSIS This issue is before the Planning Commission due to an enforcement action by the City. The site is zoned R-2, and has C-3 non -conforming status. A transmission shop and used car lot, C-4 uses, recently occupied the location and a zoning violation notice was issued by the City. The owner is now requesting a R-2 to C-4 rezoning for the property. Zoning in the general vicinity is R-2, C-3, C-4 and I-2. The nonresidential zoning for the properties fronting I-30 is a combination of C-3, C-4 and I-2. Land use is a mix of single family, commercial, industrial, and a mobile home park. A number of uses are non -conforming and there are several vacant tracts found throughout the area. Over the years, the City has endorsed a zoning configuration of C-3, C-4 and I-2 along the I-30 corridor. The proposed C-4 reclassification conforms to established pattern and should not have any impact on the surrounding land. Also, the current Otter Creek District plan shows the site for strip development, and either C-3 or C-4 is the appropriate zoning classification for the land use element. Therefore, the C-4 rezoning does not create any type of plan conflict. 1 May 21, 1991 ITEM ND.: 3 Z-5439 Cont. The plan I-30/Mabelvale West planning Staff recommends approval of the C-4 rezoning as filed. PLANNING COMMISSION ACTION (May 21, 1991) The applicant was present. There were no objectors and the request was placed on the consent agenda. A motion was made to recommend approval of the C-4 rezoning. The motion passed by a vote of 9 ayes, 0 nays, 1 absent and 1 open position. 2
