A plicant's Statement: In connection with an interior remodeling of my house, I am planning to add a small alcove (approximately five feet deep by six feet wide by one story tall) to permit access to a stairway leading to a bedroom above my garage. The alcove will attach to the west side of my house and be set into a recess formed by the north wall of the garage and an existing chimney, and will be no closer to the property line than the garage wall. A building permit has been issued for construction, but it requires that the alcove wall be set back at least 5.7 feet from the property line. If this requirement is met, the interior wall of the alcove will not align with the wall of the stairwell leading to the bedroom over the garage. That configuration would make the route to the bedroom a zig-zag, rather than a 90 degree turn, and would impede access. My request is that I be allowed to build the alcove to permit alignment of the internal walls, which would result in the exterior January 27, 1997 Item No.: 1 Cont. In no event will the alcove wall be closer to the property line than the existing west wall of the garage, which is 24 feet in length and, at its highest point, approximately 20 feet high. The visual impact of the alcove will be negligible. The difference between what has been approved by the building permit and what is required to make the internal structural configuration acceptable is less than one foot. The alcove will not be visible to my neighbors to the east or south, and from the north (Woodlawn Drive) will be no more visible than the garage already is. My next-door neighbor to the west, Mrs. L.R. Moffett, has advised me that she has no objection to constructing the alcove as proposed in this letter. Staff Analysis: The applicant is in the process of remodeling the house located on the R-2 zoned property at 4201 Woodlawn Avenue. In connection with the remodeling, the applicant plans to add a small alcove to permit access to a stairway leading to a bedroom above the garage. The alcove is proposed to line up with the existing west wall of the house which has a 4.7 foot side yard setback. The ordinance requires a 7.5 foot side yard setback for this lot. The proposed addition is very small, only 5 feet deep by 6 feet wide and one story tall. The existing garage portion of the house has a 4.7 foot side yard setback and the impact of adding this small alcove will be negligible. Staff_ believes the variance request to be reasonable. BOARD OF ADJUSTMENT: (JANUARY 27, 1997) The applicant, Walter May, was present. There were no objectors present. Staff presented the item and a recommendation of approval, with conditions. Mr. May offered no additional comments other than to state that he understood and agreed with staff's recommendation. The question was called and a vote taken on the variance request as recommended by staff. The vote was 5 ayes, 0 noes, 3 absent and 1 open position. 3
