Variances are requested from the
area regulations of Section 36-254
to permit construction of a home
with a reduced side yard setback
and from the height and area
provisions of Section 36-156 to
permit construction of an accessory
building with a reduced street side
yard setback and which occupies
more than 30 percent of the
required rear yard.
A licant's Statement: The
subject property is an unimproved
residential lot. The applicant
proposes to construct a home on
this property. The small size of
the lot makes it very difficult to
construct a house of more than
minimal size.
A detached two car garage will
occupy the rear portion of the lot.
This structure will use more than
30% of the rear 25 feet of the lot
and will require a variance. The
garage will be entered from Van
Buren Street. There will be 26
feet between the curb on this
street and the garage door. This
should be sufficient for
maneuvering of the vehicles.
There is a problem with side yard
setback because a portion of the
lot has been lost in adverse
possession. This too will require
a variance. The main body of the

home will meet or exceed the side
setback requirement. The setback
variance will only be for a very
short distance on the right rear of
the home.
Even though meeting the setback
requirements for front, rear and
left side of the home, the left
side will be within the area of Van
Buren Street recently closed by
City Ordinance #16088. The
applicant is presently obtaining
permission from all utility
agencies for this intrusion.

This item was withdrawn by the applicant prior to completion
of the agenda. Plans were produced which conformed to
ordinance setback requirements.

Staff reported to the Board that Mr. Nolan Rushing, the
applicant, in this instance has withdrawn his application from
further consideration. The withdrawal is due to Mr. Rushing
downsizing the structure in a way that it now meets the setback
requirements on the lot.
