Please accept this email as notification of a change to the application for the rezoning of 16719 Cantrell
Road filed February 4, 2009. The change is as follows:
The property will be used "as is" without amending the parking lot to add additional spaces.
In addition, I request that this application be deferred to the April 30th meeting. The dentist that had
placed the property under contract backed out due to parking constraints, but there is interest from a
physician to use the space for his general practice. As a single physician operator, the current parking
meets his needs and complies with zoning requirements for this use. Based on the interest from the
medical community in general, Mr. Richard Organ would like to pursue the allowable uses to include
medical clinics, as opposed to withdrawing the application, as stated in a previous email.

Included with this cover memorandum, please find an Application for Rezoning and a revised
site plan amending the current parking lot. The subject of the Rezoning is to expand
allowable uses within the current Planned Office Development (POD) to include medical,
dental or optical clinics in addition to the general and professional office uses which are
allowed under the current zoning. Also, the owner would like to expand the parking as
shown on the attached site plan, which will increase the parking spaces from 11 (current) to
21.
The subject property is identified as 16719 Cantrell Road and is owned by Richard Organ.
There is a contract for purchase on this property by a dentist, who plans on operating his
practice at this location. Under the current POD, this use is not allowed. This property is a
3,100 SF house that has been converted to office and is flanked on either side by commercial
properties. The property is nonconforming to the Highway 10 Design Overlay District and has
been grandfathered in as such. EK Williams Tax Service is the neighbor west of this property
and Reflections Salon is the adjacent neighbor to the east. Montagne Court, comprised of
patio homes, abuts the south end of this property and is buffered by an existing 8' wood
screening fence.
Although there is sufficient parking at this time to comply with zoning requirements for
medical use, the new owner may add an additional dentist in the future, and therefore would
like to be able to accommodate additional staff and patient needs. Also, the proposed buyer
provides services in part, to an elderly clientele and feels that they would be best served by
being allowed to park directly in front of the building, which is where the reception area is.

By expanding this POD to include this use, there is no expectation that this will in any way
impede traffic flow on Highway 10. There is a single point of ingress/egress.
