STAFF ANALYSIS•
The property in question is located at the NE corner of West
Markham and Old Town Road, and the request is to rezone the
land from 110-3" to 11C-111. The proposal is to replat the
acreage into two lots and to develop the southern tract for
an upholstery shop, which is a conditional use in the "C-1"
district. (A conditional use permit request has been filed
and it is Item No. 5 on this agenda).
Zoning in the general area includes 11R-2111 "R-511, "MF -18111,
110-311, "C-1" and "PCD". The site under consideration abuts
a "C-1" parcel to the north and "PCD" to the east. Across
Old Town Road, the existing zoning is 110-3" and "PCD". Land
use in the immediate vicinity is single family, multi-
family, a church, office, commercial and a large auto sales
facility to the east. Some of the land is undeveloped at
this time and there are several established single family
subdivisions to the south.

The adopted plan, Rock Creek Valley, shows the property for
office use. Currently, the commercial line is directly to
the east, the western boundary of the "PCB". From the "PCD"
to Parkway Place Drive, the land between the Chenal Parkway
and West Markham is identified for office use, and a high
percentage of it is zoned 110-311.
Because of the existing land use and developing zoning
pattern, it appears that a commercial reclassification is a
reasonable option for the property. Adding an acre of
commercial land should not have an impact on the area
because of the major commercial development to the east,
which is an auto dealership with outside display.
Staff's position is that a "C-1" reclassification for the
site is appropriate and supports the request. Should the
Planning Commission endorse the rezoning, a plan amendment
will be forwarded to the Board of Directors along with the
rezoning. Staff will recommend that the plan be changed to
shift the commercial line to Old Town Road to recognize the
"C-1" parcels on the east side of Old Town Road.
