Rezone from "R-2" to "AF" Plant material storage 2.5 acres Vacant and Plant material storage SURROUNDING LAND USE AND ZONING: North-- Vacant, and Rock Creek, zoned "R-2" South Vacant, Single Family, zoned "R-2" East - Vacant, and Rock Creek, zoned "R-2" West - Vacant, Single Family, zoned "R-2" and "MF -18" STAFF ANALYSIS: The two tracts that are included in this rezoning request are adjacent to Rock Creek, which is undergoing some major channel improvements. As a part, of the project, the City has determined that it will have to acquire some additional land in the area. from Robert Tice. During the initial discussion, Pyr. Tice suggested a possible exchange for the parcel that the City owns at the northeast corner of West 16th and Leander. The City has agreed to Mr. Tice's offer and is proceeding with the necessary negotiations. Mr. Tice operates a landscaping service/garden center and his property is primarily used for the storage of plants and other materials. His plans are to utilize the City's land for additional storage and the Planning Staff has determined that a rezoning to "AF" is necessary. It was also decided to include Mr. Tice's existing opera.t.ion in the request to the do away with the property's non -conforming status. The rezoning to "AF" will only recognize the existing use and allow Mr. Tice to continue what he is currently doing. 1 I July 31, 1990 Item No. ?Z-5348 _ inued) Should any structures be proposed for either location, a conditional use permit will be required because plant nurseries are listed as a conditional use in the "AF" district. Zoning in the general vicinity is "R-2", "MF -1811, "C-3", and "I-2", with the residential south of Rock Creek and the non- residential zoning north of the creek. The existing land use is very similar to the zoning pattern. There are several parcels that are undeveloped, including large "MF - 18" tract to the west. ENGINEERING COMMENTS: None reported. STAFF RECOMMENDATION: Staff recommends approval of the "AF" rezoning. PLANNING COMMISSION ACTION: (July 31, 1990) The applicant was in attendance. There were no objectors and the issue was placed on the consent agenda. A motion was made to recommend approval of the AF rezoning. The motion was approved by a vote of 8 ayes, 0 nays, and 3 absent.
