STAFF ANALYSIS:
The request for 2709 Izard Street is to grant a special use
permit for a day care family home. The zoning odinance
defines a day care family home as:
Any facility which provides child care in a family
setting within the care giver's family residence in
accordance with provisions of licenses procedures
established by the State of Arkansas. This use shall
be limited to a maximum of 10 children at any time,
including the care giver's children. The minimum
number of children to qualify as requiring a special
use permit is 6 from households other than the care
giver. The use must obtain a special use permit in all
zoning districts where day care centers are not allowed
by right.
The property is zoned 11R-4", and the applicant is proposing
to care for 7 to 8 children.

The lot is situated in a neighborhood where the primary land
use is single family residential. However, there are some
other uses, duplexes and a day care, scattered througout the
area. Zoning of the immediate neighborhood is either "R-3"
or "R-4". Along West Roosevelt, 2 1/2 blocks to the north,
there is some non-residential zoning.
Other than restricting the day care to the operator's
residence and the number of children, the zoning ordinance
does not list any other criteria for a day care family home.
When reviewing a special use permit, staff looks at the yard-
areas
ard-areas and safety of children. With this request, it appears
that, there is adequate space for outside play. Any outdoor
locations that will be used by the children that are not
already fenced, should be fenced as soon as possible. Also,
the play areas are somewhat removed from the street so
safety should not be a problem. The alley or the street can
be used as an adequate drop off point.
A day care family home is an appropriate use for a
neighborhood, and staff supports the request. The use can
provide an needed service for an area and should have no
impact on the nearby properties.
ENGINEERING COMMENTS:
None reported.
STAFF RECOMMENDATION:
Staff recommends that the special use permit be granted for
2709 Izard Street.
PLANNING COMMISSION ACTION:
(July 31, 1990)
The applicant was present. There were no objectors and the
item was placed on the consent agenda. A motion was made to
approve the special use permit for 2709 Izard Street as
requested. The motion passed by a vote of 8 ayes, 0 nays,
and 3 absent.
