OWNER/APPLICANT: Thomas and Linda Bright PROPOSAL: To remove an existing 1971 model, 780 square foot nonconforming single wide mobile home and to replace it with a 1990 model, 1456 square foot double wide manufactured mobile home on 0.33 plus or minus acres of land that is zoned "R-21'. The proposal should be compatible with the surrounding area. 3. On -Site Drives and Parking The site contains an 11.8 feet (width) asphalt drive and a parking area located in the rear yard. 4. An al y q.l s The Staff feels that the proposal will be compatible with the surrounding area (See Note No. 2). The applicant's proposal will meet City Building Codes and placement requirements (concrete block foundation). 7. Staff Recommendation Approval as filed. SUBDIVISION COMMITTEE REVIEW: The applicant was present. There were no unresolved issues. PLANNING.,_COMMIS_SI.ON-ACTION: ( July 17, 1990 ) The applicant was present. There were two -objectors present. The Staff stated that the application met the Ordinance standards and recommended approval as filed. Ms. Darcia Norwood, Secretary for Sewer Improvement District No. 147, spoke in opposition to the proposal. She stated that allowing manufactured housing in the area would provide 2 July 17, 1990 SUBDIVISIONS Item No. 12 (Continued) inadequate value and hurt the assessment in the district, thereby causing long term financial difficulty for the area. She further stated that a dump truck was being parked on the subject property. She also questioned the possible nonconformance status of the accessory buildings in the rear yard area. The Staff stated that the commercial vehicle ordinance prohibited the parking of a dump truck on site, and that only one accessory building was nonconforming by a margin of 1.3 feet on the side yard. Staff also stated that the nonconforming accessory building would not preclude making the principal str6)cture a conforming use, provided the application was approved by the Planning Commission. Mr. J. H. Penny of 524 West Scenic Drive, stated that he owned property in the area and that initially he had been opposed to the idea of manufactured housing, but that he had changed his mind and was now in favor of it. Ms. Karen Johnson, attorney for Frank Daley, spoke in opposition to the proposal. She stated that manufactured housing in the area would hurt the long term financial opportunities for the sewer improvement district because it would tend to preclude others from building more expensive conventional housing. The Commission questioned the Staff about whether or not the application met the ordinance requirements. The Staff stated that it did. The Commission then asked the City Attorney, Stephen Giles, whether they could deny the application, if it in fact met the City Ordinance requirements. Mr. Giles stated that if the application met the Ordinance requirements, there would be no justification or grounds for denial, The Commission then voted 10 ayes, 1 absent to approve the application as recommended by the Staff. 3
