STATEMENT OF PROPOSAL:
The applicant proposes a time extension of 3 years to begin work
on the existing PCD.
A. PROPOSAL/REQUEST:
The applicant requests approval by the Planing Commission of
a 3 -year extension on the PCD which was approved the Board
of Directors on September 18, 1990.
B. EXISTING CONDITIONS:
The site is undeveloped and wooded.
C. ENGINEERING/UTILITY COMMENTS:
No comments were received.
D. ISSUES/LEGAL/TECHNICAL/DESIGN:
The Zoning Regulations, Sec. 36-454(d) stipulate that the
applicant shall have three (3) years from the date of
preliminary plan/plat approval to submit the final
development plan/plat, but that the Planning Commission may

grant extensions of not less than one (1) year nor more than
three (3) years. The applicant is requesting an extension
as provided in the Regulations.
E. ANALYSIS•
The application is in order and there are no negative
comments by any division or utility company.
F. STAFF RECOMMENDATIONS:
Staff recommends approval of the request.

Mr. Pat McGetrick, the engineer on the project, was present.
Staff outlined the requested to the Committee, and after a brief
discussion, the Committee referred the matter to the Commission
for review.
PLANNING COMMISSION ACTION:
(November 16, 1993)
Staff presented the item and reported that there are no
unresolved issues to be addressed. The item was included on the
consent agenda for approval and was approved with the vote of
8 ayes, no nays, 2 absent, no abstentions, and 1 open position.

This proposal consists of the construction of a
financial building ori one -Lot and creating two
additional lots for single family houses.

L. EXISTING CONDITIONS:
This tract of land is generally in an undisturbed state
with large mature timber. The principal arterial is
Highway 10, lying along the south boundary. Joe T.
Robinson Elementary School is directly east from this
tract.
C. ENGINEERING COMMENTS:
Provide principal arterial right-of-way for. Highway 10
(55 feet from center line). Development should provide
"in -lieu" contribution for Highway 10 improvements.
Indicate what improvements are proposed for Morgan
Road.
D. ISSUES / LLGAL/ TECHNI_CA-L• /DESIGN :
The site plan as submitted conforms to the submission
requirements set forth in the PUD Ordinance with only
one exception and that being the use, which should be
clarified further than just a statement as an
Office/Financial if this is an Office/Lank. It may
very well include uses like an insurance branch, CPA
office, etc. Those kinds of uses may require separate
privilege licenses, or business licenses, and in order
to issue such, the PCD should clarify that they are
permitted.
The last item concerning P=lanning Staff is an
explanation of additional "long range expansion" use
and its proposed size.
E. ANALYSIS:
The Planning Staff's review of this plan reveals few,
if any, comments concerning the design or use of the
project. it, appears to be a good project, well sited
and we -11 designed. Access to the site appears to be
good along Highway 10 and Morgan Cemetery Road.
F. _S TAFF RECOMMENDATION:
'The Staff recornmends approval of the project subject to
the completion of the improvements as recommended by
the Public Works Department.

SUBDIVISION COMMITTEE COMMENTS: (Jul -y 5, 1990)
The applicant was present. This matter was discussed
briefly. Mr. McGetrick indicated that Staff recommendation
presented no serious problem. He agreed to mo0ify cover
letter which includes future uses.
The discussion moved to the requirements for improvements
along Highway 10 and Morgan Cemetery Road. Jerry Gardner, _
of the Public Works Department, indicatedthat he would need
to work with the applicant to determine the status Of the
improvements. The right-of-way has been dedicated and will
fulfill Master Street Plan requirements.

There were two objectors present. Mr. McGetrick was
representing this application.
The Planning Staff presented its recommendation being
approval of the revised site plan with applicant complying
to Highway -10 landscape and buffer ordinance. _.
Chairman then asked Mr. McGetrick to present his
application. Mr. McGetrick agreed with Staff's
recommendation as presented.
The Chairman then asked first objector present to express
his concerns. Mr. Brent. Ty.rrells' next door neighbor
concerns were traffic congestions and drainage.
The Chairman then recognized another objector present, Mr.
Tom Lovette. He is the property owner directly north from
the subject property. His concerns were drainage and
traffic. He also stated, the lack of sewage would require
septic tank installation and the subject. property is too
small for its placement.
A brief discussion then fd-llowed involving several of the
Commissioner's, Objectors, Planning; Staff and Mr. McGetrick,
primarily dealing with drainage and sto:rmzaa.te.r retention on
the site.

The Commission then asked Mr. Gardner. from Public Works to
respond to drainage issues. Mr. Gardner stated that City
stormwater Detention Ordinance will apply to this site when
developed.
Commission McDaniel suggested to defer this item for two
weeks to allow additional time to address drainage problem.
Mr. Tyrrell also requested additional information on grading
and stormwater retention issues.
Brief discussion then followed centered on whether this item
should be deferred or be voted on it at this time.
Applicant states that he cannot change present drainage
situation and he is convinced that his development will not
increase amount: of stormwater. He stated that stormwater
comes from larger area located south of this property.
A motion was made to defer this item for two weeks in order
to allow Mr. McGetrick time to conduct additional study on
stormwater retention and drainage. A motion was passed by a
vote of 9 ayes, ]. ria.ys, 1 absent.

There were several objectors present. Mr. McGetrick, was
representing this application. The Planning Staff presented
its accommodation being approval of the revised site plan
which applicant compliance to Highway 10 landscape and
buffer ordinance.
Pat McGetrick state that he met with neighbors, but the
drainage issue had not been resolved.
Chairman asked Mr. Tyrrell, first objector, to express his
concerns. He state that his concerns were drainage, damage
of residential integrity, traffic and decrease the value of
his house.
Chairman then recognized another objector. present. Mr.:. -Tom
Lovett state that he received letter from Commissioner
Walter Riddick, assuring that all the property passed
Highway 300 are zoned. 11R-211. His concerns were traffic
congestions, spot zoning, and drainage.

The Chairman then asked the next objector present, Mr. Bill
Lessenberry, to present his objection. He stated that he
has been living in this area for eleven years and has a two-
bay—car repair shop. His concerns are drainage and traffic.
A brief discussion then followed involving several of the
Commissioners and Mr. McGetrick. Mr. McGetrick state that
his project complies with Highway 10 requirements. He also
said that Arkansas Transportation and Highway Department is
planning to extend Highway 10 to a four lane highway past
T.J Robinson School next year.
Commissioner then asked Mr. Gardner to explain the water
retention issue. Mr. Gardner stated that heavy foilage
would retain more water than open space, but would not make
much difference.
A brief discussion followed centered on drainage and water
retention problems.
Mr. Lessenberry stated that water comes from southeast and
south under Highway 10 through concrete openings and flow
through his and adjacent property. He also added that the
water volume was increased when the school was built and
parking lot was paved.
Mr. Tyrrell stated the engineering comments do not base on
true review of that side and he would like to see more
research applied.
Commissioner Reddick called question. A motion was made to
approve this application as recommended by Staff. The vote
was 3 ayes, 4 nays, 1 abstention, and 3 absent.
(It was noted for the record that this item will -be deferred
for two weeks as Bylaw Requirements to August 14, 1990
Agenda).

There were several objectors in attendance. Mr. Pat
McGetrick was representing this application. The Planning
Staff presented its recommendation being approval of the
revised site plan with applicant compliance to Hwy 10
Landscape and Buffer ordinance.

Planning Staff stated that they prepared overhead showing
drainage areas and flow channels.
Mr. Gardner from Public Works stated that stormwater comes
from about a 70 acre area located southeast and flows down
under Hwy 10 openings through subject property and Mr.
Tyrrell's property.
A brief discussion then followed involving several of the
Commissioners and Mr. Gardner, centered on drainage and
water channelization after construction.
The Chairman then asked Mr. McGetrick to respond to water
flow. Mr. McGetrick stated that his client plans to direct
water through the channel on Lot 1 and realize it on Lot 2
and 3 to present ditch which is located on the west property
line.
Chairman asked Mr. Tyrrell, objector, to express his
concerns. He stated that his concerns were traffic
congestion, damage of residential integrity, and decrease
the value of his house.
Chairman then recognized another objector present, Mr.
Lessenberry. He was concerned about water availability on
the site.
Pat McGetrick stated that owner has several options. One of
these is to extend city water lines.
A brief discussion followed, centered on water availability
and city main extension.
Chairman then recognized another objector present. Mr. Tom
Lovette stated that his concerns were spot zoning and
traffic congestions.
The Chairman then called question. A motion was made to
approve this application as recommended by Staff. The vote
was 5 ayes, 4 nays, and 2 absent. The application was
denied. (It was noted for the record that his item will be
sent to Board of Directors with denial recommendation from
Planning Commission.)
