NEW STREET: 0 ALLOWED USES: Auto dealership PROPOSED USE: Commercial On August 21, 1990, the Board of Directors passed Ordinance No. 15,920 rezoning this property from C-3 to PCD to allow an auto dealership. The approved PCD allowed small areas of outside vehicular display as well as a small service and auto detail operation within the existing buildings. The auto dealership recently vacated the property and was replaced with an antique mall, an entirely enclosed commercial operation. PROPOSAL: The property owner, Riverside Properties, LLC, submitted a letter to staff on January 4, 2001, requesting that the PCD be officially revoked and the property revert to its original C-3 zoning. C. NEIGHBORHOOD COMMENTS: The Capitol View Stifft Station, Hillcrest and Cedar Hill Terrace Neighborhood Associations were notified of the revocation request. STAFF RECOMMENDATIONS: FILE NO.: Z-5340 Staff recommends that the PCD be revoked; that Ordinance No. 15,920 be repealed and that the property be returned to C-3 General Commercial District as previously existed. PLANNING COMMISSION ACTION: (MARCH 8, 2001) The staff presented a positive recommendation on this application, as there were no further issues for resolution. There were no objectors to this matter. The Chairman placed the item before the Commission for inclusion within the Consent Agenda for approval as recommended by staff. A motion to that effect was made. OF NEW ST.: 0 ZONING: "C-3" PROPOSED USE: • "PCD" PLANNING DISTRICT: Heights - Hillcrest VARIANCES REQUESTED: None STATEMENT OF PROPOSAL: Investment Motorcar Corporation is seeking to rezone property at 2905 Cantrell Road as a planned commercial development. IMC is an Arkansas corporation formed in October, 1989, for the purpose of selling luxury pre -owned automobiles (BMW, Jaguar, Ferrari; etc.). In compliance with the present "C-3" zoning classification, IMC has to limited its business to inside sales only. There is also a small service and detailing operation located in the same structure at the rear of the property. The property is level and almost totally paved in asphalt. The business is presently employing 10 people. A. PROPOSAL RE VEST: This proposal involves an outside display and service of the lux,iry pre -owned automobiles on a property previously used as an automobile air condition sales and installation. 1 July 17, 1990 SUBDIVISION Item No. 5 (Continued) B. EXISTING CONDITIONS: The site is currently occupied by two structures. Both buildings are made of metal and concrete blocks. The parking is paved in asphalt. The adjacent street is developed to city standard. C: ENGINEERING COMMENTS: Provide Cantrell Road right-of-way to principal arterial standards (55' from center line). Construct sidewalk on Cantrell Road frontage. Existing landscaping in the Cantrell right-of-way will require a franchise to remain in place. The existing driveway encroaches onto the adjacent property to the west and should be reconstructed to conform to Ordinance requirements. D. ISSUESILEGAL/TECHNICALfDESIGN: There are a number of detail items on the site plan which require some resolution. These are as follows: 1. The storage area for autos awaiting service or repair should be indicated. 2. Details of landscape treatment along Highway 10 side should be shown. 3. Limit operation hours from 8 a.m. to 8 p.m. 4. Show dimensions and number of parking spaces for proposed display area on the site plan. E. ANALYSIS• The Planning Staff's view of this proposal is that it is attempting to conform the existing auto related business to the City Zoning Ordinance. The Staff feel that landscaping and improvements would enhance this site. 2 July 17, 1990 SUBDIVISION Item No. 5 Continued E. STAFF RECOMMENDATION: Approval subject to: 1. Complying with Engineering requirements. 2. Limiting operation hours from 8 a.m. to 8 p.m. 3. Showing dimensions and number of parking spaces for displayed cars and cars waiting for service. SUBDIVISION COMMITTEE COMMENTS: (July 5, 1990) Mrs. Mona Mizell was present representing this application. The staff recommendation was explained to applicant. There were several design elements discussed. These dealt primarily with including right-of-way and landscaping on the site plan. It was determined that the applicant will submit revised site plan showing existing right-of-way and required right-of-way and apply for franchise with the City to keep existing landscape in place. There being no further items for discussion, the matter was forwarded to the full Commission for resolution. 3 July 17, 1990 SUBDIVISION Item,......._ No. .5 (Continued .... PLANNING COMMISSION ACTION: (July 17, 1990) Ms. Mona Mizell was present representing this application. Mr. Lawson of the planning Staff, offered a brief comment on the staff recommendation and pointed out that he met with Ms. Mizell ;just before meeting, and she agreed to put landscape on the front twenty feet of the property, if Fire Department agrees to release fire easement. Ms. Mizell was asked by Commission to present tier application. She stated p that her client agreed to provide landscape areas where Possible. A brief discussion then followed involving several of the commissioners and Ms. Mizell dealing primarily with landscaping and its placement on the property. The motion was made to approve this application as amended with Applicant willing to accommodate landscaping on the front, if permitted by Faire Department and .limit, operation hours from 7:00 a.m. to 8:00 p.m.. The motion was made and passed by a vote of 9 ayes, p nays-, 1 abstain, and 1 absent. The motion passed. 1
