AN ORDINANCE VACATING AND CLOSING A PORTION OF AN
ALLEY IN BLOCK 5, PLATEAU ADDITION TO THE CITY OF
LITTLE ROCK AND VACATING AND CLOSING WEST FOURTH
STREET BETWEEN SOUTH ELM AND SOUTH CEDAR STREETS
IN PLATEAU ADDITION TO THE CITY OF LITTLE ROCK,
ARKANSAS; AND FOR OTHER PURPOSES.
WHEREAS, a petition was dull► filed with the on Boarthe of day of

Officio Recorder of Pulaski County, Arkansas, subject, however, to
any public utility easements in the said street; and
WHEREAS, after due notices as required by law, the Board of
Directors has, at the time and place mentioned in the Notice,
heard all persons desiring to be heard on the question and has
ascertained that the portions of street and alley, hereinbefore
described, have heretofore been dedicated to the public use as a
street and alley, as herein described; that the petitioners are
the owners of the property abutting upon the street and alley to
be vacated; and that public interests and welfare will not be
adversely affected by the abandonment of portions of said street
and alley; and
WHEREAS, the University of Arkansas for Medical Sciences
(DAMS) has obtained a recommendation of approval for the street
and alley closure from the Little Rock Planning Commission based
on its review of the UAMS site plan and landscaping plan, as
evidenced in Exhibits A and B, which are attached hereto and
made a part hereof; and
WHEREAS, in determining the desirability and necessity of
closure, GAMS and the City of Little Rock have entered into mutual
understandings and assurances as evidenced in Exhibit C which is
attached hereto and made a part hereof.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF
THE CITY OF LITTLE ROCK, ARKANSAS:

SECTION 1. Based on the mutual understandings and
assurances between uAMS and the City, the site plan and
landscaping plan, all heretofore attached and made a part hereof,
the Board of Directors hereby determines the desirability and
necessity of closing a portion of West Fourth Street and a portion
of said alley as hereinafter described for the purpose of
constructing an addition to the LAMS medical complex.
SECTION 2. Except as stated in Section 2 below, the City
of Little Rock, Arkansas, hereby releases, vacates and abandons
all of its rights, together with the rights of the public
generally, in and to the street and alley designated as follows:
Beginning at the Northwest corner of Lot 9, Plateau
Addition to the City of Little Rock, thence South
approximately 250 feet to the Southwest corner of Lot
13, Block 5, Plateau Addition to the City of Little
Rock, thence West 16 feet to the Southeast corner of
Lot 14, Block 5, Plateau Addition to the City of
Little Rock, thence North approximately 250 feet to
the Northeast corner of Lot 18, Block 5, Plateau
Addition to the City of Little Rock, thence East 16
feet to the point of beginning.
and
All that portion of West Fourth Street lying between
South Elm Street and South Cedar Street also
described as follows: Beginning at the Southeast
corner of Lot 13, Block 5, Plateau Addition to The
City of Little Rock, thence South 50 feet to the
Northeast corner of Lot 1, Block 12, Plateau Addition
to the City of Little Rock, thence West approximately
272.5 feet to the Northwest corner of Lot 12, Block
12, Plateau Addition to the City of Little Rock,
thence North 50 feet to the Southwest corner of Lot
14, Block 5, Plateau Addition to the City of Little
Rock, thence East approximately 272.5 feet to the
Southeast corner of Lot 13, -Block 5, Plateau Addition
to the City of Little Rock, being the point of
beginning.
Subject, however, to any public utility easements located

in said street.
SECTION 3. The City specifically retains the right to use,
and allow others to use, the former street right-of-way in its
entirety as a public utility and drainage easement.
SECTION 4. Abutting owners of record, receiving title to
the abandoned right-of-way and easement of the street shall at
their cost remove all vestiges of public use and access as may
exist; such modifications shall include, but are not limited, to
the following:
A. The entrances on both ends of the abandoned
right-of-way and easement shall be off -set and/or
rebuilt to conform to the standard driveway designed
as required by Ordinance No. 12501.
B. The edge of pavement of the right-of-way shall be
rebuilt to conform to existing conditions in the
general vicinity where the abandoned right-of-way and
easement intersects with the remaining public
right-of-way.
SECTION 5. A copy of this ordinance, duly certified by the
City Clerk, shall be filed in the Office of the Pulaski County
Circuit Clerk and Ex Of_iicio Recorder and recorded in the Deed
Records of the County.
SECTION 6. This ordinance shall take effect and be in
force from and after its passage.

6. It is understood that due to budgetary constraints in
the biddin: process, there may be minor architectural
changes to the biomedical building, but no substantial
changes will be made to the landscaping and buffering
plan without first reviewing such changes with the
Planning Director of the City of Little Roc?:.
The UAMS understands that the City feels that the impact of
the street and alley closures and expansion of the Medical
Center in proximity of the adjoining neighborhoods will be
minimized by the above.

8 WHEREAS, a petition was duly filed with the Board of

10 March, 1990, asking the Board of Directors to vacate and abandon a
11 portion of an alley in Block 5, Plateau Addition to the City of
Little Rock, Arkansas, and to vacate and abandon West Fourth
12 Street lying between South Elm Street and South Cedar Street,
13 plateau Addition to the City of Little Rock, Arkansas, as
14 designated on the plat of said Addition now appearing of record in

I would like to address the issue of the U.A.M.S. street and
alley closures which are presently before the Planning Commission.
At your last meeting I spoke to you voicing the concerns of the
Woodruff School CDBG Committee regarding the proposed new research
facility.
Since your last meeting, I have attended a meeting with the
Little Rock Planning staff and U.A.M.S. representatives at which
time the neighborhood Concerns were again addressed and assurances
given to meet our concerns. i also appeared at the University of
Arkansas Board of Trustees meeting in Little Rock last Priday and
expressed our concerns to them. we received a strong commitment
from them to the landscaping and green strip concept buffering the
neighborhood from the new research building. The Board also
directed Chancellor Ward to try and work with the neighborhood
closely in future development, though we did not obtain a seat on
their Facilities Planning commission as we had requested.
The Woodruff School CD"BG Neighborhood Committee met Monday,
May 7, 1990, and at that meeting discussed and considered the site
plans of the proposed research facility with u.A.H.S.
Representative Mike Dwyer and George Wittenberg, Architect for the
project. We were informed that the architect and the landscape
engineer would be working with as in the future regarding the
particulars of the landscape plans and that we would have further
input as the project develops.
There was also considerable discussion concerning the alley
closure. The consensus was that the Committee felt a turnout onto
Cedar Street would be dangerous both for traffic on Cedar street
and for people turning out of the alley. Also such a cut in the
Cedar Street side would be contrary to our plan of insulating the
neighborhood from the effects of the U.A.M.S. property. We felt
that a turnaround would be far and away the better concept and we
endorsed a plan envisioning such a turnaround.
After a discussion of the issues, the Committee voted

and information we have submitted which you requested as
