HomeMy WebLinkAboutZ-5331 Staff AnalysisJune 5, 1990 SUBDIVISIONS Item No. 7 NAME: Bethel Missionary Baptist Church Conditional Use Permit (Z-5331) LOCATION: The northwest corner of 32nd and Marshall Streets (3122 Marshall Street) OWNER/APPLICANT: Harold and Wanda Osmon/Janice R. Kelly PROPOSAL• To convert an existing 1920 square foot structure to a church (capacity - 80) and to construct 21 parking spaces on 0.32 plus or minus acres of land that is zoned "R-311. ORDINANCE DESIGN STANDARDS: 1. Site Location Adjacent to two residential streets (32nd and Marshall Streets) 2. Compatibility with Neighborhood The site is abutted by single family uses in all directions (north and south a side yard relationship, east a front yard relationship, and west a rear yard relationship). The proposed church is of a neighborhood scale and sits on a corner lot. The use should be compatible with the surrounding area. 3. On -Site Drives and Parkin The plan provides a 20 foot (width) one way ingress onto the site from Marshall as well as a 20 foot (width) egress onto 32nd Street. The plan also contains 21 parking spaces. 1 June 5, 1990 SUBDIVISIONS Item No. 7 Continued 4. Screening and Buffers The applicant is proposing to use the existing trees and shrubs as landscaping. 5. City Engineer Comments The sidewalk will need to be extended northward across the balance of the lot (along Marshall Street). 6. Analysis The Staff feels that the proposed church use will be compatible with the surrounding area (see note No. 2). The limited intensity (capacity - 80) as well as the corner lot setting should serve to reduce the impact of the use. The site slopes from the northeast to the southwest and contains heavy foliage along the west property line. A screen fence should be constructed along the north property line to mitigate the impact of the parking lot on the adjacent single family use (side yard relationship). Finally, the applicant needs to be advised that all drives and parking will need to be paved and that they will be required to meet City Landscape Ordinance requirements. 7. Staff Recommendation Approval provided the applicant agrees to: (1) pave the drive and parking area; (2) construct a screen fence along the north property line; (3) comply with City landscape requirements; and (4) construct a sidewalk along Marshall Street for the balance of the lot (sidewalk exists from 32nd Street north to the north edge of the building). SUBDIVISION COMMITTEE REVIEW: The applicant was present and agreed to comply with Staff recommendations. There were no unresolved issues. E June 5, 1990 SUBDIVISION Item No. 7 Continued PLANNING COMMISSION ACTION: The applicant was present. There was one objector. The Staff recommended approval as per the Staff recommendation. Mrs. L. Toombs of 3123 Marshall Street stated that she lived across the street from the site and was concerned because the structure had been used as a church before and it had created both parking and noise problems. Mrs. Toombs further stated that parked cars had blocked her drive and that an outside speaker system had created noise problems. Mrs. Janice Kelly, the applicant, stated that their church had only a piano and would not have an outside speaker or PA system. She also stated that the church generally held meetings on Wednesdays and Sundays with the Wednesday meetings lasting from about 7 p.m. to 9:30 p.m. Ms. Kelly further stated that they would construct a paved parking lot at the time of the renovation of the building and they would add air conditioning. A general discussion ensued. The City Attorney stated that a Conditional Use Permit could be revoked if the conditions of the Conditional Use Permit were not met or broken. The Commission then voted 8 ayes, 1 no, 1 abstention (Nicholson) and 1 absent to approve the application as recommended by the Staff (as per section number 7 in the write up) provided that no exterior speaker, or sound system be allowed and that the church members not park on the street during church services. 3
