None STATEMENT OF PROPOSAL: Mr. Charles Menard, property owner, is seeking to rezone property that he owns at Mabelvale Pike Road. The property consists of 3 adjacent lots and three structures. One of the structures was built as a service station and is currently used as a repair garage.' The second -and third structures are used for commercial, motor vehicle repair and equipment rental. The purpose of the request is to permit the use of the property as an auto repair including transmission repair shop, auto glass and muffler shop in addition to all uses permitted under 11C-3" zoning. In addition to the above request, the owner wishes to be allowed an outside display of tools and rental equipment. 1 June 5, 1990 SUBDIVISION ITEM NO.: 4 (Continued) A. PROPOSAL RE VEST: This proposal involves an auto repair and outside display of rental equipment on the three lot neighborhood shopping center in structures previously used as a commercial shopping center zoned "C-311. B. EXISTING CONDITIONS: The site is currently occupied by three one story structures. The parking is paved in asphalt with 8 curb cuts along Mabelvale Pike and one on West 51st Street. The surrounding properties on the south and northeast consist of existing businesses. These businesses have been in place for a number of years. C. ENGINEERING COMMENTS: Right-of-way dedication to accommodate a currently planned bond issue widening project will be required. The widening may require closing of some of the driveways. Specific right-of-way and driveway recommendations will be provided after meeting with the applicant. D. ISSUES LEGAL TECHNICAL DESIGN: There are no issues of concern associated with this "PCD". The only design concern relates to the provision of additional right-of-way, closing curb cuts and of meeting landscape requirements. E. ANALYSIS• The Planning Staff, in reviewing this plat, realizes that the owner is keeping existing uses which have been in place for a number of years However, there are issues involved that should be dealt with by the Planning and Engineering Staff. This is based upon accommodating a recent bond project involving the widening of Mabelvale Pike which would require additional right-of-way dedication and closing some of the driveways. 2 June 5, 1990 SUBDIVISION ITEM NO.: 4 Continued F. STAFF RECOMMENDATION: The Staff recommends approval of the 11PCD11 subject to dedication of additional right-of-way, closing curb cuts and meeting City requirements for landscaping. SUBDIVISION COMMITTEE COMMENTS: (May 24, 1990) Mr. Joe White and Bill Rector were present representing this application. Mr. Rector described this "PCD" and various elements of the proposal. He indicated that this is an existing business that was taken into the City Limits. He also stated that the Staff recommendation presented no serious problems, however, he questioned the Engineering comments and specific recommendation concerning right-of-way dedication. In a brief discussion, Jerry Gardner indicated that he would need to work with the Engineer on this project and the Public Works Director to determine the status of the improvements on Mabelvale Pike. PLANNING COMMISSION ACTION: (jUNE 5, 1990) The applicant was present. The Planning Commission briefly discussed this PCD. Mr. Jerry Gardner of the City Engineer's Staff was asked by the Chairman to provide a statement on right-of-way modification for Mabelvale Pike. Mr. Gardner stated that the existing design project will fit in right-of-way. The only additional right-of-way, requested by City Engineering, will be located on the curve. After a brief discussion, the Commission determined it appropriate to place this item on the consent agenda for approval.
