Church Conditional Use Permit (Z-5326) LOCATION: Northeast corner of Russ and Dunbar Streets OWNER/APPLICANT: A.M.E. Church/James A. Williams PROPOSAL: To construct a one story 960 square foot church (capacity - 30) and eight paved parking spaces on 0.15 plus or minus acres of land that is zoned 11R-211. ORDINANCE DESIGN STANDARDS: 1. Site Location Adjacent to two residential streets (Russ & Dunbar) 2. Compatibility with Neighborhood The site is abutted by single family uses to the north (side yard relationship) and south (front yard relationship) and vacant land to the east and west. A low intensity church use should be compatible with the surrounding area. 3. On -Site Drives and Parking The plan contains two access drives onto Dunbar Street and eight paved parking spaces. 4. screening and Buffers The plan shows landscaping on Russ and Dunbar Streets and a privacy fence on the north property line. 1 June 5, 1990 SUBDVISIONS Item No, 6 Continued 5. City Engineer Comments (1) Improvement to both Russ and Dunbar Streets will be required unless waived; (2) Improvements would include curb and gutter, one half street paving and sidewalks; and (3) redesign the curb cuts to reduce the width of the western most opening and to reduce the eastern most opening in order to save the 36" Oak tree. 6. Analysis The Staff feels that the proposed use will be compatible with the surrounding area. The Staff also strongly encourages the redesign of the eastern most curb cut in order to save the 36" Oak tree. Finally, the Staff supports the street improvement waiver due to the fact that both streets dead end near the site and because the value of the proposed construction cannot support the cost of the off-site improvements. 7. Staff Recommendation Approval provided: (1) The applicant agrees to submit a revised site plan that contains redesigned curb cuts as previously outlined; and (2) subject to Planning Commission approval of a waiver of the off-site street improvements. SUBDIVISION COMMITTEE REVIEW: The applicant was present. The Staff explained its recommendation regarding the redesign of the curb cut and the waiver of the street improvements. A general discussion ensued. The applicant agreed to submit a revised site plan to the Staff. The City Engineer stated that the reduced curb returns could be constructed of raised asphalt rather than concrete curbs. 2 June 5, 1990 SUBDIVISION Item No. 5 Continued PLANNING COMMISSION ACTION: The applicant was present. There were no objectors. The City Engineer reiterated their support of the street improvement waivers due to the fact that both streets did end near the site and also due to the fact that the proposed construction value would not likely support the cost of the off site improvements. The City Engineer also stated that Russ Street is scheduled to be a CDBG construction project in 1991-1992 and would include curb, gutter, street and drainage to a point just north of this site. The Commission then voted 10 ayes, 1 absent to approve the application as recommended by the Staff, reviewed by the Subdivision Committee and agreed to by the applicant.
