Spencer Applicant: Mike Pierce Location: Baseline Road and Geyer Springs Road Request: Rezone from "R-2" to "C-3" Purpose: Commercial Size:, 0.326 acres Existing Use: Auto service (nonconforming) SURROUNDING LAND USE AND ZONING: North - Commercial, zoned "R-2" South - Vacant building, zoned "R-2" East - Vacant building, zoned "R-2" West - Commercial, zoned "C-4" STAFF ANALYSIS• This rezoning issue, File No. Z-5320, is the last of the three requests located at the Geyer Springs Road and Baseline Road intersection. The property, approximately one third of an acre, is situated on the southeast corner and the request is to rezone to "C-311. Currently the site is occupied by an auto service business but the proposal is to redevelop the land for an eating establishment and that is why "C-3" is being requested. Zoning found in the general area is "R-211, 110-3110, "C-3" and "C-411. Land use is made up of single family, multifamily, office, commercial and a mobile home park with the commercial concentrated at the intersection extending north along Geyer Springs Road. Because of the area being annexed to the City there are still a number of nonconforming uses, especially to the south and east. The proposed reclassification conforms to the Geyer Springs East Plan and the existing zoning pattern in the area. 1 May 8, 1990 ITEM NO. 6 - Z-5320 (Continued) Staff feels that 11C-3" is a reasonable rezoning for the site and supports the request. One final issue that needs to be mentioned is access to the site. It is the staff's understanding that there is an agreement with the owners of the larger tract to provide access by way of an easement to this tract. This is being done to avoid having curb cuts on the two major streets, which should help the traffic situation. If an instrument for the access easement has been signed by both parties, staff would like to receive a copy of it and make it part of the file. ENGINEERING COMMENTS: Applicant should dedicate an additional 5 feet of right-of- way on both the Baseline and Geyer Springs frontages. This application may be appropriate for a PUD to handle siting on a very small tract. No curb cuts on either Baseline or Geyer Springs should be permitted, and the access easement on the adjacent tract should be a permanent, recorded document or plot. STAFF RECOMMENDATION: Staff recommends approval of the 11C-3" rezoning as filed. PLANNING COMMISSION ACTION: (May 8, 1990) The applicant, Mike Pierce, was present. There were no objectors. Mr. Pierce discussed the site and said the access issue had be resolved by agreeing to close driveways on Baseline and Geyer Springs. He also said that there would be an access easement through the Danny Thomas property located adjacent to the site in question. Mr. Pierce concluded by saying that $15,000 to $20,000 would be spent on landscaping for the new development. Bob Brown, Environmental Codes Staff, discussed a franchise agreement that would be necessary for the right-of-way area that would be used for landscaping. There were some questions asked about utilizing the "PUD" process and Mr. Pierce objected to filing a "PCD". Mr. Pierce also said that the new development was just trying to clean up the corner. E May 8, 1990 SUBDIVISION ITEM NO.: 5 - Z-5320 Continued Jerry Gardner, City Engineering, said that the existing right-of-way was acquired by the Arkansas Highway and Transportation Department and was 40 feet from the center line of both streets. Mr. Gardner told the Commission that the Master Street Plan standard for Baseline Road was 110 feet and 90 feet for Geyer Springs Road. He went on to say that the roads were developed for existing traffic and Engineering was recommending a reduction in the right-of-way requirement, a variance from the Master Street Plan standards. A motion was made to recommend approval of dedication of addition right-of-way. The approved by a vote of 11 ayes, 0 nays and 3 "C-3" with the motion was 0 absent.
