Taylor Street Description: Lot 7, Block 4, Mountain Park Addition zoned: C-3 Variance Requested: From the area regulations of Section 36-301(e) to permit construction of a new building with a reduced street -side yard setback and from the off-street parking requirements of Section 36-502(b) to permit a reduction in the number of required parking spaces. Justification: The typical small size (50 foot by 140 foot) of lots in this area make it difficult to provide a 25 foot side yard setback on this corner lot. 69% of the applicant's business is by phone, thereby reducing the need for the full requirement of on-site parking. Present Use of Proper : Florist Proposed Use of Property: Florist; the existing building is to be removed and a new structure constructed in its place. Staff Retort. A. Staff Analysis: The applicant proposes to remove the existing structure on this lot and construct a new, two-story, 2,856 square foot building in its place. Due to the limitation of working with a 50 foot wide corner lot, the applicant is requesting a variance to allow a reduced street side yard setback of 15 feet as well as a variance to allow a reduction in the August 29, 1994 Item No.• 2 Cont. number of on-site parking spaces to four. A 25 foot setback and 10 on-site parking spaces are required by the Ordinance. The existing building, which was originally designed as a single-family residence, is currently occupied by the applicant. The building has a 3.5 street side yard setback and zero on-site parking spaces. This proposal would seem to fit in with the nature of the Heights Commercial District which involves shared parking and extensive use of on -street parking, much of which is available on the block of "R" Street between Taylor and Polk Streets. The applicant states that 69 percent of his business is conducted by telephone, reducing the need for on-site parking. Staff feels that the proposal is reasonable and is supportive of both variance requests. Staff would urge the applicant to be sensitive to the unique nature of the Heights neighborhood and to consider a building design favoring the character of the Heights commercial area. C. Staff Recommendation.: Staff recommends approval of the requested setback and parking variances. BOARD OF ADJUSTMLNT: (AUGUST 29, 1994) Mark Nichols was present representing the applicant. There were no objectors present. Staff presented the item and a recommendation of approval. Mr. Nichols addressed the Board and further explained the proposal. He stated that the proposed setback and parking would exceed that which currently exists on the site. After a brief discussion, a motion was made to approve both the setback and parking variances. The motion was approved with a vote of 6 ayes, 0 noes, 1 absent and 2 open positions. E
