STAFF ANALYSIS•
Case No. Z-5318 is the second of the three rezoning issues
on this agenda located at the intersection of Baseline Road
and Geyer Springs Road. With this request, the proposal is
to rezone approximately 3 acres from "R-2" to "C-4" to allow
a commercial use with open display. The site is developed
with a large building and paved parking areas but the
structure is unoccupied at this time. Previous users of the
site have included a discount store and a home center.
Zoning in the general vicinity is made up of "R-211, 110-311,
"C-3" and "C-4" with the property abutting "R-2" on two
sides. Land use is similar to the zoning and includes
single family, multifamily, office, commercial and a mobile
home park. To the southeast of the intersection, the land
is zoned "R-2" so a majority of the uses, a mobile home park
and a large multifamily complex, are nonconforming.
A commercial reclassification of the property is
appropriate, however, staff is somewhat concerned with a

"C-4" rezoning for 3 acres at the Geyer Springs and Baseline
intersection. 11C-4" does permit certain uses that could
have an impact on the area, and being a large tract could
intensify a potentially undesirable situation. Staff is of
the opinion that 11C-3" is a better option for the property
and suggests that the request be amended to 11C-311. The 11C-
3" district does allow many uses found in 11C-4" either by
right or a conditional use. A home center and a lumber yard
have been mentioned as possible uses and they are both
listed as conditional uses. There are some use groups
allowed in "C-4" that are not permitted in 11C-3" and they
are primarily the sale of wheeled vehicles, such as autos,
trucks and mobile homes. And finally, 11C-3" does permit
some outside display in the development criteria section.
All commercial uses shall be restricted to closed
buildings except parking lots, plant nurseries,
promotional events and the normal pump island services
of service station operations. In addition, outdoor
display of merchandise is allowed in any area equal to
one half of the facade area of the front of the
building. Certain seasonal or special event sales may
be allowed when the owner has requested a permit for
such activity in conjunction with the privilege license
application. The permitting authority shall review the
owner's plan or placement of merchandise in order to
assure that obstruction of drives, walks, required
parking and fire lanes does not occur. In no case
shall full time static open display be permitted.
ENGINEERING COMMENTS:
Applicant should dedicate an additional 5 feet of right-of-
way on both the Baseline and Geyer Springs frontages.
STAFF RECOMMENDATION:
Staff recommends "C-3" for the site and not 11C-4" as
requested.
PLANNING COMMISSION ACTION: (May 8, 1990)
The applicant was represented by Maury Mitchell. There were
no objectors. Mr. Mitchell amended the request to 11C-3" and
agreed to dedicating the additional right-of-way for Geyer
Springs Road and Baseline Road.

Commissioner Walker made some comments and said he would
like to see some more landscaping around the site. Mr.
Mitchell indicated that he could not commit to anything for
the owner, Danny Thomas.
A motion was made to recommend approval of the "C-3"
rezoning as amended with the necessary right-of-way
dedication. The motion was approved by a vote of 8 ayes, 1
nay, 0 absent and 2 abstentions (Kathleen Oleson and Rose
Collins).
