STAFF ANALYSIS•
On this agenda, there are three rezonings that involve
properties located at the intersection of Baseline Road and
Geyer Springs Road. All three sites are still zoned "R-211
because the area was annexed to the City a number of years
ago and the three parcels were never rezoned. The request
for 5924 Baseline Road is to reclassify the property to 11C-
311 for existing convenience store.
The Geyer Springs Road and Baseline Road intersection is
zoned either IIC-311 or IIC-411 with the exception of the site
under consideration and the southeast corner. At the
northeast corner, the convenience store is zoned IIR-211 and
the adjacent land is zoned "C-311 for a shopping center. The
existing zoning in the general area is IIR-211, 110-3111, OIC -311
and IIC-411 with the commercial zoning extending for some
distap.ce from the intersection along both streets. In the
immediate vicinity, the uses are primarily a mixture of
various commercial establishments. Away from the
intersection, the land use becomes more diverse with single
family, multifamily, office, and a mobile home park.
Further to the south, on Geyer Springs Road, there is a
large church and McClellan High School.

The Geyer Springs East District Plan identifies the
northeast and southeast corners of the intersection for
commercial use/development. Therefore, the proposed "C-3"
conforms to the adopted plan. There are no outstanding land
use issues and staff supports the commercial
reclassification.
ENGINEERING COMMENTS:
Applicant should dedicate an additional 5 feet of right-of-
way on both Baseline and Geyer Springs frontages, close the
driveways closest to the corner on each frontage, and
provide a 5 foot landscape strip on each frontage.
STAFF RECOMMENDATION:
Staff recommends approval of the "C-3" rezoning as
requested.
PLANNING COMMISSION ACTION: (May 8, 1990)
The applicant, Sonny Pearson, was present. There were no
objectors. Prior to Mr. Pearson presenting his case,
Commissioner Brad Walker spoke and made some comments about
adding conditions to rezoning requests and his desire for
consistency in development.
Mr. Pearson then spoke and said there were no plans to make
any changes to the existing development. He went on to say
that it would be difficult to operate the business if
several of the driveweays were closed and a five foot right-
of-way dedication was required. Mr. Pearson then told the
Commission that he needed to talk to the company's Borad of
Directors before he could agree to the right-of-way
dedication or closing the driveways. He concluded by saying
that closing the driveways would probably cut the business
by one half.
After some additional comments, a motion was made to defer
the item to the May 22, 1990 meeting. A motion was approved
by a vote of 11 ayes, 0 nays and 0 absent.

Staff reported that the owner requested another deferral to
the June 5, 1990 meeting. A motion was made to defer the
rezoning item to June 5, 1990. The motion was approved by a
vote of 8 ayes, 0 nays and 3 absent.

for a deferral to the June 19, 1990 meeting. A motion was
made to defer the item to the June 19, 1990 hearing and to
