The last item for discussion was a request of the applicant
to waive the additional five foot right-of-way on Pine
Street. The applicant was instructed to make a formal
request to waive right-of-way dedication.
There being no further items for discussion, this item was
forwarded to the full Commission for resolution.
PLANNING COMMISSION ACTION: (March 13, 1990)
The applicant was present. Staff offered a recommendation
of approval subject to reducing the outside car display to
four, limiting the operating hours from 7 a.m. to 7 p.m.,
an edicating an additional 5 feet of right-of-way on Pine
Street.
The Chairman then asked Mr. Stuart Yancy to present his
application. Mr. Yancy offered a lengthy presentation
wherein he addressed the staff's recommendation. He
described the property as "junk" property which he is trying
to restore.
Jerry Garner of the Engineering Department explained to the
Commission that the additional 5 feet of right-of-way can be
waived by the Board of Directors with a Planning Commission
recommendation. He also added that Pine Street functions as
a one-way collector with two lanes going north and there is
no need for the additional 5 foot right-of-way at this
point.
Mr. Yancy stated that he needs more spaces for outside
display. He further responded to the stafi.,comments by
indicating that all cars being repaired will be kept inside
the building.
Jim Lawson pointed out that the staff's concern was also
intensity of the land use. His concern was that allowing
the applicant more parking for outside display could cause
some traffic problems.
Commission Nicholson then inserted a comment that the site
is small and needs to have a limitation.
There was some discussion by the Planning Commission about
the proposed parking design. Comments were offered by
various individuals.

The discussion then moved to reduction of curb cuts and
landscape requirements. It was determ' ' y

The Chairman then recognized persons present who desired to
offer comments. Mr. Fredrick Lee, who lives on Pine Street
next to this site (his mother lives on 12th Street), offered
additional comments concerning traffic problems on Pine
Street at rush hours. He also pointed out that the
retaining wall needs to be repaired.
A lengthy discussion of the matter and the several options
that have been offered to Mr. Yancy then followed. The
Planning staff was instructed to work with the applicant to
design an appropirate site plan.
A motion was made to defer this matter to the next Planning
Commission meeting in order to permit additional time to
work on the site plan. The motion to defer was withdrawn by
Commissioner Riddick who had an additional option for the
parking arrangement.
A second motion was made to approve the site plan with the
elimination of Spaces 1 and 2 on West 12th Street and Spaces
7, 8 and 9 on Pine Street; limes outside di la 'bn e

right-of-way. The motion passed by a vote of 9 ayes, 1 nay,

STATEMENT OF PROPOSAL:
Mr. Stuart Yancy, property owner, is seeking to rezone
property he owns at Pine and West 12th Streets. The
property consists of two adjacent lots and two structures.
One of the structures was built as a service station and was
most recently used as a detail shop. The second structure
was built as a four -bay car wash. The square footage of
both buildings is approximately 2500 square feet. The
property is level and almost totally paved in concrete and
asphalt.
The purpose of the request is to permit the use of the
property as a sales and repair business which will include
both mechanical and paint and body work. All repair work
will be done inside or in the northeast quarter of the
property. Also, storage will not be visible from the
streets.
In addition, the property user proposes sale and outside
display of used cars. No more than ten vehicles will be
displayed for sale at any given time. He also expects to
have one to three employees.

A. PROP OSAL/RiJQUEST:
This proposal involves an auto repair and sales firm on
a two -lot property in structures previously used as a
gas station and car wash.
B. EXISTING CONDITIONS:
The site is currently occupied by two structures. Both
buildings are in a state of extreme disrepair. The
parking is paved in asphalt and concrete. The adjacent
streets are developed to City standard.
C. ENGINEERING COMMENTS:
Five feet of additional right-of-way is needed for the
Pine Street frontage. Repair any damaged curbs and
sidewalks. Provide handicap ramps at the corner of
12th and Pine Streets. The parking and driveway plan
does not meet City requirements, The developer should
meet with Traffic Engineering to plan the redesign.
D. ISSUES/LEGAL/TECHNICAL/DESIGN:
There are a number of detail items on the site plan
which require some resolution. These are as follows:
1. The storage area for autos awaiting service or
repair should be indicated.
2. Details of landscaping and screening treatment in
the buffer along the east side should be shown.
3. A lighting scheme for the building and parking
areas should be provided.
4. Signage should be designed to the Sign Code
standards.
5. Reduce curb cuts to one on West 12th Street and
one on Pine Street.
6. Reduce number of car display spaces to four and
assign exact location for them.
7. Eliminate old gas pump islands.
8. Eliminate big sign on the southeast corner.

E. ANALYSIS:
The Planning staff view of this proposal is that it is
an attempt to renovate the existing auto related
business. The site lies in an older area that contains
a commercial and residential mix. The staff feels,
however, that with proper screening, the proposed
renovation could be compatible with the surrounding
area.
There are several additional items concerning the site
plan we feel require additional work on the part of the
architect and the developer. This includes the
screening, signage, lighting, landscaping and curb cut
reduction. The plan also requires complete
dimensioning.
F. STAFF RECOMMENDATION:
Approval subject to: (1) Comply with Traffic
Engineering requirements; (2) meet City landscape
requirements; and (3) comply with staff recommendation
in Items D and E above.
SUBDIVISION COMMITTEE COMMENT: (March 1, 1990)
Mr. Stuart Yancy, property owner, was present. The staff
pointed out that this was a good design attempt but that it
needs additional work. The items of a design nature were
discussed. Public Works requested that the curb cuts be
reduced to one on Pine Street and one on West 12th, and that
the parking lot be redesigned. The result of the discussion
was that Mr. Yancy would pursue the additional work on
design issues. However, he questioned the possibility of
postponing some of the street improvements because of his
limited budget.
The staff concerns about buffering against the residential
area was discussed briefly. It was pointed out by staff
that a wood fence would be appropriate to screen the
residence next door. Mr. Yancy indicated that the retaining
wall and hedge are already in place.
