There are no engineering issues to report.
B. Staff Analysis:
The request before the Board is for the construction of an
addition to the existing building with reduced setbacks.
The addition will be constructed in keeping with the
cottage -like design of the structure. The front garden
will be preserved.
Zoned C-3, the requirements of the Ordinance state that
"front and rear yard setbacks should be 25 feet". The
new addition will allow for the front yard setback to be
approximately 9 feet. The rear yard setback will vary
from 9 feet to -5 feet.
Also, associated with the applicant's proposal is a request
to eliminate the parking requirement. For a retail use, the
required number of parking spaces for the existing structure

and the new addition is approximately six (6) parking
spaces. The applicant has stated to staff that there
exists no available land in the area to secure in order to
provide parking; nor can lease agreements be obtained.
Some on -street parking does occur on North Grant Street.
On February 26, 1990, the Board approved two identical
variances for this site. The variances were requested due
to a fire that destroyed the original building.
Located in the Height's area of the City, the existing
building was constructed some time prior to 1930. The
structure has been continuously commercial since 1955.
Surrounding the site are all commercial uses. It should
be noted that this area of the city is one of the older
established neighborhoods, with very few of the buildings
meeting the setback requirements of the present Zoning
Ordinance.
C. staff Recommendation:
Staff recommends approval of the variance as filed.
BOARD OF ADJUSTMENT ACTION: (MAY 26, 1992)
The applicant was in attendance. There were no objectors
present. The applicant stated there were no problems with the
staff's recommendation. A motion was then made to approve the
two variances as filed. The motion passed by a vote of 8 ayes,
0 noes and 1 open position.
