Auto storage 0.41 acres Existing Use: Auto sales lot and storage SURROUNDING LAND USE AND ZONING: North - Commercial, zoned "C-3" and "C-4" South - Single family, zoned 11R-2" East - Auto sales lot, zoned 11C-3" West - Auto service, zoned 11C-3" STAFF ANALYSIS: The property in question is being used for vehicle storage by a towing company. The "C-3" District does not permit the existing use, outside storage, so the user was issued an enforcement notice and told to file for 11C-4" or discontinue the use. The site is a paved lot that is fenced and storage is the only activity taking place on the lot; there are no structures on the property. The site is situated on the south side of Asher Avenue just east of Manor Road and approximately 1000 feet east of John Barrow Road. Zoning for properties fronting Asher Avenue in the immediate area is "R-2119 "R-3119 "C-3" and 11C-411. The residential neighborhoods to the north and south are zoned "R-2" or 11R-311. Uses along Asher are primarily commercially oriented and include retail, auto service, a car wash, auto sales lot and a printing operation. Other uses of the Asher frontage are single family, mobile home park, a church and an Optimist Club facility. Also, several of the lots are undeveloped and there are some vacant buildings. 1 January 2, 1990 Item.No... 4 - Z-5271-AContinuedj Along this segment of Asher, the land use pattern is very mixed with a combination of 11C-3" and 11C-4" commercial uses. Directly to the east there is a used car lot, and there are other uses which have outside display and/or storage. Because of the existing development and a 11C-4" tract across Asher Avenue, staff feels the proposed classification is compatible with the area and supports the request. The 11C-4" rezoning conforms to the Boyle Park Land Use Plan which identifies the site for "service commercial" uses. Also, in October of 1986, the City approved a conditional use permit for this lot and the property to the west for an auto repair garage and car sales lot, so the current use is similar to what was approved through the 1986 action. In the 11C-4" District, there are certain development criteria the applicant will need to comply with if the property is rezoned. Some of the requirements or prohibitions are: - There shall be no open display of any kind whatsoever in the first 20 feet of the required front yard setback. - All servicing of vehicles shall be conducted within a completely enclosed building. ENGINEERING COMMENTS: Asher Avenue is a principal arterial which has a right-of- way standard of 110 feet, or 55 feet from the center line. If the existing right-of-way is deficient, dedication of additional right-of-way will be required. STAFF RECOMMENDATION: Staff recommends approval of the 11C-4" rezoning request. PLANNING COMMISSION ACTION: (January 2, 1990) The applicant was present. There were no objectors and the item was placed on the consent agenda. A motion was made to recommend approval of the 11C-4" rezoning. ORDINANCE DESIGN STANDARDS: 1._ Site Location Adjacent to an arterial street (north, Asher Avenue). 2. Compatibilit with Neighborhood This property is abutted by commercial uses on the north, west and east. A single family use is located to the south ( the houses as well as both commercial uses are owned by the same person) . The proposal contains nothing that does not already exist. The staff does not foresee any adverse impact to the surrounding area. '*, 3. On -Site Drives and Parking The entire area in front of the auto repair garage is paved. The pavement extends into Asiner Avenue. The used car lot is also paved and has a paved access on to Asher Avenue. August 12, 1986 SUBDIVISIONS Item No. I - Continued 4. Screeninq and Buffers No landscape plan has been submitted. 5. Analysis The proposal will not change anything that does not already exist. The property is surrounded on three sides by commercial uses. The staff does not foresee any adverse impact to the surrounding area as a result of this proposal. The applicant will, however, be required to meet City landscape requirements. 6. City Engineering Comments The applicant will be required to dedicate the necessary right-of-way to a total of 50' on their side of Asher Avenue. 7. Staff Recommendation Approval, provided the applicant agrees to: (1) meet City landscape requirements; and (2) dedicate the necessary right-of-way on Asher Avenue. SUBDIVISION COMMITTEE REVIEW: The applicant was present and agreed to make an effort to comply with staff recommendations. The applicant stated that he would meet with the Environmental Codes staff about potential landscape requirememts and that he would ask the owner of the property to dedicate the necessary right-of-way on Asher Avenue. August 12, 1986 SUBDIVISIONS Item No. I - Continued PLANNING COMMISSION ACTION: (7-8-86) The applicant was not present. The staff stated that they had not received proof of notice and recommended deferral of this item until the August 12, 1986, Planning Commisison meeting. The Commission voted 7 ayes, 0 noes and 4 absent to defer this item until the August 12, 1986, Planning Commission meeting. SUBDIVISION COMMITTEE REVIEW: The applicant was not present. (7-31-86) The item was not discussed. PLANNING COMMISSION ACTION: (8-12-86) The applicant was present. Staff stated that the applicant had not met proper notification procedures. The applicant stated that the owner would not dedicate the required right-of-way on Asher Avenue. The Commission stated that they could not endorse this project without the required street dedication. The Commission then voted 10 ayes, 0 noes, 1 absent to defer this item until the September 9, 1986, Planning Commission meeting.
