STAFF REPORT:
A. Engineering_Issues
There are none to be reported.
B. Staff Analysis
On December 18, 1989, the Board of Adjustment granted a
parking variance to Andre's in the Pulaski Heights area
of the City for reduced parking spaces. A condition of
the approval was a limit on the seating capacity to be
no more than 20 persons. y
The applicant is back before the Board of Adjustment
with a five year lease agreement for ten additional
parking spaces. It is the applicant's desire to
increase the seating capacity from 20 persons to 50
persons.

The satellite parking is located within 300 feet of the
restaurant on the Pulaski Heights Presbyterian Church
property. At the earlier meeting on December 18, 1989,
it was determined that the applicant would need a total
of 15 parking spaces for the operation of the
restaurant. By providing ten additional parking
spaces, the applicant will be providing a total of 16
parking spaces.
Although the City Attorney's office has reviewed the
lease agreement and found no problems to exist, the
planning staff would like for the Board of Adjustment
to make a determination as to whether an
acknowledgement form should be filed at the County
Court House along with lease agreement.
C. staff Recommendation
Staff recommends approval of the parking variance
conditioned upon at which time the lease expires or is
terminated, a return to the Board of Adjustment will be
required.
BOARD OF ADJUSTMENT. -ACTION: (April 23, 1990)
Joann Maxey represented the applicant, Andre' Simon, who was
also in attendance. There were no objectors present.
Ms. Maxey stated that the applicant had no problems with the
staff's recommendation inclusive of the conditions placed on
the approval.
Staff then stated for the record th4t at the advice of the
City Attorney, no acknowledgement form nor lease agreement
would have to be filed at the County Court House.
A motion was then made to approve the variance request as
recommended by the staff. The motion passed by a vote of 7
ayes, 0 noes, 2 absent.
