PROPOSAL RE UEST: This project consists of constructing a 1,200 square foot convenience store with four gas pumps. It will be located next to an existing liquor store under the same ownership. B. EXISTING CONDITIONS: Currently, the site is covered with scrub brush and small trees. Scott Hamilton, the adjacent street, is a two lane road with ditches on both sides. C. ENGINEERING COMMENTS UTILITY COMMENTS: The minor arterial right-of-way for Scott Hamilton Drive and improvements are required by the Excavation and Detention Ordinance. The detention also includes the liquor store, which was deferred earlier, and is adjacent to this site. D. ISSUES/LEGALLTECHNICAL/DESIGN: Staff will point out, one of the issues concerning this proposal, it is the nonconformity with the adopted land use plan for the area which calls for office use. 1 October 22, 1991 SUBDIVISION ITEM NO.: 5 Continued FILE NO.: Z-5250-5 E. ANALYSIS• The application is a follow-up'from a failed C-3 application review by the Board of Directors approximately three months ago. That application proposed an identical use of the land. Staff feels this is a land use question, and not one of design. This design will probably work and be efficient in support of the activity. However, in this area the activity is inappropriate because of the mixture of residential on the adjacent properties to the west and south. This is a long standing developed residential area which has been encroached upon somewhat from the south and north. Staff feels there is sufficient commercial zoning in the area that would accommodate this use. Such areas are located at the intersection of Scott Hamilton and Baseline Road as well as the area of Interstate 30 and Scott Hamilton. F. STAFF RECOMMENDATIONS: Staff recommends denial of this application. SUBDIVISION COMMITTEE COMMENT: (OCTOBER 3, 1991) The applicant was present along with his architect, Terry Burruss. Mr. Burruss responded to several question asked by the Committee concerning the buffering and street improvements. The applicant agreed to make any changes to satisfy the staff and the Board of Directors' requirements. The option of subdividing the long tract of land was also discussed. This would leave part of the 660 feet long tract zoned R-2 and would become a screening buffer for the convenience store. After a brief discussion, the Committee and staff determined that this was more a land use issue than a design. The matter was forwarded to the full Commission for final resolution. PLANNING COMMISSION ACTION: (OCTOBER 22, 1991) The applicant was present, Mr. Terry Burruss, the architect. There were no objectors present. Mr. Burruss asked the Commission to accept an amendment to his application reducing the lot depth for the PCD to 250 feet with the remainder of the site to be retained as R-2. A lengthy discussion followed, the principal elements being: 1) Conformance with the neighborhood plan. 2) Strip zoning of Scott Hamilton Drive. 3) Deteriorated state of land and uses along the street. 4) History of previous applications on the site. Staff restated its recommendation of denial based on the plan indicating office use on the site and the potential for continued strip development. The Commission discussed its options and a motion was made to approve the PCD as amended.
