White Baseline Road Rezone from "R-2" to "0-3" and " 1 -211 Office and industrial 39.93 acres Existing Use: Vacant and residential SURROUNDING LAND USE AND ZONING: North - Arkansas Electric Cooperative, zoned "1-2" South - Residential and commercial, zoned "R-2" East - Residential and commercial, zoned "R-2" and "R -7A" West - Vacant, residential and commercial, zoned "R-2" STAFF ANALYSIS: The request before the Planning Commission is to rezone 13.55 acres to 110-3" and 26.38 acres to "1-2". The property is situated on Baseline Road between Doyle Springs Road and Community Road with 1300 feet of frontage along Baseline. The proposed rezoning configuration has the "0-3" area adjacent to Baseline Road for a depth of 450 feet and the "1-2" extends back another 1,019 feet to the existing Arkansas Electric Cooperative property which is zoned "1-2". Currently, a high percentage of the property is vacant and wooded. In the southwest corner, there are several mobile homes and to the east of the mobile homes, there is a single family residence with some accessory buildings. Land use is a mix of single family and commercial uses along Baseline Road. To the north of Baseline, the primary use is single family residences with an industrial use on Doyle Springs Road, and two mobile home parks on Burris and Community Lanes. The existing zoning is either "R-2" or "1-2" with one 11R -7A" tract on Community Lane, the most recent rezoning action in the area. All of the nonresidential uses and mobile home parks are nonconforming. 1 November 14, 1989 I tem__N_o,,.,; 10 - Z-5259_Cont i nugd.- The adopted land use plan for the area, Geyer Springs East, identifies the property under consideration for "mixed density" residential. After carefully reviewing the proposed reclassification, staff feels that the zoning changes are appropriate for the land and supports the request. The 110-3" area along Baseline is compatible with the existing development pattern and creates a land use buffer between Baseline and the proposed 111-2" zoning to the north. It appears that the existing 111-2" has not had an impact on the neighborhood and adding 26 acres of industrial zoning should not create any problems for the area. Staff does suggest that along the east side of the proposed "1-2" area an "OS" buffer be provided. Fifty feet is the minimum for the "OS" District but some consideration should be given to increasing the buffer area to at least 100 feet. (Staff is also recommending a plan amendment, Item No. 12, for the location if the Planning Commission endorses the rezoning concept.) On the Master Parks Plan, some of the acreage (the "1-2" area) is identified as "proposed park land". The Parks Department's position is that another site can be located to provide new park land and recommends that the Parks Plan be amended to delete the park designation for the property in question. ENGINEERING COMMENTS: Baseline Road is classified as a principal arterial which has a right-of-way standard of 110 feet, or 55 feet from the center line. The existing right-of-way is deficient so dedication of additional right-of-way will be required. STAFF RECOMMENDATION: Staff recommends approval of 110-3" and 111-2" with an "OS" buffer along the east side of the proposed "1-2" area. PLANNING COMMISSION ACTION: (November 14, 1989) The application was represented by Jack Larrison. There were two interested property owners in attendance. Mr. Larrison said that there were two issues associated with the request, right-of-way dedication and the buffer area along the east side of the proposed "1-2" rezoning. Mr. Larrison said the property owner would prefer a 50 foot "R-2" area and not zone the buffer to "OS". He then agreed to the 2 November 14, 1989 1 tem No. 10 - Z-5259_ (Cont i.nu.e_d) right-of-way dedication for Baseline Road. Staff addressed the buffer issue and recommended a 50 foot "OS" area along the east side of the 111-2" parcel. Mr. Larrison responded by saying that the property was for future expansion and "R-2" allowed more flexibility. Jack Burcham, a property owner to the east, addressed the Commission. He asked whether the 50 foot buffer could be extended to Baseline Road and questioned the right-of-way dedication. Jerry Gardner, of the City Engineering staff, said that more right-of-way was needed for Baseline Road to meet the Master Street Plan standard. David Noble, 4013 Baseline Road, did not object to the rezoning but asked some questions. Mr. Noble wanted to know if the City would change the land use plan for the south side of Baseline Road. Staff indicated that the area had to be studied before a realistic response could be made. Mr. Larrison spoke again and asked if a fence could be maintained in an "OS" area. He said the 200 foot "R-2" area on the west side would remain and be left undisturbed. There was a long discussion about various issues and Mr. Larrison agreed to a 50 foot "OS" area along the east side of the "1-2" tract. A motion was made to recommend approval of 110-3" and "1-2" with a 50 foot "OS" strip along the east side of the "1-2" area. The motion was approved by a vote of 10 ayes, 0 nays, 0 absent and 1 abstention (Martha Miller). 3
