AN ORDINANCE TO APPROVE A PLANNED ZONING
DEVELOPMENT AND ESTABLISH A PLANNED COMMERCIAL
DISTRICT TITLED ROCK CREEK CROSSING REVISED SHORT -
FORM PCD (Z -5258-D), LOCATED AT 12206 WEST MARKHAM
STREET, LITTLE ROCK, ARKANSAS; AMENDING THE OFFICIAL
ZONING MAP OF THE CITY OF LITTLE ROCK, ARKANSAS; AND
FOR OTHER PURPOSES.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
OF LITTLE ROCK, ARKANSAS:
Section 1. That the zoning classification of the following described property be changed from PCD
to Revised PCD:
Lot 2R, THJR Addition, to the City of Little Rock, Pulaski County, Arkansas containing
2.9825 acres, more or less.
Section 2. That the approval of Rock Creek Crossing Revised Short -Form PCD (7..-5258-D), located
at 12206 West Markham Street, is subject to compliance with the following additional conditions:
That the preliminary site development plan/plat be approved as submitted, including all
staff comments and conditions as outlined in the Planning Commission Agenda Staff
Report in paragraphs D, E, F and including any conditions indicated in the staff analysis
in paragraph H and subject to additional conditions imposed at the Planning Commission
Public Hearing as amended by the applicant.
Section 3. That the preliminary site development plan/plat be approved as recommended by the
Little Rock Planning Commission.
Section 4. That the change in zoning classification contemplated for Rock Creek Crossing Revised
Short -Form PCD (Z -5258-D), located at 12206 West Markham Street, is conditioned upon obtaining a
final plan approval within the time specified by Chapter 36, Article VII, Section 36-454 (e) of the Code of
Ordinances.
Section 5. That the map referred to in Chapter 36 of the Code of Ordinances of the City of Little
Rock, Arkansas, and designated district map be and is hereby amended to the extent and in the respects
necessary to affect and designate the change provided for in Section l hereof.

I Section 6. That this ordinance shall not take effect and be in full force until the final approval of the

3 Section 7. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
4 word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or
5 adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and
6 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the
7 ordinance.
8 Section 8. Repealer. All laws, ordinances, resolutions, or parts of the same that are inconsistent with
9 the provisions of this ordinance are hereby repealed to the extent of such inconsistency.

The request is to revise the PCD to add restaurant, retail
and business office uses as allowable uses. The existing
building will be remodeled and two additional buildings
will be added.
None.
Staff recommends approval of the requested PCD zoning.
The Planning Commission voted to recommend approval of
the requested zoning by a vote of 7 ayes, 0 noes and
4 absent. The City Beautiful Commission reviewed the
request for variances from the Landscape Ordinance
requirements and voted to approve the request at their
March 1, 2012, public hearing.
The Planning Commission reviewed the proposed PCD
request at its January 5, 2012, meeting. There were no
registered objectors present. All property owners located
within 200 -feet of the site and the Point West/Timber Ridge
Neighborhood Association were notified of the Public
Hearing.
BACKGROUND
In 1994, the City of Little Rock Board of Directors
approved Ordinance No. 16,762 which rezoned a portion of
the property from C-2 to C-3. In January of 1993 a
Short -form PD -C was approved for a one-story retail
building containing approximately 7,553 square feet. The
PD -C approved tenant for the site was ABRA Auto Body
and Glass Shop. Access to Lot 1 was from West Markham
via a 25 -foot drive through Lot 2. Lot 2 was not developed
at that time.
Ordinance No. 17,468 adopted by the Little Rock Board of
Directors on May 6, 1997, established THJR Addition
Lot #2 Short -form PCD rezoning to allow an automobile
sales lot. Lot 2 was developed with a 13,200 square foot
building with 209 parking spaces and used for automobile
sales. The building consists of 9,000 square feet on the first
floor for sales and service with an additional 3,600 square
feet on the second floor for parts and general office.
Resolution No. 11,526 of the City of Little Rock Board of
Directors dated June 3, 2003, authorized the purchase of a
1.74 -acre tract of land from the City of Little Rock by the
applicant. Subsequently, Ordinance No. 19,022 was
adopted by the Little Rock Board of Directors on January 6,
2004, which allowed the rezoning of the 1.74 -acres of
property from OS, Open Space to PCD. The area was
included in the previously approved PCD. The
development was proposed as a two phase development.
The first phase would consist of a 7,200 square foot service
facility and approximately 80 parking spaces. The second
phase was to be a parking expansion consisting of
85 spaces. The spaces would be used for inventory as well
as parking for cars waiting to be serviced. The new
building was not constructed on the site.
The proposed development is located at 12206 West
Markham Street. The site encompasses 2.96 acres of land
and is currently zoned PCD and utilized as an automotive
dealership. The request is to revise the PCD to add
restaurant, retail and business office uses as allowable uses.
The existing building contains 9,773 square feet and houses
the showroom and service area for the automobile
dealership. The applicant is proposing to remodel the
existing space to be used as C-3, General Commercial
District uses.
BACKGROUND
CONTINUED
The development will also consist of construction of a
single story 7,377 square foot building located directly to
the west of the existing structure. This building is proposed
with C-3, General Commercial zoning district uses as
allowable uses. The applicant has indicated within the two
buildings along West Markham Street a total of
8,000 square feet of restaurant space will be available.
The development is proposed with the future construction
of a 20,000 square foot two-story office building in the
northeast corner of the property. The building will contain
0-2, Office and Institutional District uses and the permitted
ten percent accessory uses. A total of 164 parking spaces
will serve the three buildings.

I certainly hope you are doing well and that your holiday season is
going as planned.
Per our discussion late last week, I am attempting to address several
points of concern regarding our application to rezone the property
located at 12206 W. Markham. Please refer to the following items:
1) Staff has requested that the parking area to the west of the
property be realigned to allow northbound traffic on the left of the
parking area and southbound traffic on the right. We will comply with
this request. We still plan on allowing traffic to exit the parking
area using the driveway in front of the proposed 7,377 SF buliding.
2) Staff has requested that parking in front of the existing
dealership building be altered to allow angled parking. We will
comply with this request. However we ask that the existing curb
located at this parking area be allowed to remain "as -is". The
existing parking arrangement was accomplished at a time when landscape
setbacks were not as stringent. It would be prudent to say that
location of utilities and other facilities were also less stringent
when the property was first developed. We are fearful that doing any
construction on this specific portion of the parking area would result
in damage to sewer, gas, fiber optics, or any other underground
utilities that currently exist under that specific portion of the
parking area. Within our title search, we've discovered several
occasions where special conditions have been made to this property in
order to accommodate utilities. We ask that staff consider our
request to keep the parking area of this specific portion of the
property undisturbed as a condition of our application.
As always, our hope is to work with planning staff in order to create
the best possible development for the citizens of the city. With that
being said, we hope that this pleases any remaining conditions or
questions regarding our application for PCD rezoning of this property
and that staff will support our application. If any member of staff
feels that denial of the application is in order, PLEASE do not

Site plan must comply with the cities minimal landscape and buffer ordinance
requirements.
The zoning ordinance requires an average seventeen -foot (17') wide street buffer
along Markham Street, in front of the proposed restaurant. In no case can this
amount be less than nine foot (9') in width.
The zoning ordinance requires an average twenty-seven foot (27') wide street
buffer along the remainder of Markham Street, in front of the existing retail space.
In no case can this amount be less than thirteen foot (13') in width.
The landscape ordinance requires a minimum nine -foot (9) wide perimeter
landscape strip around the sites entirety. There are currently parking spaces,
driveways, backup areas, and perhaps dumpster pad areas within this area; revise.
These must be removed. A variance from this minimal city ordinance will
require a variance from the City Beautiful Commission prior to the issuance of a
building permit.
A small amount of building landscaping will be required.
The landscape ordinance requires a minimum of 8 % of the paved areas be
landscaped with interior islands of at least 7 Meet in width and 300 square feet in
area. Proposed plan does not currently reflect this minimum. Interior islands are
to be evenly distributed throughout the property.
An automatic irrigation system is required.
Prior to the issuance of a building permit, it will be necessary to provide
landscape plans stamped with the seal of a Registered Landscape Architect.
The City Beautiful Commission recommends preserving as many existing trees as
feasible on this site. Credit toward fulfilling Landscape Ordinance requirements

Markham Street. The current proposal reflects parking within this area; revise.
The landscape ordinance requires a minimum nine -foot wide (9') landscape

building permit. This site is located within the designated mature area of the city;
therefore, this amount can be reduced down to six foot nine inches if needed.

outward, a wall or dense evergreen planting, is also required along the northern

Dear Mr. Carney:
Please find the included application for consideration of approval the proposed development of Rock
Creek Crossings. The proposed development is located at 12206 W. Markham St. in Little Rock. The
site encompasses 2.96 acres of land and is currently utilized as an automotive dealership. The property
is currently zoned as a planned commercial development. The proposed zoning would also be P.C.D.
and would utilize restaurant, retail, and business office uses.
Currently, a building consisting of 9,773 SF exists on the site. Our company proposes to add
approximately 1,505 SF of space to the existing building to create a total of 11,278 SF. This building
would be utilized as retail space with C3 associated uses.
The development would also consist of a proposed single story building located directly to the west of
the existing structure that would house 7,377 SF of space. 6,000 SF of this proposed structure would
be utilized as restaurant space with the remaining 1,377 SF utilized as retail space.
We also propose to construct a two-story office building to be located in the NE corner of the property.
This structure would house approximately 20,000 SF of space that would utilize 0-2 associated uses.
The proposed Rock Creek Crossings development would be completed following all applicable codes

OFFER & ACCEPTANCE
1. BUYER & SELLER. Rowan Development, LLC, or its assigns, hereinafter referred to as "Buyer," offers to buy, subject to the terms set forth
herein, the below described property from Crain Investments, LP., hereinafter referred to as "Seller."
2. PROPERTY DESCRIBED AS: Lot 2R, T.H.J.R. Addfdon to the City of Little Rode, better known as 12206 West Markham Street, Little Rock,
Arkansas and shown on Exhibit B.
3. PURCRASE PRICE: The Buyer will 4W or the property, payable in cash at closing.
4. SPECIAL CONDITIONS: Buyer's Offer is conditioned upon satisfaction of the Spedal G nditlons attadl reto on Exhibit A.
5. EARNEST MONEY: Within three (3) business days of acceptance, Buyer will tender a check f� be deposited as earnest money
which shall apply to purchase price or dosing costs. Earnest money shall be held in escrow by Standard A siraet. If We requirements are not
fulfilled, or N those Special Conditions providing for an earnest money refund are not satisfied, the earnest money deposit shall be refunded to
Buyer. If Buyer falls b fulfill his obligations or if, after all conditions have been met, Buyer fails to dose this transaction, the earnest money may, at
the sole and exclusive option of the Seller, be retained by the Seller as liquidated damages. Attematively, Seller may return the earnest money and
assert as legal or equitable rights which may exist as a result of Buyer's breach of oonb act.
6. CONVEYANCE: Conveyance shall be made to Buyer, or as directed by Buyer, by general warranty deed, except it shall be subject to recorded
restrictions and easements, if any, which do not materially affect the property.
7. TITLE INSURANCE: Within fourteen (14) days of acceptance, Seller shag furnish to Buyer a corrmillment for an American Land Title Association
(ALTA) owner's title insurance policy in the amount of the purchase price issued by a company authorized to insure We to real property in the State
of Arkansas and which company is reasonably acceptable to Buyer. Where the We commitment shows special exceptions to title other than those
standard exceptions contained In the ALTA oammilrrient farm, and where such special exceptions relate to restrictions, conditions, defects or other
matters which would interfere with Buyer's use or adversely affect the value of the premises, then within ten (10) days of delNeiy of the title
commitment, Buyer shall deliver written notice Iftereof to Seller. Such notice shall state specifically those exceptions to which Buyer objects. All
objections not specifically enumerated within such a timely delivered notice shall be deemed to be waived by Buyer.
Within fourteen (14) days of Buyer's doINefy of notice of objections to Setter, Saber may arra such objections or have the exceptions waived or
removed by fhe We company issuing the oommitment. If, within such fourteen (14) day period, Seller fails to cure andlor have waived such
objections and exceptions, of within that period, Seiler delivers written notice to Buyer that it will not so cure, then, within three (3) days from delivery
of such notice from Seller or the end of the per od within which Setter may cure (whichever is applicable), Buyer shall have the option to:
a) Terminate this agreement by delivering written notice thereof to Seller, in which evenl all sums paid or deposited by Buyer shall be returned to Buyer, or
b) Purchase Me premises subjed to such objections and exceptions with no reduction in the purchase price; or
c) Agree to extend the dosing date for thirty (30) days, to give Seller additional time to cure such objections.
If Buyer fails to dealer notice of termination or grant an extension of the dosing date within that period, the objections shall be deemed to be waived
and this condition shall be satisfied.
Seller shall furnish the committed owner's title insurance policy as soon as practicable after dosing, and shall pay all expenses related to the
owner's title insurance policy.
8. PROBATIONS:- Taxes and special assessrments due on or before dosing shall be paid by Seller. Any deposits on rental property are to be
transferred to Buyer at das+ng. insurance, current general taxes and spedal assessments, rental payments, utirrties, and any interest on assumed
loans shall be prorated at dosing unless otherwise specified herein.
9. CLOSING: Closing shag occur at such time as mutually agreed by the parties, provided that the date shall be no later than twenty-one (21) days
after removal of all aoriditions and NO EARLIER than January 3, 2012, unless such requirement is waived in writing by both parties and a new date
substituted therefor. Unless otherwise agreed by Buyer and Seller, transaction costs will be paid by the party indicated below:

purchase price.
12. INSPECTIONS AND REPAIRS: Buyer certifies that Buyer hes inspected or will inspect the property and is not retying upon any warranties,
representations or statements of any agent or Seller as to age or condition of improvements, other than those specified herein.

SPECIAL CONDITIONS
