STAFF ANALYSIS:
The request is to rezone 2.8 acres on West Markham from
110-3" to "C-3" for an unspecified commercial use. This
section of roadway used to be called Rock Creek Parkway but
with construction and the renaming of the Parkway connection
to Chenal Parkway, West Markham has been shifted to the
north. Chenal Parkway and West Markham will intersect at a
point just west of the existing "R-5" land shown on the
accompanying sketch. The acreage is wooded with a 100 foot
AP&L easement along the west property line and a 50 foot
Water Works right-of-way running east and west.
Land use in the general vicinity includes a drive-through
bank facility, commercial uses and some AP&L offices. The
majority of the land is still vacant, especially on the
north side of West Markham. The only exception is the
northwest corner of Bowman Road and West Markham which is
the location of the banking operation. The acreage
adjoining the site on the east and north sides is existing
park land and some land to the northwest is identified as
proposed park land on the Master Parks Plan. Zoning is a
mix of "R-2", "R-5", "MF -12", "O-3", "C-3" and "1-2".

The 1-430 Land Use Plan identifies the site for commercial
use but staff is concerned with the 11C-3" rezoning of the
property and cannot endorse it. In this situation, staff is
of the opinion that a reclassification of the property
should be accomplished through a PCD for a real project.
The PCD process would provide the necessary review to ensure
that the proposed development is compatible with the parkway
environment and protect the integrity of the City's park
land. Also, the zoning on the north side of West Markham is
multifamily residential, so a proposed project for the
property should be reviewed in the context of a residential
setting and being somewhat removed from the existing
commercial development. Finally, the location of existing
easements could restrict or place some restraints on the
land and a PCD would better determine the feasibility of
developing the site.

None reported.
STAFF RECOMMENDATION:
Staff recommends denial of the 11C-3" rezoning request.
PLANNING COMMISSION ACTION: (November 14, 1989)
The applicant, Joe White, was present. There were no
objectors. Mr. White amended the request to 11C-2" and the
item was placed on the consent agenda. A motion was made to
recommend approval of the 11C-2" rezoning as amended. The
motion was approved by a vote of 11 ayes, 0 nays and
0 absent.
